(CNN) -- A Florida jury awarded a 92-year-old man $1.9 million in compensatory damages for the death of his wife, a former two-pack-a-day Marlboro smoker who started when she was 16 and died in her 70s, attorneys said Thursday.
The jury of five women and one man deliberated for slightly more than a day before deciding on the amount, attorneys for both sides said. The jurors put the total award at $5.3 million but found that Philip Morris USA was only 36.5 percent responsible for the lung cancer that plaintiffs said killed Leon Barbanell's wife.

Having lost loved ones to cancer,I sympathize with this gentleman but why is the tobacco company responsible for his wifes death?She chose to smoke,like many of us do,even though we know its harmful to us.Alot of people die early preventable deaths from alcoholism also,but you do not see news reports of massive torts against Jack Daniels or Budweisers parent companies.
Wow this is unreal. What ever happened to personal responsibility. You know smoking is bad for you, you do it anyway, you get cancer, and that's the cigarette makers fault??? I think I'll go buy a gun, shoot myself in the hand repeatedly, and then sue Smith and Wesson. "Wait, these bullets really sting!!!!"
And you wonder why tort reform is needed? Why can't people be accountable for what they deliberately put in their bodies? This is absurd and benefits the lawyers.
If I had been on the jury, there would have been a different verdict. He does not deserve any compensation for anything. Where do they find these juries???
For God's Sake, the widower didn't die! Why the hell is he getting money because his wife is an idiot?! He's gonna die in a bit anyways. I understand sorrow but god this sounds like a corrupt jury.
