Suspect Shot By Homeowner During Burglary

Location: 19000 Bee Jay Lane, Lewes, Sussex County, DE

Date of Occurrence: Thursday September 10, 2009 6:20 p.m.

Suspect(s):

Paul L. Spencer, 43, Lincoln, DE
Gregory B. Stewart, 49, Lincoln

Resume:

State police have arrested two Lincoln men after one was shot and the other was cut after they broke into the home of a 74 old-old man.

On Thursday, 09/10/09 just after 6:20 p.m. a 74 year-old man arrived at his home located in the 19000 block of Bee Jay Lane. The homeowner found an unoccupied SUV near his driveway. The homeowner observed the side door to his home open, which he had previously secured. He walked to the front of his residence and found his front door kicked in. As the homeowner walked back to the side door he observed Spencer and Stewart.

Spencer and Stewart approached the homeowner at the side door, advised him that they were “looking to purchase a dump truck,” and attempted to make entry into his home. The 74 year old homeowner told them to leave his property. However, they continued toward him. Spencer managed to enter the threshold and grabbed a landscaping tool and threatened the homeowner. The homeowner retrieved a machete/lopper from next to the door and swung it at Spencer and struck him several times on his right forearm and hand. Both suspects continued toward the homeowner, which caused him to fire two .25 caliber rounds from a handgun. One of the bullets struck Stewart in his abdomen.

Both subjects fled the victim’s residence. A short time later, Stewart was driven to Milford Hospital where he was admitted for a gunshot wound. Spencer was located and arrested at his residence in Lincoln a short time thereafter. Stewart was listed in stable condition.
Spencer was arrested for Burglary 2nd, Conspiracy 2nd, Menacing, Criminal Mischief. He was committed to SCI. Spencer was treated for lacerations to the right arm. Warrants for the same charges are on file for Stewart

The 74 year-old homeowner was not injured.

Good thing this happened in Sussex and not in MD! God only knows what they would do to that homeowner had this happened in Maryland ...:(

In Md, the homeowner would have been arrested, and the burglars would have filed a law suit that they probably would have won, and meanwhile the homeowner is sentenced to jail for attemted murder !!!!!!!

I live in Maryland-Wicomico county and can't get to come here because I have some hot molten lead for them as well. Oh yea if I don't get them my wife loves shooting her 45. God forbid we miss because my sons are up next. I guess what I'm saying is we are tired of this crap too. It's too bad these thugs have to pick on the elderly i guess they are afraid of someone who is well capable of fighting back. Congrats go to the gentleman who stood up for what was right.

should have had bigger gun or better aim and we wouldnt have needed a court date. he must not have known police policy 2 to center mass then reevaluate situation.

4:03, they will never go to prison for this. With those charges they will get 30 days max, but probation is more like it.

Well, can someone start a fund so we can buy Mr Homeowner a .357 so he can pop a REAL cap in their butts next time! I'll gladly kick it off with $20. There would be less chance for scum like this to flourish if they are staring at the dirty side of the grass.

I'd love to shake this man's hand. He's the epitome of someone who takes responsibility for his home defense, not call 911 and then wait for someone to respond to just make a report as to why Mr. Homeowner is now deceased and gee, what a shame, the scumbags got away. Not a slam against law enforcement, just a slam against a system that encourages citizens to become dependent on the state.

Alright!Don't mess with the elderly-some of them are pretty feisty!This could have ended badly but the old guy fought back!Way to go.

Just exactly why we have the second amendment. Every red blooded American citizen should have this right to protect his home and family. It is too bad that it isn't the case in Maryland. The Maryland scene would be 74 year old man charged on weapon charges and attempted murder. Then the shot burglar would sue the old man and the old man would have to support the crimanal which is free for shooting
him. Definitely wrong. This country is all backward now days. Punish the innocent and let the criminals run free.
