Delaware State Police have positively identified the bicyclist involved in the crash with a 2003 GMC Envoy. The crash occurred Sunday August 1, 2010 at approximately 9:10 p.m. The bicyclist involved is 52 year old Jose Aurturo Moscoso of Laurel. Moscoso has only been in the United States for about a year.
The crash occurred as the GMC Envoy was traveling westbound on SR 9 County Seat Highway intersecting with Dukes Lumber Road 2 miles east of Laurel. Jose A. Moscoso was on his bicycle and traveling eastbound on County Seat Highway on the eastbound shoulder.
State Police believe Moscoso was on his way to his residence which was located on the north edge side of County Seat Highway. Moscoso veered into the path of the GMC Envoy and was struck on the right side of his body. Moscoso was transported to Nanticoke Hospital Seaford Delaware where he died from injuries sustained in the crash approximately three hours later. The driver of the GMC Envoy was Mary Ann Bailey-39 of Milton.
State Police have been in contact with Immigration and Naturalization Service and the State of Delaware Medical Examiners office to help determine Moscoco’s naturalization status. Moscoso is originally from Guatemala.
A preliminary Delaware State Police investigation suggests alcohol to have been a factor in the crash. (With victim Jose A. Moscoso) Moscoso was not wearing a helmet.
Delaware State Police are continuing their investigation and there are no charges that have been filed against Mary Ann Bailey.
