F.O.P. Appeals Court Ruling


Appeals court affirmed the ruling by the Circuit Court that the Charter Amendment is unconstitutional! HERE.


Hasn't anyone found it interesting how the MSM hasn't even touched this information.

Joe, here I thought the whole time that our deputies did have the Collective Bargaining with binding arbitration that I voted for when I voted for Mike Lewis. You are right when you say the MSM has stayed away from this. But, lately Sby News is where I've been getting most of my information from. I am very disappointed that I did not know this whole time that my vote "did not count" to give the deputies the collective bargaining with binding arbitration that I voted for that year. Thank you again as always for informing the public Joe.

So the courts have legislated from the bench once again! They have effectively overruled the voice of the people when it was exercised in a manner consistent with the law (the county charter). The referendum method was included in the county charter as a way to give the PEOPLE the final say in how their local government operates. The best part of it is that the County Council used taxpayers dollars to pay a Baltimoron attorney to overrule the voice of the people. Well it's like this. Elections are coming. If We The People don't vote these idiots out of office, we have let our country go down the tubes.

If the FOP had done it right, it would be in place today. THEY made the mistake.
Go ahead and blame the elected officials, they're not the ones who did it wrong.
If a major developer comes in and does it wrong but the the elected officials approve it, you all would be barking how bad that deal was and they shouldn't have approved it.
You can't have it both ways!
The way I see it is the elected officials actually protected the taxpayers on this one.
Do it right the first time and stop wasting the taxpayer dollars tying everything up in the courts.
This should tell you all what happens when you approve collective bargaining anyway. This is just the start of the legal battles the taxpayers will be footing the bill for!
The FOP could care less about the taxpayers, they're only interested in trying to get more more more for the police. They don't care how high your taxes go to pay for it and they don't care if the police do a better job. They only care about the $'s!

12:26 it doesn't matter what you personally think! More than 71% of the voters voted for it. They followed the law as it was written in the charter. The elected officials hung their hats on an old "Clintonesque" tactic.....it depends on what the meaning of the word "is" is. It's bullsh*t. The people spoke and the elected officials did what THEY wanted to do - screw what the voters think.

To Anon 12:26 I believe I know who you are. I recently attended a meeting in which I learned that Ocean City has actually saved money with this system. That 90% of the other jurisdictions that have allowed thisa did it in good faith. The councils that is. They believed in their officers. Some came after voters gave an overwhelming vote to do it. Just like here in Wicomico County.

This is where it gets ugly. 18000+ said give it to the deputies. The County Exec. said give it to the deputies. Yet seven council members said NO ! What follows is even better. The council stated it was an uneducated vote. The people did not know what they were voting for. LOL Well we are kinda stupid we did elect the current council body.

O.K. here is what I see as the major difference other jurisdictions had the same voter outcome. They did hear the peoples voice and made it work. They met in the middle found ways to keep the issue out of the courts. The F.O.P. tried to keep this out of the courts. Rick Pollitt and Mike Lewis tried to keep it out of the courts. The council comprised of seven people defied 76% of th overall vote. Just how arrogant are you people.

I am aslo aware that attempts were made to work it out since then and the request has fallef on deaf ears. I will not vote any encumbant back into office. Lewis and Pollitt do not fall into that bunch. They tried to do what was right. If nothing else get the deputies disability and a retirement they can live on.

Where is the money that over seventy deputies paid into the system and never became vested ? Is that lost money like they seem to lose on a regular basis? Is that the pattern of conduct the council wants. Get them to leave beore they are vested. How many deputies have retired from this system. Mike Lewis these are questions your staff needs the answers to. If anything the council better respect you. None of them have one fifth the voter support you do.

Did the council pay into E. Bakers retirent account just after the court ruling came out in Wicomico. The county tax payers have a right to know this.

I think Rick Pollitt needs to meet with the F.O.P. and grant collective bargaining from his shop. Then let the cards fall where they may. I know he has the deputies best interest at heart. Do the right thing Rick. It will have dividends ten fold. That I can assure you. The F.O.P. has financial backing of the State F.O.P. and the National F.O.P. on this matter. I recently learned there are projects underway to exspose those who defied the voters. This action by Wicomico's Council has gained national attention in the police world. It has angered and offended men and women accross the country who serve and protect. I dont think anyone would have guessed the recent attention this matter has gained. It is simply embarrassing we have fallen under the national eye.

There was a meeting in Annapolis among all the state lodges and they have all pledged financial and physical support to continue this fight. The National F.O.P. is watching and waiting for the State Lodge to say the word.

It is time to recognize the price paid by your men and women who serve so courageously. They are fine county citizens who chose to protect us all. I do not see what they are asking for is so far fetched that anyone could look at this matter with such defiance as the current council has.

The bottom line is work this out because it is not going away. The fight in these men and women is here to stay. This matter will be resolved one way or another. I do not think forcing a long and drawn out legal battle is the way to go over the misplacement of a single word in the language the the question "A" voter iniative.

18000 can not be worng even if you feel they are. They put you there and the will of the people should take some kind of priority over your bias.

Your dead wrong, deputies do care about the tax payers, because most deputies are tax payers and conservatives.

You just sound anti-police. Deputies want a good disability for thier family. They may be injured on this job and may not be able to work anymore. I want the comfort to know that my two baby girls are taken care of, if i am critically injured, GOD Forbid!.

Anon 1256, your biggest worry when you go to work is that coffee stain on your tie, but we play with criminals that carry guns, knives, bats, fist, etc....Yes, we signed on to this job knowing this, but most of us just want to prepare for the worst, for our family.

If your looking at the trimming the fat, start with all these social welfare programs and how the drug dealers and other criminals take advantage of us, the tax payer.

Instead of bashing the police, who work hard, try targeting the leaches who never had a job and leach off our system everyday, with endless pockets.

For the record, I never bashed the police. I bashed the FOP.
Do I believe the police deserve their fair salaries and benefits?
Yes, I do. But they're going about it all wrong, in my opinion and I'm entitled to my opinion just as well as you are.
If you want collective bargaining, the put it in place. You don't need the FOP to do it. It can be mutually agreed upon.
When you bring in an outside organization which bullies their way in and bullies you with their "demands", no wonder people can't work together.
Let your feathers settle (on both sides) and you might get something done!
As far as the dangers of police work, yes, they knew what they were signing up for and God Bless them for doing so. I couldn't do their job and don't want to but don't hold the dangers of the job over my head as a taxpayer every time you turn around and demand more pay because of the dangers you knew were there.
I will also say it again. The FOP messed up. What was voted for was not legal. So go back to square one and start over, if you must involve the FOP.
As far as sounding Anti-Police, if that's the way you read it, that is your option but I've gotta say that the couple of posts from the police prove my point.

5:01 Right on! I remember how the FOB messed it up and then to save face they blamed it on the seven members of the council. My advise, FOB, go back and read(and understand) the laws that govern this county. Quit crying and quit costing us, the taxpayers, more money. Deputies deserve good benefits, good wages and good support from their organization.
A few of you in the FOB are not
representing your own "brothers & sisters" like they should be represented because of your pride. You want to win at any cost. Well,
the big man spoke, please listen to him---what you are trying to do is unconstitutional.

Here is what I am hearing

The community backed Wicomico County Officers and voted in favor for them.

The police did not have their ducks in a row and apparently they or their lawyers did not know how to put this vote into place to make it count.

What I do see is that most police officers of today know the term me but have forgot we. Mr. Officer if you want me to back you, then how about giving back to the community when you are not getting paid.

I was with James "Jim" Mathias he stated he totally supported it. That is was a great way to work "within" the budget. It is not a union. Those that state that are confused. It gives an independant party a chance to llok at what is needed and bargain for it. No one os bound to anything if it is not fair.

As for the F.O.P. They trusted the county attorney to do the right thing. It appears he did not. This same attroney was brought into the current retirement. This was tax dollars that bought a man into the counties system. Does anyone have a problem with this. Was it a reward for screwing the deputies. Why did the county prepare a labor law. DO YOUR HOMEWORK !!! On this one it is about to get ugly.

Lawyers make a fortune on these matters. Ask any member of council when is the last time they sat and asked any county employee what they needed. It should be a hoot. They do not do it.

All I ask is for all sides to be heard. I voted for i know many cops. This just seems odd to me. I can see the national attetion it will get. It is an election year. The council was right in black and white. Why did they not work something out to save a ton of money. Better yet give the deputies the same benifits evryone around them doing the same work has. Its a no brainer. I think that would solve a majority of the problems.

I live on retirement anf I feel for these guys. The benifits are horrible.

F.O.P. you have my suuport now and at the poles.

It was the duty of the council when 18,000 spoke to listen. Watch over the people not dictate them. No one crying at the F.O.P. that I have heard. They just want justice.

All the negative post are council members. It is just to the point of being comical.
