Ocean City To Condemn Boat Ramp Property

The Town of Ocean City will initiate condemnation proceedings on land it wants for the proposed 64th Street boat ramp, following multiple failures over the past several weeks to buy the property or to obtain an easement to use it.

Property owner Robert Kirchiro said earlier this week that he had pulled back from offers by both the city and the owner of Dead Freddie’s Restaurant, the property adjacent to his, to buy the land.

“I don’t want to do business with them,” Kirchiro said. “It’s dirty pool.”

City Solicitor Guy Ayres said on Wednesday that he had sent a letter to Kirchiro and his partner, Matin Maghsoudzadeh, notifying them that the city intends to condemn.

Look Harry Reid must want the land for his private boat!!! corruption at it finest Ocean city government is no different!! A boat ramp that you cant even use in the summer time for all the transplants

We can't buy it so we will condemn it. Wow. Must be liberals running OC. Who would have thought. Next year Trimpers rides will be operated by the illegal immigrants being shipped to MD instead of the Russians immigrants that operate them now.

From the Dispatch article: "Given current wetlands protection laws, Kirchiro is unlikely to get clearance for any improvement on the land unless it was publicly funded."

Things like this is what is so messed up in this country. A private citizen can't use his land because of regulations. But the government can use the land for the same purpose.

How can you condemn land? Is there any run-down building on it? After reading the whole article, it doesn't really sound like much land because most of it is under water. It doesn't sound like there is anything to "condemn".

Must be one helluva need for a boat ramp up there. But, I can't think of one reason, myself. There's a lot more to this then a stinking boat ramp, rest assured of that.

514 ohhhh I am not a fan of the eastern european workers in oc. I make a point of calling them out in my best russian everytime. They are always so startled/испугаться, and our children think it is hilarious.

I blame the establishment too. Tax breaks for immigrant workers..and local kids can't find jobs???? crazy times.

By the way, most of the 20 somethings from eastern europe are from affluent families. This is a working holiday for them.

Peck Miller is the man in the middle. A clear conflict. He is a snake in the grass representing both sides. No doubt he has knowledge of what the cities intentions are. Yet he sits on Planning and Zoning while attempting to make money on the sale of the property.

The Council learned that they might have to give seasonal bus drivers an increase in compensation after 7 years. Can't have that. Where are the Teamsters when you need them?

5:59 you don't have a clue... Very few if any of the eastern Europeans are from "affluent" families.
They come here because they can make 3 years salary in 3 months.
But, back to the topic at hand.
The property owners have a right to ask what they feel the property is worth and considering the City is willing to stoop to corrupt means obviously it is worth quite a bit even under water. They are right, it is "dirty pool". How can you condemn a marsh?
This is why Md. needs a "stand your ground" law.
They need to go "George Zimmerman"
on the corrupt city employees to protect their property and their rights. Eminent domain does not apply for a boat ramp.

8:35 While you are correct about them not being from affluent families most are from mid to upper middle class families. They don't earn 3 years salary in 3 months. Your understanding of eastern European economies along with the cost of living in OC and the wages they earn is way off base.

B.S. 10:46 You're understanding is incorrect. I married one of those Eastern European women!
Met her family in Belarus. Lived there for months. She worked 4 jobs all summer and took home 3 times what her family earned in a year! She sewed the cash into a bra to avoid the 60% tax! They lived in a 4 room dacha with no toilet! Certainly NOT upper middle class. They were as dirt poor as everyone there.
You have no clue either just like 5:59!

8:35-You are off base. If you knew anything about the V1 Visa Cultural Exchange Program, you would know it is for middle to upper class students. The students are very worldly, well traveled and cosmopolitan.
Only students who aren't likely to overstay their visas are approved. The first thing looked at is the student's familiar economics because a student from a poor family is more likely to overstay.

The government can condemn/use eminent domain against undeveloped property if there is a "public need."
A boat ramp-a "public need?" Really?
A boat ramp can only be used by a small percentage of people.

I know this area and there are Diamondback terrapins living in that marsh as well as herons and other water birds living and coming to feed.
If they do go through with condemnation I would contact the Humane Society of the US and have them file a lawsuit. They have been successful at this before.

7:24 maybe has nailed it.
The city would best be served by dropping this whole thing immediately. Law school 101. Too many twists and turns and if the owner does take this to court a jury is going to find for the owner. Besides opening up ethical concerns surrounding Miller who according to article is a Realtor so I'm assuming has a MD license.
I'm not too sure about the city's legal counsel. Not on the ball for lack of a better phrase.
The most recent being the street performers. And let's not forget about the Dipino lawsuit from years ago. 2 cases that were impossible for the city to prevail, something first year law student could have told them.

"good source" being Peck Miller?
If so possibly an ethical violation not only in the capacity of P&Z official but as a real estate agent as well. Complaint can be filed with the Maryland Real Estate Commission. They have subpoena power and can question witnesses as to whom this "good source" is and can sort out if any violations have occurred.

Obviously Ocean City officials are not aware that there is a difference between an appraisal and a Condemnation Appraisal.
In a CA the property is valued at what it was worth as soon as the condemnations talks began. Property is worth what someone would pay for it-would pay being the key phrase. If the restaurant owner was willing to pay nearly asking price then the owner would be awarded that amount at a trial.
The prior negotiations between the property owner and restaurant owner have muddied the waters so to speak.

How can they say the property is worth so little when the owner was getting $5000/per year rent from the restaurant owner. This until the realtor got involved in the mix. Someone told the restaurant owner about the city wanting the property according to what the newspaper saw.
