Texas Man Convicted of Resisting Arrest - Mistaken for Burglar in Own Home

A jury on Wednesday found a Lufkin man guilty of resisting arrest in his home after police mistook him for a burglar. A judge then sentenced the man to serve 30 days in jail and pay a $500 fine.

Marco Sauceda, 30, entered Angelina County Court-at-Law No. 2 Judge Derek Flournoy’s courtroom Wednesday morning wearing a tan button-down shirt and navy dress slacks, but by the end of the day found himself in county orange.

Following a one-day trial and four-hour deliberation, a six-person Angelina County jury concluded Sauceda was guilty of resisting arrest on March 15, 2009, while being pepper-sprayed, shot with a pepper ball gun and wrestled to the ground by Lufkin Police officers in his living room, according to testimony.

Wow the laws must be different in TEXAS. Here in Maryland you can resist an unlawfull arrest and clearly this was unlawfull if it was his own house. Of course our state is extremely liberal and TEXAS is extremely conservative.

Wow!! Just hanging out in YOUR HOUSE, not doing much, kinda chillin', and BOOM! the house is flooded with armed agents of the government, pointing guns, screaming, and runing thru your previously quiet home. You KNOW you didn't do aything wrong, so you DON"T just give up to the threatening guns and screaming. So, you STARTED the day just another honest citizen, end the day beat up and shot by the police and later, convicted by a jury (of "yes sir, the government MUST BE RIGHT") of a crime. AND you actually do JAIL TIME!!! Where are the "if you just obey the law (which he was doing BEFORE the police showed up), you don't have anything to worry about" people????

I am a law abiding citizen BUT if that happened to me the first thing that comes to mind is REVENGE! There is no way this man should be doing jail time at all. After the 30 day sentence is up I would be hunting down the whole bunch of them with my own little justice. Talk about screwed up this is what America is coming to be?
