The Hudson Center Packs Them In

This weekend the Willis W. Hudson Center welcomed hundreds of people to their facility for some great fellowship and a great time. Mayor Ireton was present and I even saw Tony Sarbanes there and spoke to him for a while. It was very nice to see so many come together while so many other events were going on at the same time this weekend. The biggest hit there, (believe it or not) was the basketball hoop they set up. The kids were having a blast!

I was honored to be invited to my 6 year old grand-daughters dance recital today. I am so blown away of the talent in this show. The lady who owns Feet of Fire has done a FANTASTIC JOB in teaching these young boys and girls. Yes there were boys that were very good, but the girls, or should I say young women were the stars.

I was blessed by having 3 boys and thought being a Soccer Mom was tough. Watching today the mothers, especially my daughter-in-law run back and forth to do hair, change costumes, and help in ay way to make the show run smooth. My job as a soccer mom was a piece of cake even with the boys on 3 different teams.

The hours the dancers have to learn a dance and practice amazes me. This means dedication from the dancers themselves and also from the parents and siblings. The emotion you could feel from the dancing was so moving I cried several times. Miss Shaun, the owner and teacher even danced and was truly loving every second of this. I could tell by her glow and smile in her eyes, and all this after having a baby 3 months ago. She looks great.

What I saw today on this stage was our future. The pure joy of something they all loved to do and took the time to work on this, and the confidence they had to perform. I saw hope today and I am looking forward to the next show.

Business Owner Finds Man Deceased In Office

Location of Incident: Aqua Leisure Plus, 35465 Wolfneck Rd., Rehoboth, Delaware, Sussex County

Date and Time of Occurrence: Sunday, June 07, 2009, at approximately 10:50 a.m.

Resume: At approximately 10:50 a.m. this morning, the business owner of Aqua Leisure Plus entered the store in order to open. He soon discovered a person slouched over in a chair in the office. Upon this discovery, the owner fled the store and called 911.

Delaware State Police Patrol Units responded to the business, and found a male subject deceased.

This investigation is ongoing and it appears the subject may have been in the middle of committing a burglary when he died of unknown causes. The body of the male was turned over to the Medical Examiner's Office and his name will not be released at this time, pending notification of the family.

Vehicle One Dr.: Jacqueline Shorter, 71 yrs. old female, Salisbury, Md.
Pronounced at Peninsula Regional Medical Center as a result of injuries sustained in the collision.

Vehicle Two Dr.: Granville McCauley, 69 yrs. old, Stephenson, Va.
Minor Injuries - Treated and released from Peninsula Regional Medical Center.

Vehicle Two: 2000 Chrysler Grand Voyager

BRIEF RESUME:

Vehicle one, a 1988 Honda Civic was attempting to cross westbound U.S. Rt. 50 and continue northbound onto Sixty Foot Road when it failed to yield the right of way to vehicle two which was westbound on U.S. Rt. 50 in the slow lane. Vehicle two is a 2000 Chrysler Grand Voyager. The operator of vehicle one was transported to Peninsula Regional Medical Center where she was pronounced due to injuries sustained in the collision. The driver of vehicle two and his passenger were treated and released with minor injuries.

The investigation is continuing. It does not appear speed or alcohol was involved. Occupants in both vehicles were wearing their seatbelts.

More Bodies From Downed Jet Found

Brazil (June 7) — Three more bodies were found Sunday in the ocean near the spot where an Air France jet is believed to have crashed a week ago, bringing the total number of bodies plucked from the water to five, Brazil's military said.

Authorities also said pilots searching the mid-Atlantic also spotted an undetermined number of additional bodies from the air and are sending ships to recover them, said Navy Capt. Giucemar Tabosa Cardoso.

City should address its election cycle, benefits

Salisbury has two issues that need to be addressed in the near future -- compensation for elected officials and reviewing the municipal election cycle. Common sense and levelheaded discourse will bring consensus on a solution.

With the recent controversy over health benefits for elected officials, the problem is this is not included in the municipal code as a part of the compensation package. Historically, this has been offered to elected officials and was simply added in the budget; hence, the precedent and policy argument. But the municipal code and Salary Review Committee never offered health benefits as part of the compensation package.

The benefit as used by council members is worth more than $7,000, making total compensation for those who use it at $17,000. The Salary Review Committee should revisit it this year and make a recommendation to codify, should they so opine. It should be added to the compensation package.

Next, I believe the municipal election cycle should be returned to the fall, with the national and state elections. This will increase voter turnout and reduce the number of election cycles. It will also allow a newly elected mayor time to settle in and execute priorities with his or her own budget in the spring.

Though this was changed several years over concern that local candidates were lost in the shuffle, the consequence has been less participation at the polls.

Boy Scouts Of America Somerset Outstanding Citizen Award Dinner

The Tri-County District of the Del-Mar-Va Council, Boy Scouts of America, will hold its annual Somerset County Outstanding Citizen Dinner on Friday, June 19, 2009 at the Somerset County Civic Center in Princess Anne. This year the Boy Scouts will honor Austin Cox Sr. Austin has been and continues to be an active member of the Lower Shore community.

The Somerset Outstanding Citizen Dinner is the annual opportunity for the community’s leadership to gather and celebrate the successes of the Boy Scouting program in our area. The dinner is built around recognizing a person who uses the character traits taught in Scouting to make our community a better place. While running what is now Delmarva's air conditioning, heating, plumbing and electrical specialist, Austin has personified all that is good about the business community and its people. Along with running a business he has been active in the Crisfield Fire Company, the Crisfield City Council, the Elks, the American Legion, Kiwanis, the J. Millard Tawes Museum, the Heritage Foundation and the Chesapeake Bay Foundation. As part of his work with the museum he has worked with children to better understand the eco-systems of the bay. He has built a crab shanty to reproduce for educational purposes what the life is like and the things necessary to make a living from the water. Over 600 children have participated in this experience. This year Austin is one of ten D-Day veterans to accompany twenty girls and boys from the USA to France. The purpose is to commemorate the invasion of Europe and to teach the students what the landings were like from those who were actually there at the time.

The event will draw over 150 people to recognize Austin for his service. The Outstanding Citizen Dinner will hopefully raise over $20,000 to help support scouting programs and services. Over 15,000 youth are served by the Del-Mar-Va Council, Boy Scouts of America annually. Special efforts are made to reach urban, rural, minority, handicapped, and underprivileged youths, who will benefit most from Scouting’s values-based programs.

Individual tickets are $35.00 and event sponsorships are available. On line registration is available at www.dmvc.org/tc-ocad . Reservation and Advertizing deadline is June 12, 2009.

Will You Dance With Me?

Too many people put off something that brings them joy just because they haven't thought about it, don't have it on their schedule, didn't know it was coming or are too rigid to depart from their routine.

I got to thinking one day about all those women on the Titanic who passed up dessert at dinner that fateful night in an effort to cut back. From then on, I've tried to be a little more flexible.

How many women out there will eat at home because their husband didn't suggest going out to dinner until after something had been thawed? Does the word 'refrigeration' mean nothing to you?

How often have your kids dropped in to talk and sat in silence while you watched 'Jeopardy' on television?

I cannot count the times I called my sister and said, 'How about going to lunch in a half hour? She would gas up and stammer, 'I can't. I have clothes on the line. My hair is dirty. I wish I had known yesterday, I had a late breakfast, It looks like rain.' And my personal favorite: 'It's Monday.' She died a few years ago. We never did have lunch together.

Because Americans cram so much into their lives, we tend to schedule our headaches. We live on a sparse diet of promises we make to ourselves when all the conditions are perfect!

We' ll go back and visit the grandparents when we get Steve toilet-trained. We'll entertain when we replace the living-room carpet... We'll go on a second honeymoon when we get two more kids out of college.

Life has a way of accelerating as we get older. The
days get shorter, and the list of promises to ourselves gets longer. One morning, we awaken, and all we have to show for our lives is a litany of 'I'm going to,' 'I plan on,' and 'Someday, when things are settled down a bit.'

When anyone calls my 'seize the moment' friend, she is open to adventure and available for t rips. She keeps an open mind on new ideas. Her enthusiasm for life is contagious. You talk with her for five minutes, and you're ready to trade your bad feet for a pair of Roller blades and skip an elevator for a bungee cord..

My lips have not touched ice cream in 10 years. I love ice cream. It's just that I might as well apply it directly to my stomach with a spatula and eliminate the digestive process The other day, I stopped the car and bought a triple-Decker. If my car had hit an iceberg on the way home, I would have died happy.

Now....go on and have a nice day. Do something you WANT to......not something on your SHOULD DO list. If you were going to die soon and had only one phone call you could make, who would you call and what would you say? And why are you waiting?

WCDC Inmate Found Guilty Of Assault On Correctional Officer

On Friday June 6, 2009 the case of State of Maryland vs Brinton Cox was brought to trial. As you may recall Brinton Cox is the inmate who attacked Sergeant Victor Stone on January 8, 2009.

After months of delays by the defense(this was the forth time the case was called to court) Brinton Cox was called to face his accuser. The prosecution called four witnesses who testified that Mr. Cox threw or pushed Sergeant Stone against the metal steps in his housing unit. You can get more information by going to a previous post, WCDC Officer injured by inmate posted on January 8, 2009. All four prosecution witnesses testified that Mr. Cox did assault Sergeant Stone. The defense had called for witnesses to show, but nobody showed up in Mr. Cox's defense. Mr. Cox did take the stand in his defense, changed his mind when his attorney informed him that the prosecution could bring up past criminal acts. Mr. Cox declined to testify and ran back to his seat. The Judge, Honorable Bruce Wade, found Mr. Cox guilty on all charges. When the judge proceeded to sentencing he imposed a Pre Sentencing Investigation due to Mr. Cox's extensive violent criminal convictions. Mr. Cox will be sentenced after the investigation is completed. Mr. Cox is facing 15 years to be served consecutive to any other sentences. This is not any normal sentence though. Because it involves a assault on a correctional officer, all time is to be served day for day with no parole or probation possible.

I wish to commend Sergeant Stone and his witnesses for their diligence in seeing this process through. The court system is sometimes slow and cumbersome, but justice will prevail.

Aging With Pleasure

I would never trade my amazing friends, my wonderful life, my loving Family for less gray hair or a flatter belly. As I've aged, I've Become kinder to myself, and less critical of myself. I've become my Own friend. I don't chide myself for eating that extra cookie, or for Not making my bed, or for buying that silly cement gecko that I didn't Need, but looks so avante garde on my patio. I am entitled to a treat,
To be messy, to be extravagant.

I have seen too many dear friends leave this world too soon; before They understood the great freedom that comes with aging. Whose business is it if I choose to read or play on the computer until 4 AM and sleep until noon? I will dance with myself to those wonderful Tunes of the 60 &70's, and if I, at the same time, wish to weep over a Lost love ... I will.

I will walk the beach in a swim suit that is stretched over a bulging Body, and will dive into the waves with abandon if I choose to, despite The pitying glances from the jet set. They, too, will get old. I know I am sometimes forgetful. But there again, some of life is just As well forgotten. And I eventually remember the important things.

Sure, over the years my heart has been broken. How can your heart not Break when you lose a loved one, or when a child suffers, or even when somebody's beloved pet gets hit by a car? But broken hearts are what Give us strength and understanding and compassion.

A heart never broken is pristine and sterile and will never know the Joy of being imperfect.

I am so blessed to have lived long enough to have my hair turning gray, And to have my youthful laughs be forever etched into deep grooves on My face. So many have never laughed, and so many have died before their hair could turn silver.

As you get older, it is easier to be positive. You care less about What other people think. I don't question myself any more. I've even Earned the right to be wrong.

So, to answer your question, I like being old. It has set me free. I Like the person I have become. I am not going to live forever, but While I am still here, I will not waste time lamenting what could have Been, or worrying about what will be. And I shall eat dessert every Single day (if I feel like it).

* I was born in one country, raised in another. My father was
born in another country. I was not his only child. He fathered several
children with numerous women.

* I became very close to my mother, as my father showed no
interest in me. My mother died at an early age from cancer.

no experience in leading a single organization. Yet I was a powerful speaker and
citizens were drawn to me as though I were a magnet and they were small roofing
tacks.

* I drew incredibly large crowds during my public appearances.
This bolstered my ego.

* At first, my political campaign focused on my country's foreign
policy. I was very critical of my country in the last war and seized every
opportunity to bash my country.

* But what launched my rise to national prominence were my views
on the country's economy. I pretended to have a really good plan on how we
could do better and every poor person would be fed & housed for free.


* I knew which group was responsible for getting us into this
mess. It was the free market, banks & corporations. I decided to start making
citizens hate them and if they were envious of others who did well, the plan was
clinched tight.

* I called mine "A People's Campaign" and that sounded good to all
people.

* I was the surprise candidate because I emerged from outside the
traditional path of politics & was able to gain widespread popular support.

* I knew that, if I merely offered the people 'hope,' together we
could change our country and the world.

* So, I started to make my speeches sound like they were on behalf
of the downtrodden, poor, ignorant to include "persecuted minorities"
like the Jews. My true views were not widely known & I needed to keep them
unknown, until after I became my nation's leader.

* I had to carefully guard reality, as anybody could have easily
found out what I really believed, if they had simply read my writings and
examined those people I associated with.

* I'm glad they didn't. Then I became the most powerful man in
the world.. And the world learned the truth.

(CBS) It's the last thing you'd expect to see emerging from the woods of Tennessee - the last two things actually. Which is why CBS News correspondent Steve Hartman knew the story of Bella and Tarra would be big. He just had no idea how big.

"Tarra and Bella have agents now?" Hartman asked.

"It's all your fault," said Scott Blais, a cofounder of the elephant sanctuary.

"It is all your fault," agreed Carol Buckley, the other cofounder.

Buckley and Blais run The Elephant Sanctuary outside of Nashville.

"When that piece aired we were just bombarded with offers," Buckley said. "Books, movies, any number of things."

If you saw the original story, you know how elephants come here from zoos and circuses one by one - but stay here two by two.

"Every elephant that comes here searches out someone that she then spends most of her time with," Buckley said.

The Duggar's At Salisbury Sam's Club

Joe,

We have never sent any info to you before, but this was too good to keep to ourselves. The Duggar family from TLC's "18 Kids and Counting" was at the Salibury Sam's Club. We spotted their silver bus while we were getting ready to get gas. I told my wife their was somebody famous on that bus, and darn it, the Duggar family began to pour out of the bus.

We drove over and spoke to them and they were super friendly. Jim Bob, the dad, even came over and introduced himself to my wife and I. As more children piled out of the bus, they climbed and hung on to the door of the car as my wife was showing pictures of our dogs to Johannah and Jackson. They nearly climbed inside. Johannah advised that she wanted to be a Mommy when she grows up and Jackson wants to be a police officer.

Jim Bob, was kind enough to oblige us with a couple of photos. If we knew we were going to meet famous people at the Salisbury Sam's Club, we would have put on better clothes.

Oh, yeah. They were in town attending one of Jim Bob's cousins' wedding this weekend. We also met Grandma Duggar.

This is D-Day. I heard my Dad talk about it my whole life until he passed last September. Thanks to all of you who fought for this just cause.

Here in Caroline county we had a D-Day tribute put on by the Caroline County Historical Society at Linchester Mills which or Historical Society just renovated. Thank you J.O.K. Walsh and the Historical Society for all the good work you do.

My father had his uniform and a video of him on display talking about that most important battle. Thank you Dad. (Click on the photo to see the details.)

Armed Robbery At Winterplace Market

INCIDENT: Armed Robbery DATE: 06-05-2009 LOCATION: Winterplace Market, 6731 Hobbs Road, Salisbury, Maryland NARRATIVE: On June 5, 2009 at approximately 2110 hours, the Wicomico County Sheriff’s Office and the Wicomico Bureau of Investigation responded to the Winterplace Market on Hobbs Road for a reported armed robbery. Two armed suspects entered the Winterplace Market and demanded the clerk open the cash register. The suspects were able to obtain an undetermined amount of US currency during the robbery. The store clerk was unharmed.

A Reader Writes In About Ethics Decision

I know why the delay in the Ethics board decision getting released. That way, Jonathan Taylor and the Barrie Tilghman powermongers got to smear Debbie Campbell and Terry Cohen on the newspaper's highest circulation day (Sunday) and announce they were cleared of all wrong doing on the newspaper's slowest circulation day (Saturday). I have family in the media business down south. Circulation numbers are used to plan advertising. The Tilghman Times people have played the same game with their news.

Did you see Taylor's quote at the end of today's Daily Times article? He said this was all for better government. Now you got to know he didn't come up with that quote himself. Look at what he said in the previous Daily Times article. He just sounded like a crank nutjob mad that Campbell and Cohen got insurance and was trying to embarrass them. (Forget that Shanie took city health insurance needlessly for four years!)

All of a sudden Taylor sounds like Barrie Tilghman trying to sound like Terry Cohen talking about good government? ROTFLMAO! The difference is, sincerity can't be faked and Barrie was always trying to fake it. Guess that's why Lynn Cathcart was there and left early. She knew the Scheme Team's butts got kicked and they had to go into major damage control.

You can bet it won't end here, sorry to say for the two ladies on council. Sorry to say for us!

CAR LOCATED IN KENT CO. MURDER INVESTIGATION

(Crumpton, MD) – The car leased by a husband who was charged late last night in Kent County with the murder of his wife has been found by police in Washington, D.C.

Maryland State Police homicide investigators were contacted by officers from the Metropolitan Police Department in Washington, D.C. at about 11:15 p.m. yesterday and informed that a car fitting the description of the 2007 blue Honda Accord leased by Ryan D. Holness had been located in Northwest Washington. A Metropolitan Police Department officer spotted the car parked in the 600-block of I Street NW. State Police homicide investigators responded to the scene and confirmed it as the vehicle they had been searching for.

State Police homicide investigators took custody of the car and had it towed to the Forestville Barracks. Troopers are currently preparing an application for a search warrant for the car. The car will be searched and processed for evidence later today after a search warrant is granted. Information about anything observed in the car or evidence recovered after the search warrant will not be released at this time.

State Police have no specific information about how the car arrived in Washington, D.C. The nationwide lookout for the vehicle has been canceled.

The investigation is continuing.

HUSBAND CHARGED IN KENT COUNTY MURDER

Ryan D. Holness

(Crumpton, MD) – The husband who told Maryland State Police homicide investigators he and his wife were carjacked in New Jersey and the carjacker killed his wife along a rural Kent County road early this morning has been charged with his wife’s murder.

After consultation tonight with the Kent County state’s attorney, Maryland State Police homicide investigators charged Ryan D. Holness, 28, of the 48000-block of Spinnaker Court, Lexington Park, Md., with first degree murder and second degree murder. He has been processed at the Centreville Barracks and will be taken before a court commissioner in Kent County later tonight for a bond hearing.

Ryan Holness is charged with the murder of his wife, Serika Dunkley Holness, 26, of the same address. The body of Serika Holness was found by police lying in a field along Rt. 290, four miles north of Rt. 301, in Crumpton, at about 6:00 a.m. today.

Maryland State Police and the Kent County Sheriff’s Office responded to a 911 call shortly before 6:00 a.m. today in the 10000-block of Crumpton Road (Rt. 290). Ryan Holness had gone to a house there and asked the resident to contact 911. He told police he and his wife were traveling back from visiting relatives in Brooklyn, New York last night when they were carjacked at a rest area between exits 8A and 8 on the New Jersey Turnpike.

Ryan Holness told investigators he was made to drive to the Crumpton area and was assaulted by the suspect who was armed with a gun and a knife. He said the suspect bound his hands and feet with duct tape before attacking his wife who had attempted to flee.

While Maryland State Police launched a nationwide search for the suspect described by Ryan Holness and the vehicle today, they also interviewed numerous individuals and examined physical evidence at the scene. Information provided by Holness throughout the day today did not match information developed through witnesses and evidence at the scene. Further detail about those inconsistencies cannot be provided at this time.

Troopers continue to search for the 2007 blue Honda Accord. The car is believed to have Virginia registration plates reading either 876718, or KDZ-1408.

This investigation and the search for the vehicle will continue throughout the weekend. Anyone with information about this murder or the missing vehicle, is urged to contact Maryland State Police at the Centreville Barracks, at 410-758-1101.

Incident Underscores Why the Conversation Needs To Be Serious and Meaningful

Midway Movies, Route 1 in Lewes, Delaware, Sussex County

Date and Time of Occurrence: Friday, June 6, 2009, at approximately 8:35 p.m.

Suspect(s): Two 15-year-old girls from Chesapeake Beach, Maryland

Resume: At about 8:30 p.m. last evening, a staff member of the Midway Movies in Lewes was viewing the surveillance video system in the theaters when they came across two young ladies in one of the hallways.

The girls were observed taking off their clothes and snapping photographs of themselves with their camera enabled cell phones. These acts were done in public and witnessed by several other patrons walking by.

Troopers arrived on the scene and took custody of the suspects. They were taken back to Troop 7 on charges of Disorderly Conduct. Also, their parents were contacted.

Investigators learned that the two girls were de-robing and snapping the pics of themselves as they intended on electronically sending their racy photos to their friends- memorializing their behavior.

This incident underscores the dark contrast of how technology can both benefit and adversely impact our youth. Corporal/1 Jeff Whitmarsh says, “The purpose of this news release is not to simply notify the public of this incident, but to encourage parents to engage in serious and meaningful conversation with their kids about the dangers vs. the benefits of technology. As silly as incidents such as this may seem on the surface, there are real concerns afoot. Once a digital image is sent across the information highway, it no longer belongs to the sender. Photos, such as the ones taken last evening, all too often end up on various web pages and file sharing sites. It is not until the original sender learns how many people have seen their pictures, including strangers that the realization of their decision to send the photos in the first place sets in. This is why parents need to talk to their kids. This is why the conversation needs to be meaningful and serious.”

Gun Ban Upheld, Conceal Carry Info, New Blog Question

The National Rifle Association sued the City of Chicago, Illinois and Village of Oak Park, Illinois so citizens could protect themselves with handguns.

We lost. Gun ban won. The word came down June 2, 2009.

These two municipalities ban the possession of most handguns. But you are probably thinking we won in Washington, DC with the Heller case didn’t we? Didn’t that clear the right to own a handgun to protect yourself?

No. Here is why:
The courts felt that Washington, DC and the Heller case dealt with law enacted under the authority of the national government, while Chicago and Oak Park are subordinate bodies of state.

In short, courts are deciding the Constitution of the United States and the 2nd Amendment doesn’t apply to the entirety of the United States of America.

Beware:
1. This decision will be used around the country to ban you owning a gun.
2. Courts will decide that the 2nd Amendment will only apply to long guns because they better serve the intent of the Founding Fathers in that guns are for a citizen militia and long guns serve that purpose. Therefore handguns are unnecessary to the security of a free State according to the language of the Amendment.
3. States will argue that they are independent of the federal government and can ignore the Bill of Rights, as they successfully did in Chicago.

Fatal Pedestrian Crash Probed In Bear

Location of Incident: Route 40 westbound, west of Wellington Drive, Bear, Delaware, New Castle County

Date and Time of Occurrence: Friday, June 5, 2009, at approximately 9:26 p.m.

Resume: Members of the Delaware State Police Collision Reconstruction Unit are investigating a fatal pedestrian crash which occurred last evening on Route 40.

A 45-year-old male pedestrian was initially standing in the grass median separating the east and westbound lanes of Route 40. He then began to walk in a northerly direction across Route 40. He walked directly into the path of a 1995 Nissan Maxima resulting in the initial impact.

The pedestrian ended up in the roadway and was struck a second time by a 2006 Mercedes CV.

Neither operator of the aforementioned vehicles was injured.

The pedestrian was subsequently pronounced dead as a result of the injuries he sustained in this incident.

Alcohol in considered a factor in this crash on the part of the pedestrian. It was also noted that he was not crossing the roadway in a marked crosswalk.

No charges will be filed in this incident.

The names of those involved will be released later this evening.

Serious Injury Crash Reported On I-495

Location of Incident: I-495 southbound at Route 13, New Castle, Delaware, New Castle County

Date and Time of Occurrence: Saturday, June 06, 2009, at approximately 2:22 a.m.

Resume: Troopers are investigating an early morning crash that occurred on I-495 southbound at Route 13.

A 2000 Mercedes 230 was traveling southbound at a high rate of speed in the center lane.

The Mercedes approached a 1993 Volkswagen Eurovan in the center lane. The Mercedes swerved to the left and lost control. It traveled into the center median where it impacted a dirt burm. The Mercedes deflected back into the southbound lanes as it overturned. The operator was then ejected.

Debris flying off of the Mercedes struck the Eurovan.

The Mercedes ended up in the center lane of travel. A 1993 Dodge Ram pick-up was traveling southbound in the center lane and struck the Mercedes.

The operator of the Mercedes was transported from the scene to Christiana Hospital where he was last listed critical condition.

Alcohol is a considered a factor in this crash on the part of the operator of the Mercedes.

The names of those involved will be released later today after the family of the operator of the Mercedes is notified.

Dear Sonia, May I call you Sonia? We’ve just met but I feel I’ve known you forever, because of your “compelling story.” I’m an elderly, white male who’s a lawyer. But wait, I’m not that dull and dismissible. I’ve had my “story” moments.

Remember that psychologists’ list of the ten worst things that can happen to a person? Losing your job, or house, getting divorced, going bankrupt, facing death, burying a child. You know, nasty stuff. I’ve been through almost everything on that list, some more than once. You pick yourself up and continue on as best you can. Big whoop.

Having a “story” does not qualify anyone for the Supreme Court (or other high offices). Here are some examples. There have been four men who fit the following definition: They were born in humble circumstances, far from the centers of power in their nations. They suffered many losses and defeats in their early careers. Still, each of them became the leaders of their nations at a time when their nations faced potentially fatal wars.

In alphabetical order they were, Adolf Hitler, Abraham Lincoln, Benito Mussolini, and Joseph Stalin. True, they are all dead white guys, but they were in all the papers. Like theirs, your story proves that you are persistent. But, like theirs, persistent in what purposes?

Can we chat about the Constitution for a bit? It is our “supreme Law.” Check out Article VI, paragraph 2. And why must it be either the supreme law, or a nullity? See Alexander Hamilton, Federalist 33. I presume you know a little bit about other nations’ constitutions. Of the 186 with constitutions, a majority are dictatorships. The men in charge control the courts, the legislatures, and alter or suspend their constitutions as they choose.

Since you have a special concern for Hispanics and for “people of color,” surely you are aware of Hugo Chavez who has surmounted his constitution and is running Venezuela into the ground, or Robert Mugabe in Zimbabwe who has similar power and has utterly destroyed his once prosperous nation, with spates of murder thrown in.

By the way, I am also a person of color. The color is beige. From what I see on TV, we’re about the same.

The purpose of every constitution that actually works, as opposed to being mere window-dressing, is to restrain the branches of government within boundaries. Congress, for instance, has the power to “make policy.” See Article I generally, and Section 8 in particular. Courts do not have that power. It was sad to see the clip where you said they do, to law students at Duke. Sadder still was the fact that these budding lawyers and occasional judges laughed knowingly at your remark.

If you want to make policy, feel free to resign from the bench, run for Congress, and if you win, make policy morning, noon and night. But you have no right to keep your gavel and black robe, remain on the bench, and trample the Constitution when you feel an urge to make policy.

Thomas Jefferson said it best in the Kentucky Resolutions of 1798: “let no more be heard of confidence in man, but bind him down from mischief by the chains of the constitution,” Don’t get your knickers in a twist over “man” meaning everyone, women included. It’s just a literary convention, like Neil Armstrong stepping on the Moon, “One giant leap for mankind,”

The first task of any Justice of the Supreme Court is to know the Constitution, including the Amendment Article which gives the power to alter that document only to the sovereign people through elected representatives. The next task is to obey that Constitution. The third is to require parties in cases before the Court, to obey the Constitution.

You seem to have a problem with all three of those. That means that after you are sworn in, you will set out to violate your oath of office, repeatedly. If you really wanted to serve the nation and the Constitution, you’d withdraw your nomination, resign from the bench, and spend a year or so studying why the United States Constitution has survived longer than any other, and why the others have failed.

You are not alone in your ignorance. The President who appointed you, and the Senators who will probably vote to confirm, share your basic ignorance about why we have a Constitution and what that means.

Ah, well. Write when you get work.

Bank Robbery Probed

Date and Time of Occurrence: Friday, June 05, 2009- at approximately 3:38 p.m.

Suspect(s): Black male, approximately 30 - 40 years of age, average to large build, approximately 5’10’’ to 6’01’’, beard, wearing sunglasses, dark baseball hat, dark hooded sweat shirt/jacket, and blue jeans

Resume: Earlier this afternoon, Troopers responded to the Artisans Bank on Pulaski Highway for a reported bank robbery.

In this case, a black male suspect entered the bank and approached a teller. This subject presented the teller with a demand note for cash. He was also in possession of a handgun. The teller complied with the robber’s demands and the suspect then fled the scene.
