Let's Clear The Air


Yesterday we did a Post referencing the Tom McGuire case and the States Attorney Nolle Prosqui the arson charges. At the end of that Post we clearly stated, "There are cases in which a states attorney will nolle prosqui a case if an indictment has been returned. They do have the ability to re-charge Mr. McGuire at a later point." This is exactly what happened.

It should be noted, even though we got a call from the States Attorneys Office immediately following our original Post, they had no information to offer and assured me they would make contact with me once they could find someone who knew what was going on with the case. That call never came.

From what I learned last night, McGuire has now been re-charged with 1st degree arson instead of 2nd degree.

I should add, the States Attorneys Office has made it next to impossible to gather public information on their website. In fact, so much so that they have actually been deleting press releases on their site that had been previously published. They do not make current information available. Considering so many are victims of crimes, one would think they'd do everything possible to keep the public up to speed on cases, yet they do not. I guess they don't want the public to see just how many cases fall into the nolle prosqui kingdom.

A politician (yes a states attorney also) ain't gonna be around long if they don't take advantage of what the world wide web has to offer as far as getting info out to their constituents.

There's no excuse anymore for them not to be more forthcoming. People want to know what's going on on the front lines and not the latest function they attended or a parade they went to.
The only one that seems to understand this is Del McDermott.

More public servants who believe they are really public MASTERS. The public only gets to know what they WANT us to know. They disarm us, restrict our rights to protect ourselves, hide information from us, and then send the people who are supposed to "protect and serve" us out on the highways to garner revenue. LTS of "protection" happening at the radar/seatbelt sites all over the county.. I'll bet all of you who voted for Matt thought HE was the guy who would bring "change". LOL!! Fell for that one, again, didn't ya?

I for one did not. I was the one who said he was too young for the position.


But everybody always knows more and are quick to call others idiots and morons when they disagree.

Not sure what all the hype is about. He was charged incorrectley with 2nd degree arson (arson of a storehouse). It was dropped he is being being charged correctly with 1st degree arson (arson of a dwelling). Happens all the time after the SAO review cases. Each charge has several elements that have to be met in order to proceed to court. Don't be so quick to judge when the SAO did nothing wrong and most people don't understand the system. It just produces controversy when there is none.

If the case went before the Grand Jury yesterday, maybe they could not give any information at the time you called. While I certainly think that there could be a little more transparancy in that department, we also have to remember that they are dealing with the law. there are certain things they can and cannot say. On the one hand we want to know everything we can about what is going on, on the other hand, id some things went public it could hurt certain cases.

8:38, they certainly could have said T. McGuire case now to be heard in circuit court. Which should have been done ASAP. Whoever's running the show over there ain't too shrewd. Now there's surely a handful of folks who will think the case was dismissed. A handful of voters can make a difference in a lessor populated county such as Wicomico.

When cases are tried by jury, a juror must be unbiased toward the case. If the SAO were to release all information, it would be hard to form an unbiased jury. When this happens, many defense lawyers will seek a change of venue for the defendant like what happened in the Thomas Leggs case. Lets allow Matt to do what we elected him to do and take the scum off the streets. Now, I realize that mistakes have been made, but they are going to happen no matter who is in that position. Our legal system is very skewed in favor of the defendants.

anonymous 9:19, no one is asking for specifics to the case. All we have asked for is what is going on with the case itself, why the nolle prosqui in the first place. There's no reason to have the public believe the case simply went away. It could have easily been said yesterday that new charges have come forth and it will br tried in another court.

Why you people are going in another direction with specifics to the case is truly beyond me.

9:25 It is all available on the MD Judiciary Case Search site. We all must realize that the case was to be held yesterday. The indictment was posted last evening. We ALL tend to forget that there is a clerk who has to enter the information to the site by hand everyday and that takes a bit of time. That does not excuse the office from not being forth coming, however in today's age, I think there are much graver concerns over the our area.

The guy is charges with alleged child sex abuse charges and taking video of such.

If the grand jury met yesterday like you say they could not tell you until the indictment is returned in the court and it is unsealed.

Actually, that idiot IS/WAS a neighbor of mine. While his acts are deplorable and I hope he gets life without parole, I also feel it necessary to address the larger picture. For example, if our rights to own firearms are taken away like the government wants, then we all risk danger. By that I mean, if it were my child involved, this whole case would be a mute point because he would not be around to stand trial. Right now, our government is doing everything in its power to strip each and everyone of us of our rights and freedoms.

I agree with you that he is a monster and understand your long issues with him and I do not discredit that you have a personal stake in the game, for a lack of a better words, but he is facing 9 felonies and 13 misdemeanors as you know. He will be going away for a long time, or at least he better Matt.

My thoughts are what can we do to stop this runaway freight train of a government before they collapse this once great nation and county of ours?

10:06...sorry to break the bad news. There is NOTHING (short of a civil uprising) that can be done. Many people have been cowered by the power of the state. Many others live in comfort (relatively) and are afraid to lose the little they think they have....Others have been convinced that we have powerful and pervasive "enemies" that need our constant (and, again, pervasive) vigilance and support EVERY measure to accomplish that (i.e. The Patriot Act & the NDAA). Others think that they just need to vote into office the next person who promises to "change" things, even though NO ONE (Democrat or Republican) has changed ANYTHING except the level of corruption and ineptitude. The best you can do is what MILLIONS (none of whom are wearing a tin-foil hat) are doing. Stock up and get ready. Because it's coming.

Our country IS NOT BECOMING anything. It is already there and has been for quite a while.

The powers that be know this. A few of the enlightened ones know this.

The VAST majority of americans do not. They are just beginning to wake up and see what is going on. Too late, as usual.

We are dealing with much smarter people than there ever could be on this blog. They know what your are going to do before you do.

You people are too busy fighting amonst yourselves, worrying about people on welfare, who is getting food stamps, who is living in public housing and for how long.

You are no real threat to them or anyone else. You mindset is a comedy of errors.

And I know you're going to bash me for saying this. I don't care. It needs saying.

You are a bunch of wannabe hero's without a plan between any of you. But you can eat well for a few weeks. lmao.

And then what are you going to do? Do you know where to attack the enemy? Do you even know WHO THE ENEMY IS?

It's going to be over before you even know it's here.

Stop mouthing off and get some organization. And for God's sake, don't do it on the internet or this blog.
