Federal appeals court orders Justice Department to explain whether the Obama administration believes judges can strike down federal laws.

Of course the court can strike down laws that are deemed unconstitutional...that is why the court exists. Thats their job to determine if the executive and legislative branches are acting to support the Constitution or not. Its called balance of power. Oh..I forgot...all three branches of government are equally powerful...except one is more equally powerful than the others.

Usually a law is challenged After it goes into effect. The healthcare law is not in place until 2014.
So proving a negative may be difficult.

For a "Constitutional law professor", he sure displays a blatant ignorance of the Constitution that he claims to know so well. Every time he opens his mouth he takes dishonesty and buffoonary to a new level. What a fool he has made of himself and this once-great country.

bender, that's interesting. some parts of the law have already taken effect. this law must be struck down for the good of the nation.
