AP: House Health Care Bill Exceeds $1 Trillion

Cost over a decade much higher than target President Obama has set

WASHINGTON - Health care legislation taking shape in the House carries a price tag of at least $1 trillion over a decade, significantly higher than the target President Barack Obama has set, congressional officials said Friday as they struggled to finish work on the measure for a vote early next month.

Democrats have touted an unreleased Congressional Budget Office estimate of $871 billion in recent days, a total that numerous officials acknowledge understates the bill's true cost by $150 billion or more. That figure excludes several items designed to improve benefits for Medicare and Medicaid recipients and providers, as well as public health programs and more, they added.

The officials who disclosed the details did so on condition of anonymity, saying they were not authorized to discuss them publicly.

Are You Serious

When Asked Where the Constitution Authorizes Congress to Order Americans To Buy Health Insurance, Pelosi Says: 'Are You Serious?'

When CNSNews.com asked House Speaker Nancy Pelosi (D-Calif.) on Thursday where the Constitution authorized Congress to order Americans to buy health insurance--a mandate included in both the House and Senate versions of the health care bill--Pelosi dismissed the question by saying: “Are you serious? Are you serious?”

Pelosi then shook her head before taking a question from another reporter. Her press spokesman, Nadeam Elshami, then told CNSNews.com that asking the speaker of the House where the Constitution authorized Congress to mandated that individual Americans buy health insurance as not a "serious question."

Pelosi's press secretary later responded to written follow-up questions from CNSNews.com by emailing CNSNews.com a press release on the “Constitutionality of Health Insurance Reform,” that argues that Congress derives the authority to mandate that people purchase health insurance from its constitutional power to regulate interstate commerce.

Brianna Brinkley/Anitra Pirkle

Today Judge Don Davis sentenced Brianna Brinkely to Life Imprisionment for her role in the Carjacking/Murder of Anitra Pirkle on January 22, 2009. Brinkely was the second defendant to be sentenced for this Murder. Kenneth Alvira had received Life Without the Possibility of Parole and a thirty year concurrent sentence for Armed Carjacking.

The State sought a sentence of Life Without Parole, but the Court, citing the fact that there was not evidence that Brinkley actually inflicted the stab wounds herself, imposed the Life Sentence. By filing the LWOP Notice, it automatically means that Brinkley will not be eligible for parole until she serves at least 25 years of her sentence before eligibility kicks in. In addition, on any Life Sentence in Maryland the Governor's consent is required before anyone is released on parole. The State believes that the sentence imposed is a fair one.

By State's Attorney Davis Ruark, "The family of Anitra Pirkle is relieved that the second person has been sentenced for her role in the carjacking and murder of Anitra. Nothing can ever make up for the loss of Anitra, a young lady who did everything right. This senseless, random act of murder is repulsive to us all. The exceptional police work of the Wicomico Bureau of Investigation and the Maryland State Police Homicide Unit ensured that the three were captured and successfully prosecuted. I am grateful to all of the investigators involved."

The third defendant, Brittany Barkley, is scheuled for sentencing on December 1st. The State is seeking Life Without the Possibility of Parole and consecutive sentences in that case.

Kratovil Introduces Legislation to Cut Taxes On Small Businesses Owners Seeking to Reinvest in Their Companies

Small Business Property Reimbursement Act extends $250K tax deduction for small businesses through 2010 to help spur economy and create jobs.

Washington, DC – Today, Rep. Frank Kratovil introduced HR 3898, the Small Business Property Reimbursement Act. The legislation will extend a key tax deduction for small business owners that invest in new equipment for their businesses. Specifically, Kratovil’s bill will extend a provision of the tax code that allows small businesses to expense up to $250,000 of the total cost of qualified assets purchased for business purposes. If Kratovil’s extension does not pass, this deduction will decrease to $125,000 at the end of this year.

Rep. Kratovil’s bill would extend an enhanced Sec. 179 of the Internal Revenue Code through 2010 representing a significant tax subsidy for business investment. “Instead of bailing out giant corporations, we ought to focus on strengthening the small businesses that support our local economies and drive economic growth,” said Rep. Kratovil. “My bill provides much needed tax relief that will allow small business owners to re-invest and create new jobs.”

The higher expensing allowance is designed to increase business investment by augmenting the cash flow of firms that rely heavily on retained earnings to finance their investments. Expensing can increase a firm’s cash flow in the short run because it allows the firm to deduct the full cost of qualified assets in the tax year the firm places them into service. The legislation also serves to simplify the tax code by allowing an immediate deduction, instead of depreciation deductions over a specified recovery period.

Click here to read the bill.
Kratovil’s bill has drawn praise from a number of small business advocacy organizations, including the National Association of Manufacturers (NAM) and the National Federation of Independent Businesses (NFIB). “The expanded expensing provision helps smaller manufacturers by lowering the after-tax cost of investing in new equipment and generating new orders from customers,” according to Dorothy Coleman, NAM Vice President of Tax and Domestic Economic Policy. “Extending this incentive through 2010 will enhance the effectiveness of the provision to spur desperately needed business investment and job creation.”
“We appreciate Representative Kratovil's efforts in introducing HR 3898. This legislation will provide small businesses with incentives and certainty to make new investments in their business. This is especially important in the current economic environment where small business hiring, capital spending and earnings are at record lows," said Brad Close, NFIB Vice President for Federal Public Policy. “If Congress wants to encourage small business owners to start investing in capital spending, then it is critical that they extend section 179 expensing limits. HR 3898 provides the kinds of tools and incentives that small businesses need to expand and grow their businesses. Small businesses are the engine of our economy, generating seven out of ten new jobs and leading our economy out of past recessions. The NFIB thanks Representative Kratovil for standing up for small business owners, our nation's job creators," said Close.

HR 3898 is the second small business tax incentive bill introduced by Kratovil since taking office in January. Earlier this year, he joined with Rep. Chris Lee (R-NY) to introduce H.R. 1552, the Small Business Formation and Job Creation Act, which would increase the maximum deduction for business start-up expenses to promote the creation of new start-up small businesses.

Kratovil has also voted in favor of the Small Business Research and Innovation Act, legislation designed to create new jobs and boost the economy by supporting small business innovation in research and technology. Rep. Kratovil offered an amendment to the legislation that raises the award ceilings for veteran-owned small businesses and creates new incentives for the formation of technology-based companies to compete for defense and homeland security related contracts awards, allowing veterans to capitalize on their service experience.

Rep. Kratovil Backs Coast Guard Reauthorization With Stronger Penalties for Illegal Immigration

Kratovil amendment to assess Coast Guard facility shortcomings passes unanimously; Maryland’s Oxford station is housed in temporary trailer and lacks a pier

Washington, DC – Today, Rep. Frank Kratovil joined a bi-partisan majority in backing HR 3619, the Coast Guard Reauthorization Act. This bill authorizes $10 billion for the Coast Guard in FY 2010 and provides for a 1,500 person increase in Coast Guard personnel, for a total of 47,000.
Kratovil lauded the bill for incorporating the provisions of H.R. 1029, Alien Smuggling and Terrorism Prevention Act, which the House passed by voice vote on March 31, 2009. These provisions ensure that the United States takes a comprehensive approach to combating smuggling both on land and at sea by authorizing punishment for persons who bring, recruit, encourage, transport or harbor an illegal alien knowing or in reckless disregard of the fact that the individual is without authority to enter the United States. The bill gives law enforcement stronger tools and also significantly enhances federal penalties for alien smuggling – raising it to a felony from a misdemeanor.

HR 3619 also requires the Department of Homeland Security to cross-check smugglers and illegal immigrants who are apprehended with terrorist watch lists to ensure that potential terrorist threats are stopped right at the border.

“Coastal and shoreline security goes hand in hand with putting a stop the illegal immigration that is draining our national resources,” said Rep. Kratovil. “This is a good bill that will give the Coast Guard the tools that they need to be an effective component of our national security while increasing the penalties for illegal immigrants as well as those who seek to bring them within our borders for personal profit.”

Rep. Kratovil introduced an amendment to H.R. 3619 to assess the prevalence and effects of the Coast Guard operating out of temporary facilities and buildings. The amendment passed unanimously. The amendment requires the Commandant of the Coast Guard to conduct a national study on the facility infrastructure requirements needed to fulfill the Coast Guard’s prescribed missions and capabilities.

In Maryland’s First District, the Coast Guard station at Oxford operates out of a double-wide, temporary trailer, which it shares with the National Oceanographic and Atmospheric Association. The Oxford station also lacks a pier, forcing the Coast Guard to lease space at a commercial pier nearly a mile away from the temporary trailer. Kratovil is concerned that this and other “temporary” arrangements could be affecting operations and mission capability.
The amendment requires a report to Congress that must include:
· An assessment of any shortfalls in facility infrastructure, including the extent of the use of temporary trailers;
· An inventory of the number and type of new facilities needed to meet the service’s mission; and
· A plan for how the Commandant of the Coast Guard will develop the appropriate facility infrastructure, including timelines, budgets, and any additional legislative authority the Commandant determines is required to implement the plan.
Click here to read the amendment.

“The amendment is a common sense means toward ensuring those entrusted with protecting our coast and shorelines are being given the right tools and facilities to do so effectively,” said Rep. Kratovil. “I am pleased that my colleagues are equally committed to ensuring the Coast Guard has top notch facilities and infrastructure in order to effectively play their part in keeping America safe.”

Home sales rise 9.4 percent in September

‘There's a mini-boom going on in the housing market,’ pollster says
WASHINGTON - Home resales rose in September to the highest level in more than two years, beating expectations, as buyers scrambled to complete their purchases before a tax credit for first-time owners expires.

The National Association of Realtors said Friday that sales rose 9.4 percent to a seasonally adjusted annual rate of 5.57 million in September, from a downwardly revised pace of 5.1 million in August. Sales had been expected to rise to an annual pace of 5.35 million, according to economists surveyed by Thomson Reuters.

The median sales price was $174,900, down 8.5 percent from a year earlier, and slightly lower than August's median of $177,300.

MDE Nails Z's Country Store In Parsonsburg

Some time ago the Quick Stop, (also owned by the Z's Country Store) was required to removed the old gas tanks and the MDE found they had leaked pretty bad and the soil was contaminated. The MDE made them remove the soil and it was required to have a plastic liner underneath and over top of the contaminated soil. The above image is that soil and as you can clearly see, it's not covered.

The above image is a shot from a different angle of the same piles of dirt required to be protected and it is not.

If you think that's bad, WAIT, it gets even worse. Recently en elderly farmer in some way or another worked out a deal to take away what he thought was simply dirt. He showed up with a front end loader and started taking the dirt away and then placed it on different right of ways in Parsonsburg, (shown above).

The same farmer also started storing this same soil on his farm, not knowing it was contaminated, (above).

Once again, Salisbury News breaks exclusive stories the Main Stream Media has no interest in. Here's what's most concerning. Many properties in Parsonsburg have very shallow wells. I'm talking wells that are only 20 feet deep.

The MDE (Ross Kelly) is on the scene right now as I publish this article. The MDE has confirmed that the soil is contaminated and before the property owner could do anything with the soil, it was to be tested, (as required by law) and the results sent to the MDE. The MDE has absolutely no record whatsoever of this soil being tested and will demand it be done immediately.

Because the owner has not submitted documentation, the MDE has to assume the soil is contaminated. No one is permitted to take the soil and it is to be quarantined. We already know the soil has been removed and spread on local roads. The owner of the property could face huge civil fines.

I'm sure there will be more to come but if you live close by you may want to contact the MDE and have your water tested.

AFP UPDATES

AFP Wicomico County - LAZER FOCUSEDMeeting and Activities
October 2009
Dear Joe,
Greetings! It's been a while since I have sent you an email. There has been a lot going on, keeping me busy! I hope to give you an update of some of the happenings in this email. First and foremost our efforts to stop the crazy spending in Washington and socialized Healthcare are paying off! Now is not the time to slack off! 2010 is just around the corner and we need to continue to beat back big government and influence the political spectrum.

AFP Wicomico Meeting THIS Monday (10/26) at 6pm at Adams Ribs on Route 13 in Fruitland
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
It's been a long busy month since we last met and much has happened and much is planned! Please be sure to attend this meeting THIS Monday and bring a friend or 10. AFP has grown so large on the Eastern Shore, we have decided to break up the counties to expand our efforts and give more access to local county residents. That being said; we need to grow the effort in Wicomico, as there is much work to do here and all over the state as well as nationally. Please consider bringing a friend or two to the meeting and forwarding this email to anyone concerned about the direction our government is taking. This meeting will feature a visit from Delegate Eckerd and we have upcoming plans to involve you with; including private meetinga with elected officials as well as a huge state event upcoming in Annapolis. Additionally, we plan to discuss and educate you on the political happenings in our state and country give you a vehicle to put into action at this next session. We also hope to share with you methods on how you can influence this next election cycle.
The State of the State
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
As I am sure you aware, Maryland is TWO BILLION DOLLARS short of their budget and they are taking back state promised funds from all counties causing the domino effect. Wicomico is now over 4 million dollars in the hole, even after the furloughs. Please make sure you attend the NIGHT MEETING/Public Hearing schedule for Tuesday November 10th at 6pm in the Midway Room at the Wicomico Youth and Civic Center, to discuss how they are going to deal with this and the cuts necessary to balance the budget. Additionally we need a good showing to once again make our voices heard for transparency in government and REGULAR night meetings. So, put it on the calendar and we'll discuss our strategy more at next Monday's (10/26) meeting. For more information on this; please click here to check out my commentary on it.

Salisbury has some issues too. Taking stimulous monies for things they don't need, like a million dollar fire boat. Some things are just unbelievable. It's time to take action on all levels of the governement. AFP can help you understand how, as a strong nationwide group, to take effective action.

Defending the American Dream ReCap
~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~
On October 2nd and 3rd, AFP Lower Shore headed to Washington DC for the Defending the American Dream Summit. What a wonderful event to make an impact on our elected officials and network with AFP and the Campaign for Liberty activists all across the country! We had an interesting event when we had 60 AFP members show up over at Kratovil's DC office.
See the video here and here.
For those of you who attended; thank you for taking time from your family, your work, and your community to stand up for our economic freedoms by attending AFP Foundation's 3rd Annual Defending the American Dream Summit. Over 2,000 activists came to DC to here from great speakers, and learn what they can do to promote free market principles. For pictures of the event, here are the ones I took: click here
Burger King Marks Launch Of Windows 7 With A SEVEN-Patty Whopper
Burger King has released a gut-busting seven-patty Whopper to mark the release of Windows 7.
In what may be the most bizarre cross-promotional campaign ever, Microsoft linked up with the fast-food chain to create the 'Windows 7 Whopper.'
The fatty burger behemoth contains more than 2500 calories, is 5.1 inches tall and costs just 777 yen - about £5.
It went on sale in outlets in Japan today to coincide with the release of the new operating system.
Although the promotional picture looks relatively appetising - well, sort of - the actual product left a lot to be desired.
New Yorkers Focus On Gas Drilling Threat
from Enviromental Working Group
Natural gas may seem clean, but it has a dark back story. As Environmental Working Group has reported, gas producers out West have drilled thousands of wells with hydraulic fracturing or "fracking," which involves breaking open gas-bearing formations by injecting them with water laced with toxic chemicals like benzene. To make matters worse, gas drillers have been exempted from the federal Safe Drinking Water Act and permitted to conceal, as trade secrets, the identities of the chemicals they're forcing underground.
This Morning's Comcast News
Re: “Senate bill may have public insurance plan” by Dave Espo, AP 10/23/09 Comcast online news
Here now I read that the rumored talk behind the closed “transparency” doors of the Health insurance discussion is that the public option is back in the ring, putting a “non- profit” government insurance ring in competition with your local for profit broker and for profit companies. The “saving grace?” Well, States would have the option of dropping out of the system! Don’t that beat all!
If you think about it, this would destroy private companies even faster. The first thing it does is work in the opposite direction of trade across State lines, thereby stifling competition. If one state is “in” and the other is not, than I’m sure that one could not trade with the other!
Secondly, what if ALL the states opted out? Now we are all paying taxes to the feds for a program with no customers! Oh, except for the ex- illegal aliens who are now to become some sort of stateless (migrant) national residents!
There you have it: free health care for all aliens paid for by Joe taxpayer, who will not be covered because he’s a resident of a STATE legally.
If all states stay “in”, well, we’ve still got a non- profit in direct competition with for- profit companies. We’ve already done the math on that one, it will just take a couple more years to get to the same end.
One more time, son: Tort reform, competition across state lines, and government in the law business, not in the health insurance business!
PRESIDENT OBAMA ADMITS HE REACTS TO PUBLIC OUTCRY
Today President Obama announced that due to public outcry, the salary/bonuses of bank executives would be cut by 90% in some cases.
Oddly, yesterday Obama had no knowledge of the cuts, but today he made the announcement. It seems the Pay Czar has free rein to take this drastic action.
So with this insight into his modus operandi there can be expected movement in his condemnations of ACORN activities and upcoming announcement of additional ACORN investigations and indictments. All this because the people spoke out.
There should also be special prosecutors appointed into the subprime mortgage fiasco since there was great public outcry. These bad loans were bought by Fannie Mae and Freddie Mac under the expert leadership of Mr. Franklin Raines and enabled by Barney Frank and Chris Dodd. Beginning in the Clinton Administration and its Community Reinvestment Act, good banks were threatened with deprivation of funds if mortgages were not offered to parties with poor credit, no jobs and no down payment.
The opposition of the American citizens to Health Care Reform has been a continous long lived voice of disagreement. Since there can be no doubt as to the stance of the American people, it can't be long until the President announces his scraping of the entire Health Care Reform, and institutes torte reform, portability and eliminates fraud/waste at Medicare and Medicaid.
Since the American people were so vocal on Obama's indecision to sent the 40,000 troops requested by General Mac Crystal to Afganistan, that announcement will be forthcoming any day. If only President Obama had shared how easily he is swayed by public opinion.
So Mr. President, we, your humble citizens, will continue to speak out passionately on issues that matter to us and we anticipate that you will respect our opinions and act accordingly.
ARE YOU AN OBAMAHOLIC?
Do you get a warm and tingly feeling up and down your leg, when you see Obama? Does the sound of Obama's voice send you into ecstasy? Do you feel you were a sinner under Bush, but now you are saved? If your answer was yes to any of the questions, I am sorry to say, you are an Obamaholic.
The first step in curing yourself, of this terrible sickness, is to admit you are dependent on government. If you would like a cure and return to the days when you stood on your own two feet, help is available. However, you must be wary of another addiction. Don't be duped into becoming a Rinoholic. It might look, sound and taste different, but it's just as bad for your health. Some even call it Obama lite.
Undoubtedly many people will continue to enjoy the drink of big government, to go with their free lunch. I only ask for a modicum of consideration. Stop asking the rest of us to buy your drinks and pay for your own lunch. I don't want you to starve or die of thirst and would gladly help anyone trying to help themselves. Don't you think it is time to put an end to dependency on others?
Welcome To America!
A Russian arrives in New York City as a new immigrant to the
United States . He stops the first person he sees walking down the street
and says, "Thank you Mr. American for letting me into this country, giving
me housing, food stamps, free medical care, and a free education!"
The passerby says, "You are mistaken, I am a Mexican."
The man goes on and encounters another passerby. "Thank you for having such a beautiful country here in America ." The person says, "I not American, I Vietnamese."
The new arrival walks farther, and the next person he sees he stops, shakes his hand, and says, "Thank you for wonderful America !" That person puts up his hand and says, "I am from Middle East . I am not American."
He finally sees a nice lady and asks, "Are you an American?" She says, "No, I am from Africa ." Puzzled, he asks her, "Where are all the Americans?"
The African lady checks her watch and says, "Probably at work."
Education Cuts – Bureaucracy or the Classroom?
There is no joy seeing Maryland Gov. Martin O’Malley finally admit that the state’s level of education spending is unsustainable.  If O’Malley had confessed that simply throwing money is not the solution to any problem there would be some cause for applause; unfortunately, this is a lesson that O’Malley is unlikely to learn.
There is no question that pain will be felt at boards of education around the once Free State.  The question will be – WHO feels the the pain?
Will bureaucracy take the hit before classroom instruction?  Doubtful.  If you live in a county like Wicomico you will be TOLD that this is the case.  Of course, you are already being told that all taxpayer monies are well spent.  As you will see next week, the WCBOE doesn’t have a very good record when it comes to truthfulness.  This is particularly so when money is being discussed.
Parents (and taxpayers in general) need to contact their ELECTED representatives and start demanding that tax dollars need to be going to EDUCATE CHILDREN, not FEED THE BUREAUCRACY.  Appointed boards seem to believe that they serve employee unions rather than taxpayers and the children they are charged with educating.  The only hope for citizens seeing that their tax dollars are well spent is from their county council members or commissioners.
GOVERNOR O’MALLEY, LT. GOVERNOR BROWN TO BE HONORED FOR EFFORTS TO STOP DOMESTIC VIOLENCE
ANNAPOLIS, MD (October 22, 2009) – Governor Martin O’Malley and Lieutenant Governor Anthony Brown will be honored tomorrow at the Maryland Network Against Domestic Violence 2009 Annual Meeting and Awards Luncheon for their work during the 2009 legislative session to remove firearms from the hands of domestic abusers. The legislation passed by the General Assembly this year provides judges with an additional tool to ensure the safety of Maryland’s families by granting them authority to remove weapons from homes early during domestic violence proceedings.
The Maryland Network Against Domestic Violence has been working since 1980 to eliminate domestic violence in Maryland through education, training, and advocacy.
Then they all started shouting '14....14....14'...
