Fatal Pedestrian Crash Probed In Bear

Location of Incident: Route 40 westbound, west of Wellington Drive, Bear, Delaware, New Castle County

Date and Time of Occurrence: Friday, June 5, 2009, at approximately 9:26 p.m.

Resume: Members of the Delaware State Police Collision Reconstruction Unit are investigating a fatal pedestrian crash which occurred last evening on Route 40.

A 45-year-old male pedestrian was initially standing in the grass median separating the east and westbound lanes of Route 40. He then began to walk in a northerly direction across Route 40. He walked directly into the path of a 1995 Nissan Maxima resulting in the initial impact.

The pedestrian ended up in the roadway and was struck a second time by a 2006 Mercedes CV.

Neither operator of the aforementioned vehicles was injured.

The pedestrian was subsequently pronounced dead as a result of the injuries he sustained in this incident.

Alcohol in considered a factor in this crash on the part of the pedestrian. It was also noted that he was not crossing the roadway in a marked crosswalk.

No charges will be filed in this incident.

The names of those involved will be released later this evening.
