CRIME: Possession of Obscene Matter with Intent to Distribute / Distribution of Obscene Matter
ACCUSED: Darrell Lee Richardson
CHARGES: (1) Count of Possession of Obscene Matter with Intent to Distribute, (1) Count of Distribution of Obscene Matter
NARRATIVE: On Wednesday, June 11, 2014 members of the Worcester County Bureau of Investigation, Worcester County Sheriff’s Office, Maryland State Police, Worcester County Office of the States Attorney and the Pocomoke City Police Department responded to an address within Pocomoke City, Maryland, the residence of Darrell Richardson. Richardson had been identified through prior investigation as being involved in downloading and sharing illegal “obscene matter” via a peer to peer file sharing network.
Once inside, an interview of the residents revealed that Darrell Lee Richardson was responsible for sharing and downloading the images.
Richardson was subsequently charged with one count of Possession of Obscene Matter with Intent to Distribute, and one Count of Distribution of Obscene Matter.
Richardson was issued a criminal summons and is awaiting trial.

Child porn is definitely illegal, but "obscene matter", come on, get real. I thought the courts struck down any attempts to define what is obscene years ago. Isn't that a freedom of expression thing? Maybe the morality police didn't find what they expected to find and made it up as they went along. If it wasn't child porn, the charges probably won't stick. If it was, then they should report and charge it for what it is.

"Obscene matter" What was he doing, watching snuff videos?
I'd love to be on that jury. I want to see what was so obscene that four different police agencies were called into action to address the crime. It must be really bad....

Kagan does not know what he is doing. This is clearly not a crime. Certainly a stretch to prosecute. What a waste if resources. Also, the law says u must have at least three images because of the large amount of unknown accidental downloads.
Other news sources say that he is charged with download and sharing of child pornography. That would make him a suspect of perversion in the highest degree.
Case of entrapment?
Do not worry .This is just the states way of trying to rebuild the sex offenders registry after the court of appeals ruling that will allow thousands of offenders on this useless list be removed. They now have to up charges against folks to rebuild the list. SO BEWARE...
