Sometimes Neighbors Just Plain Suck!


If there's one business I truly enjoy it's the Backstreet Grill in Salisbury. Always clean, always friendly, prices are fantastic and the food quality is very enjoyable.

I've been frequenting Backstreet for a few years now and one thing that always amazed me was the lengths everyone goes through to make sure no one parks in the Paint Store parking lot next door.

Once a tow truck hooks you up there's a $250.00 fee to get your vehicle back. The Owner of Backstreet has done just about everything he can think of to work something out with the property owner. He's offered money to allow his patrons to park there and even meals to boot. The Paint Store refuses to work with them.

I can tell you first hand, the owner of the Paint Store has a camera set up that they watch all night long and I'm NOT kidding you. They actually sit at home on Friday and Saturday night, (at least) and watch their live camera picking up on someone pulling into their parking lot. Once they do, the Tow Truck company is called immediately and I'm not kidding, within 30 seconds they are there for the tow. 

This weekend the owner of Backstreet pulled his pickup truck right next to the Paint Store entrance, put lights on the signs in the bed of the truck in order to keep their customers from parking there. Believe it or not, I even watched someone pull in there and park their car, UNREAL! We warned them immediately and within seconds the Tow Truck was pulling into the parking lot.

If it isn't bad enough that City is so business unfriendly, neighbors can be even worse. The owners of Backstreet even tried putting up the plastic yellow warning tape across the parking lot entrance but the owners of the Paint Store saw it on their cameras and drive down there to pull it down. 

I know where I'll never be buying my paint from now on.

I would like to know why the Paint Store is so adamant about not allowing cars to park there afterhours. I would imagine that Mark would pay to rent the space when they are closed. It seems really small-minded and un-business friendly by the paint store. Perhaps customers should boycott their paint store because they don't support a fellow businessman.

9:35, I'm not saying they don't have the right, they absolutely do. Just not very neighborly and in my personal opinion, anyone sitting at home at night glued to their live camera feed is a bit obsessed.

Joe, I think the paint store people could be more flexible about it, but they may be worried that a drunk patron will wreck their property and don't want to suffer insurance hikes. Also, it may not be legal for them to rent their parking at night for the grill people.

Just trying to see the other side. Not affiliated with either party. I like the food at the grill, too. Wish I had more money to go more often, but once is year is about all I can manage.

On Wednesday and Saturday night you can get a huge burger there for $5.00 and it's delicious. In fact, they have Happy Hour prices/deals all night on Saturday night.

As for drunk patrons, can you recall any time when someone drove into the building at Backstreet? Come on man, that's stretching it quite a bit.

I saw that Saturday night, I tried going to Fratellis but I was greeted with a 50+ minute wait so we went over to Backstreet, I wanted some good fries anyway. Was able to get seated right away and had a good meal as usual.

I thought the owner of the paint store had done that, I should have known better that they wouldn't be that kind, with the the paint store across the street closed that ended up giving Backstreet more overflow parking.

You can't tell me that paint store isn't getting a kickback from the towing company.

The issue is liability. If they allowed anyone other than customers of their business to park there and there was damage to the vehicle or if someone got hurt on the property or even assaulted, robbed or raped they would be liable and their insurance company would likely not cover it as it as the event would have occurred after business hours.

A friend of mine was towed from the paint store. The tow company told her that they make $50 off the tow and the paint store owner makes $200.

10:10, I couldn't agree more. There are signs all over the place. Mind you, I have seen, (over the years) many people of all ages not pay attention to the signs and here's why I believe they don't look. The business, (paint store) is closed at night. No harm, no foul, right? Older people see the opportunity to park closer to the front door of Backstreet and they park there. Is it their fault, absolutely. There's even a sign on the front door of Backstreet telling people do not park at the paint store next door.

IF the owner of the paint store building simply chained off the parking lot, that would be cool. INSTEAD, they tease people by not putting up a chain, (the poles are there to do so, so you know) in the hopes of collecting a few bucks, (I'll assume) after hours.

The right thing to do is to work out a deal with Backstreet OR the City should step in with an ordinance stating if they don't close off the parking lot it's fair game. STOP TEASING people into parking in ANY parking lot only to get towed with the hardship of fees and the loss of your vehicle until the next day AND finding a way home that night.

The insurance and the liability reason is nonsense.
If the paint store owner had an ounce of business acumen they would welcome people to park in the lot after hours as everyone is a potential customers.
There's Home Depot, Lowe's, Walmart right around the corner and the paint store need not ever ever forget it. The paint store needs the public. The public doesn't need a paint store. Anything a business owner can to do increase their visibility and their kindness toward other businesses and their customers in the area is always a plus for sales.

Get a few (like 20)friends to drive onto that lot and park there for ten or fifteen minutes while not leaving the car, or leave the car and wait until they see the towtruck coming, then skedaddle.
Maybe that will encourage the owner to stop this foolishness and put a chain up across the driveway, which he should have done ages ago. Of course, his cousin the towtruck driver might not like this.
I wonder what the owner's cut is for each tow?

i was towed there a couple of months ago the driver was rude to me and my family .i also had my grandparents inside backstreet and parked the because they are very old and cannot walk far i didn't think it was a big deal parking there when the paint store was closed i guess the tow man owes me $50 as that was what i was charged not $200,as far as backstreet i will no longer patronage them as the whole situation is ridiculous, my total bill for that night was $335.00 thanks for nothing PAINT STORE and EXPERT COLLISION TOWING.

the city should set a price for the tow. if a vehicle is towed it should be the same price anywhere in the city/county. owners should not be allowed to set the prices for tows and fee the tow company charges.

As I sat there eating my dinner I had the same thought as Joe, why not just put up a barrier if you don't want people parking there (works in OC). That right there tells me they are wanting the kickback from the towing company, sad that a property owner has to rely on another business's success to leech money off people.

The next time your neighbors have a big party why don't you let them park in your drive way. After all chances are you aren't going out after dark any way. It would seem small-minded and unfriendly if you didn't. Perhaps you could help out your fellow neighbor by turning on all of your outdoor lights to make sure it's safe for your neighbors guests at night.

As a small business we dealt with the same problem with a resturant.
It's our private property. If they offered to pay rent for their patrons to park, fine, but they did not.
So they were all towed and we also checked 24 hours a day.
Needless to say, they stopped parking in our lot.
Tough. Our patrons never used their lot.

MD has already passed laws regarding towing. The city must comply with these laws. If they want they can add to make more stringent but not ignore what's MD law.
•Specific sign requirements including (i) that the sign must be at least 24 inches high and 30 inches wide; (ii) be clearly visible at the lot entrance or from the parking spaces; (iii) state the name of the towing company and the location where vehicles will be towed; (iv) indicate that Maryland law requires vehicles to be available for reclamation 24 hours per day, 7 days per week; and (v) state the maximum amount that may be charged for the towing of a vehicle.
•Before towing or removing a vehicle, a tow company must have the authorization of the parking lot owner which shall include: (i) the name of the person authorizing the tow or removal; (ii) a statement that the vehicle is being towed or removed at the request of the parking lot owner; and (iii) photographic evidence of the violation or reason for the towing of the vehicle.
•If a vehicle has not yet been removed from a parking lot, the towing company who has possession of the vehicle must release the vehicle to the owner or an agent of the owner: (i) if the owner or agent requests release of the vehicle; (ii) if the vehicle can be driven under its own power; (iii) whether or not the vehicle has been lifted off the ground; and (iv) if the owner or agent pays a drop fee in an amount not exceeding 50% of the cost of a full tow.

We have cameras on our building as do many other businesses. Drug dealers meet on these lots at night. We have several taxi companies constantly turn here looking fir an address. They could just go around the block. My property is private property and yes the property is posted a tow away zone. When a business files for a license they take in consideration how many parking slots needed or how many the business will hold. Maybe the restaurant is over occupied? The parking lot by Daytons Restaurant has a sign not to park in front of a business.

Hey if it says no parking just respect the owners rights.
It sounds a little childish to say If I can't park
on your private property I won't buy your paint.

You can't compare a private residence to a business where the parking lot is considered a public accommodation.
People assume it's okay to park in a closed business lot afterhours to patronize another business. It's human nature because it's an accepted practice in a lot of places.
If this unwanted parking is happening over and over and is a pattern and the lot owner hasn't put up a gate or barrier of some sort than they are one ignorant SOB and yes, no one should ever buy from them again unless they stop this childish game they are playing.

The towing law also states that the penalty for the tow company will be THREE TIMES what the vehicle owner was charged.
If he was charging the full $250 to drop the vehicle before leaving the paint store he would be in violation BIG TIME, it says up to half the full amount of a tow?? The signs are not 24x30 over there either...pics prove that. If he was towing cars without a signed authorization in hand, he was in violation. Did he call the police and take pictures of each vehicle?
Sounds like just about EVERYONE who has been towed by him will be owed a ton of money!!!

If I saw a parking lot posted with "no trespassing, violators will be towed" I would have the good sense not park there

IMO the owner of the building is not the idiot, the ones not heeding the signs show by their "I dare you" attitude, they do not care if they get towed or maybe they cannot read

perhaps glued to the camera is cheaper than construction of that fence you had the audacity to tell the owner to put up, so patrons of backstreet would not park on his posted property

does backstreet have enough parking for customers - does not sound like it, if backstreet patrons need to park at paint store

the folks who " will never deal with the paint store again" probably never did - wishing to destroy a person in business who does not own the building says a lot about ones "unfriendly" character

there is another side to this kerfuffle for sure - If the building owner cares not to be neighborly after all the options backstreet has suggested in order to use the parking lot in the evening, the building owner thinks he has good reason. In the meantime all the wrong people are being blamed - blame the violator, who backstreet has warned in every possible way

I also like backstreet and find their food good and prices reasonable BUT in today's economy i try my hardest to keep my priorities in check. One of my priorities is never charging food on a credit card. With us raising our three children, mortgage, electricity, saving for the future, etc., we go to backstreet once or twice a year and eat out maybe every two months. $5 Burgers and beer are not our choice when eating out. Everyone does not eat out nightly - for us it is an occasional treat that will increase when our first priority have flown the nest.

Would it be possible for someone in the vicinity to see if the paint store has the appropriate signs up? Curious to see if they have the name of the tow company on the sign. This IS state law. Asking because there is no MD business license listed for Tindall's Towing. The tow truck company if legitimate will be aware of the MD laws that were enacted in 2012. The owner of the business, has a duty to know what the laws regarding towing is and to hire a qualified representative. The lot owner can be liable for any refunds as well.

Maybe customers should go to Back Street in a less busy time. When we go to Daytons on Snow Hill Road and they are busy we go to their parking in the back of the business. (Daytons extra parking).

Thanks for the name of the towing company. I will keep my eye out for them and hope I see them doing something wrong so I can drop a dime on them. But that is all the money I will spend on such a company.

If the citizenry does not like how a business operates, they have every right NOT to frequent that business.

Just as whoever chooses to call the tow company for something they don't like, others can choose to go elsewhere for something they don't like.

Joe you need to alert Mike Lewis about Tindal having a weapon. If he has a record, I doubt they would issue a concealed weapon permit. They are VERY hard to get. Second, lots of people claim to have one who don't.

If you were ever towed by him then report the incident to the police department and/or the States Attorney. Sounds like a class action suit to me. If he overcharged everyone boy would he owe these people some serious jack!! $750 repayment to anybody that was charged $250 !!!

Backstreet is a favorite lunch spot for me and my friends, but parking is a problem. I would like to see them relocate to a better location with adequate parking. As for Fratelli's...they need a second location, perhaps on the east side of town. Great food at both places!

We were some of the first people to frequent Backstreet when they opened. The food was good and prices nice. BUT... because of the lack of parking and our car getting dented because of the lack of parking we stopped going. The best way to describe the parking is "TIGHT". I cannot imagine it since I heard they added more dining space. Why did they purchase a property with such limited parking in the first place? Sounds like Mark (don't know him) and Michael (don't know him) have issues with each other more than just parking.

hey I did it I parked in the petty Paint Stores lot just to call in a take out order it was minutes before a brand new red tow truck showed up I told him I was just ordering he said he told the owner that I was just sitting in the car but that the owner told him to go there anyway I would buy an empty can of paint from Lowes before I would go there for any reason

The bottom line is if this is a habitual problem for the paint store owner, the landlord whomever, they need to put a barricade up over the entrances to the parking lot. If you have to have cameras to your house and you watch to see if someone infringes on the lot and then have them towed that's predatory behavior and can signify a bigger issue than just towing someone.
Whoever is doing this may want to consider getting a mental evaluation.

: I received a call from the owners Son. He stated to me that his parents do not have a camera set up watching the parking lot all night. I was told different by someone who would know but it is what it is.

As for the tow truck driver, he is simply doing his job. IF you have a problem with all of this, be upset with the situation, not the driver.

I am a small business owner in Salisbury. I debated on making a comment because I don't like so many angry remarks. I own,or actually the bank does, my property and am fortunate enough to own enough property for my customers and employees. I don't like when patrons for my neighbors business parks on my property during my business hours, even though there is plenty of parking next door to the business they are patronizing but my business is easier to get into and out of and it avoids a stop sign. I do have a sign that parking for our customers only but don't tow anything. If the vehicle was left there for a few days without my permission then it would be towed. I have left Backstreet before because of lack of parking. I don't know what the split ion for them to be, except try to talk to the owner and see what would satisfy him. If I were him I would definitely put up a park at your own risk or no parking. That would relieve him from any insurance issues. With the amount I pay in property tax to the city, I would love to rent out some of my parking space! I don't like to be anonymous my business is Cathy's Pet Salon, Spa, and Doggie Daycare! Small businesses have to stick together and support each other! As for the tow truck driver carrying a gun, I sure would if I did his job, especially late at night!

Well it is indeed plainly obvious that if you and I am referring to the disgruntled tow truck driver that if the rest of the community can read as well as you spell you should not be the one to judge people for not reading well hidden and poorly lit signs.

why is it that if you have a problem in a parking lot its not the owners responsibility. they say its public access. but then they can tow your car if you park there after hr. and then say the parking area is mine and now one can use it. make up my mind is the parking public access or personnel property. to many diff rules and laws.

Cathy, Thank You for chiming in on this. Your being a property owner and another small business, your opinion and experience is very important.

I agree. I think the property owner next door could do something to relieve their liability by posting a sign.

As for the person who keeps trying to tell me I should check my sources better, my source is FIRST HAND. Just because someone calls me and tells me they are the Son of the owner doesn't mean they are who they say they are. Heck, for all I know that person was YOU. Out of respect I published what they stated. I also told the person who called, (who was very nice, I should add) who informed me there was a camera overseeing the parking lot.

Now, being a regular at Backstreet and seeing this happen quite often I can tell you first hand the tow truck driver does not sit in the cold all night up the street just waiting for someone to pull in. As they told me, they get a call when someone pulls in and they head over to tow the vehicle.

One of the two people are not being truthful but BOTH are first hand people. Someone is watching that parking lot, that's a FACT.

People get on a blog and vilify a property owners for being an unfriendly neighbor . A law suit over business A not letting business B's customers park on Business A's parking lot,marked" no trespassing private property" and It can end up in court.

The courts find that Business A's signs are too small and he is using an illegitimate towing service. After many court appeals the government steps in and fines Business A $100,000, tells him he has to reimburse every towed vehicle owner and declares all of Business B's customers can park on Business A's parking lot, 24/7.

This scenario happens over and over which puts volumes of stupid laws on the books taking away our rights. Look at how little a property owner has say in his property today - property he bought and paid for, and will continue to pay for because of taxes as long as he owns it.

Now because 2 Business neighbors - Business B offering with several suggestions for the paid use of Business A's parking lot and Business A saying No, it is my property and I am not interested. This is a situation between A and B not a concern of anyone else. But all the fools in the area stick their nose in anyway telling Business A what he SHOULD do.

None of your business fools but you will keep scabbling and the case will go to court and the government will have taken another right away from the people and we citizens will have to abide by a new dumb law.

The Bank of Delmarva on RT. 13 North has patron parking as well. No parking signs have been there since they had problems with Chico and Saladworks. I don't see an issue here whatsoever. Abide by the Rules, its that simple! Don't park in the paint store parking lot. I saw people patronizing BackStreet and parking there during the paint store's business hours. They have every right to protect their property. I have neighbors that get upset when someone parks in front of their house on a public street. I understand their point!

There is a sign in the paint store lot- small, but there. I understand how he wants to protect his property and he has every right to. When did that become a crime? They should reach an agreement or just agree to disagree. It's stupid. As for you and being a first hand source, have you seen the camera or been in their home watching them call the towing company? I don't know how you are unbiased in this "fight".

It was nice to talk to you earlier, let me make this clear, we get NO MONEY WHAT SO EVER from the tow company. nor have we ever! We have owned the building for the past 30 years, and for a large part of that been next to an establishment serving Alcohol. during this time we have had to replace Multiple Fences, Windows, and even had a drunk driver drive through the front of the building. Now I realize that the current business next to our property is a vast improvement over the last, that does not change the fact that stuff sometimes happens. Plain and simple, if you don't park at 317 park heights Ave. you won't get towed.

Cathy said it all in a few short words-Small businesses have to stick together.
We've been in business in OC since 1979. We have a 50+ space parking lot with the proper tow signs displayed. We've towed 2 cars in 30+ years. Both had been abandoned by foreign students who had returned home.
We have huge problems in the summer with non customers parking in our lot but as stated we do not tow or even ticketed them, which OCPD can do if called.
We simply leave a notice on the windshield stating they are illegally parked and are subject to towing at their expense. I can't tell you the countless people who then return to our business to not only apologize for parking, but to thank us for not towing them, and a lot end up spending money at our place and have become returning customers. We see parking infringements as a part of doing business and part of our success has been in knowing what battles we should fight and which ones to try and turn into something positive.

Its a liability issue for the owners of the paint store. Someone gets hurt in their parking lot or damage done to their vehicle, who ends up responsible. No doubt there is a fair amount of drunkards probably use their parking lot/building as a personal toilet. I would do the same if I was the owner.

Jared in plain English, you lack any common sense which would dictates that if Backstreet is a "vast improvement" as you stated, then you should be doing everything in your power to keep them in business next to you.
Not to mention the potential customer base you are offending by being so mean and spiteful.
It's not any great revelation that stuff happens but to sit around worrying about something that might or might not happen at the risk of offending potential customers is not at all a good business practice and a bit paranoid.

Jarred, Thank You for not only chiming in but for using your name. That goes for Cathy as well. I do not see the harm in doing so on a post such as this one.

Both parties involved should, (in my opinion) should work something out.

Neither party seems, (to me) to be bad people, not at all. I can see where small problems can come up. How many times have we seen SOBER people drive their cars through the front of a store. It happens and yes, it's inconvenient. However, it is a part of doing business and in the end the entire structure is properly fixed to current code.

Work something out guys. Support each others businesses and SET AN EXAMPLE.

As for the tow truck driver, give it a rest people. He is simply doing his job. I've personally spoken face to face with this driver and like his spelling or not, I have personally watched him let people go, including last weekend. He's a decent guy who has a job that just plain sucks.

2:30, As for the liability, if the owner puts up the proper signage they would have no liability. I'm not 100% sure on this but I would think Backstreet could add to their policy for liability next door.

Someone authorized (either the property owner or their agent) has to be calling for the tow each and every time. This must be documented by the tow truck driver and should be on file. If the business is closed, this is still required, so someone must be watching from somewhere and making the call.
Either this or the driver is engaging in predatory towing-he knows the owner doesn't want non customers parking there and when he sees them, he tows, which is why the MD State Legislature enacted laws regarding towing in 2012.

Sounds like Backstreet has outgrown the property. The paint store better be careful what they wish for. If Backstreet leaves, they could end up with one of those places that hires out the rap DJays. They think they have "problems" now they haven't seen anything when one of those places opens up.

PHEW,man I've never seen so many comments on something so trivial. There several solutions to the problem none of which involve the parking lot owner or the tow truck driver. First the owner of Back Street Grill could pay somebody( a high school kid) to stand out there and tell his customers not to park there or what might be even better have a valet who works for an hourly rate plus tips take his customers cars to a secure parking area.The owner of backstreet grill obviously cannot work with the parking lot owner so the ball is in his court.If I owned the Backstreet Grill I would not let this peoblem fester there are several solutions but at the very least pay someone to stand out there on weekend nights.

Ordinarily a blackmail tow is only 50 bucks. Storage blackmail is usually only 50 or 75.

Stu, Let me assure you that Back Sttreet has done just about everything they can to discourage people from parking there.

Here's what I've been told. I was told that the tow truck company gets $50.00 for the tow and the owner of the building gets $150.00 to $200.00 for the tow.

That being said, the owner of Back Street offered $450.00 a month to use the parking lot and the owner came back at I believe either $700.00 or $750.00 a month.

It seems the owner of the paint store building is more interested in making money off the success of Back Street.

Now, IF that property owner wanted to resolve this matter and STOP people from parking there, all he has to do is put tape across the entrance and exit, problem solved. However, as I understand it and see it, they want to make money off of Back Street patrons mistakes.

Bottom line, now that this has received all this attention, the City is going to make damn sure the signs are legal, all of which we have already taken pictures of today. IF they are in violation and have not followed the law, well, there's going to be a real problem.

Then there's the IRS issue, has all of this money been reported properly.

My suggestion, WORK IT OUT GUYS!

If that picture of the truck with the no parking sign on it including with this post, is the only sign the paint store has for no parking they are in direct violation of MD law.
Each and every tow slip needs to be signed by the property owner too. A property owner can't give a tow truck company free reign to tow any vehicles they may see on the property when the business is closed.

I was thinking the same thing stu. anyone can do anything they want with THEIR property as far as I am concerned.

maybe they had an issue with trash being in his lot. or other bad stuff.

or maybe they are just greedy. or maybe they are not making enough money selling paint and using this as a means to stay afloat. or maybe they are jealous of backstreet's success.

or maybe an alien landed and shoved a hair very far up someone's rear.

lack of cooperation is one thing, but intentionally trying to sucker someone in to rip them off is quite another....IF that is what is happening.

they several different methods the paint store, or anyone else for that matter, can keep people off their property, IF they really wanted to.

they made an effort with a ( small ) no parking sign. they prob figure they did their part and whoever ignores, or can't see the sign is fair game, and profit from it. ( allegedly )

750 a month to rent a PARKING LOT??!!

I don't think they are as much worried about people parking there as they are concerned with making a buck.

Reading some of these childish comments reminds me of the city council meetings and the mayor's behavior.
It seems pretty simple to me, don't park on private property for any reason. In the spirit of business friendliness, cooperation makes the difference.

Joe i have personlly seen Tindalls parked arcoss the street at the auto body shop and wait for someone to park in that lot. And once the customer goes into Backstreet They hook them up. Thats how they get so many ppl.

Bernstein was mad because he couldn't get the money fast enough to buy the property (backstreet grill) back when it went up for auction after the last owner went to jail. Plain and simple.
