17.04.120 And The Federal Fair Housing Act Amendment Of 1988

Debbie and Terry and to whom it may concern,

It has recently come to my attention that the City of Salisbury has an ordinance that prohibits group homes of any kind in your residential district. I want to thank Shanie Shields for standing up for those that she serves, the people of Salisbury. As far as I know she was one of the Council Members that was familiar with the Fair Housing laws and tried to convince the City Council not to enact the zoning restricting group homes in residential neighborhoods. Way to go Shanie!! I personally am against discrimination in any manor and make it a rule to know the laws that pertain to my job. Just in case you wanted some additional information about fair housing I am including a link http://www.justice.gov/crt/housing/final8_1.php that will tell you everything you ever wanted to know about FHAA but was afraid to ask. If you want more information on fair housing I will be delighted to send much much more, but I am sure in the next short while you all will be learning a lot more about Fair Housing and how it pertains to your duties as a public servant. I do hope you find this information helpful and by the way please thank Shanie Shields for her commitment and dedication to duty for the Citizens of Salisbury. If you want I will send you the 1995 Supreme Court case law that sites FHAA does not allow City Governments etc. from excluding group homes in residential neighborhoods. If you have any questions please feel free to contact me by phone or email I will happy to provide as much information as I can. Now you know where you went wrong so now you can do the right thing and fix it.

Thanks A Million

This is an embarrassment and must be righted asap. We pay council persons to do the proper thing, obviously some did not do their homework regarding this. Shame on us.

Sir , you do not understand the law , your interpretation is not correct , and as far as shanie goes
her interest was not the veterans , but her land lord.

Keeping these veterans in need from having a home and a place to recover is shamefull. These guys deserve the very best for their service to this country. Give them a home now.

I'm sure a home could be acquired for the vets but when St. Fleur misrepresented from the get go, there is something wrong with that. If he is so interested in seeing that the vets have housing, do it the right way and quit side stepping. and 8:57 you are correct, Shanie's interest was not the veterans but her landlord, he just might raise her rent if she didn't go along with his scam.

Shanie:

If you gonna wrap yourself in the flag, better get a giant size one.

This is false.

Salisbury does allow group homes.

There are several.

Sounds to me like these guys just didn't want to do it the way it's allowed already.

How much more smear are these people going to do on those two council people? Maybe this guy ought to be writing the city attorney instead.

Joe, you ought to repost that smear letter that Black guy put out and the response by that veteran Dave something.

This is not about any one case or person or any relationships. I never mentioned any specific cases so you must be employed by the city if you are refering to a specific case. This is about Fair Housing Laws. Is there some issue with the Vets? What does an animal doctor have to do with this.I too am human and subject to mistakes. If you feel I have missread the law please let me know what part of the FHAA I am getting wrong. Does the City of Salisbury allow any new group homes in any residential neighborhoods? Please correct me by identifying yourself and comparing sec 17.04.120 with http://www.justice.gov/crt/housing/final8_1.php the Fair Housing Act Amendment of 1988. By the way who is that Black guy? Who is St Fluer? What does Shanie Shields rental have to do with Fair Housing? At any time I will be happy to debate the two laws word for word with any one. Please give me case law or language in a law that proves me wrong and I will admit that I am wrong, but you must prove me wrong. Case law that supports my opinion can be found in All that is required is that a group be permitted a level playing field - i.e. an opportunit.v

rro avoiding this requirement. FIovsons, Inc. Totvnship of Brick.89 F.3d 1096, 1104-05 (3rd tiir.

playing lleld is all the FHAA requires. Again I welcome an honest debate so please let me know your side.

Go to the city's website.

Look in the zoning code somewhere.

It allows group homes already.

There are several group homes in Salisbury already.

If you were any kind of realtor, you'd already know this.

Hell if I'm calling you and exposing myself. You'll just add me to your ignorant smear campaign.

What this is about--Salisbury Landlord wants to maximize profit from property he already owns, circumvents zoning regulations by saying it will be for veterans also gets to play the race card to his benefit, five years from now 79 Mexicans will be living in this property taking turns sleeping in shifts.

Anonymous said...

11:04, you might be right about 79 mexicans living in this dwelling but that is where we are heading in this country. You still can't ignore the law and it sounds to me like Mr. Million is correct in his interpretation of the law. Maybe we should focus on keeping the illegals out of the country and we could focus more on our own problems.

i don't know anything about the law. but i do know that the house has been inspected by the city and has passed. if there is a problem with the zoning then we should have the chance to talk about it. i know they had an all in favor to put it on the work session but cancelled it on may 10th. what is the problem? have you answered the hud complaint yet? let's move on and get this settled.

The post that refered to Mexicans and Crack Whores proves the discriminatory nature of that person. I never refered to a specific property or case or location. Please answer the question, Does the City of Salisbury allow group homes in any residential neighborhood? Next I will be happy to debate you with out knowing who you are but will only do so to an intelegent person willing to debate on facts. It has been said that I missunderstood or missread the law. Ok that may be but can you give me the language and your opinion as to the meaning. Please help me to understand and/or prove me wrong. My intent is not to smear anyone only to warn Salisbury about it's potential liability associated with this issue. Get your head out of the sand and read the Law! Take action to avoid more liability. I am actually doing you a favor by bringing this to your attention.

Don't we have 4 yo 2? Doesn't a group home in this location violate the neighboring single family zone's rights? We do have laws, and a group home belongs in a properly zoned area. Expert House Movers may be able to help here!
