Jose Caballero, 40, and Elissa Alvarez, 21, were convicted in May of two counts of lewd and lascivious behavior in a case that drew international attention for the couple's brazen act. They were videotaped having sex on a Manatee County beach last summer in broad daylight. Witnesses testified that a 3-year-old girl saw them.
Caballero told jurors that he and Alvarez were not having sex and that witnesses were mistaken. Jurors listened to graphic testimony from witnesses and saw a video of Alvarez moving on top of Caballero in a sexual manner in the middle of the day while others watched.

There is no excuse for this at all. However I doubt the 3 yr old knew what they were doing. I don't think the sentence fits the crime and I disagree with them having to register as a sex offender.

I totally agree with the sentence and the SO status. Anyone who would have sex on a public beach ANYTIME is not only a trashy person but someone who is a pervert with no impulse control and perverts are to NOT ever be trusted ever and their names need to be blasted so others know the perverse nature of the person.
If she's not hot, then they should be arrested. If she in fact is hot, then it's all kool & the gang baby!
unfortunately 1:14 it is not illegal to be trashy and although I agree with you that there is a time and a place for this activity the sentence is ridiculous. there are child molesters getting their hands slapped for their crime, drug dealers selling to kids, domestic violence abusers that never see the inside of a jail cell, and these two "Consenting" adults go to prison? Come on people...stupid, trashy, inconsiderate, ....yes. But jail? why didn't the adults standing there watching tell them to take it somewhere else? they are obviously not smart enough to know this so someone should have told them....like a parent to a child. Your just as guilty if you stand there and watch and do nothing.

And the worse part is that the reasons to get on it is growing to the point where it has made the List totally Useless and very very expensive to maintain and run and now the LAWSUITS in many states are taking a toll on the List and allowing many on it to get off of it . Due to violations of the Laws. In which makes it even more useless and if you are in a certain class of people and should be placed on it for your crime. You are given is rubber stamp and not be placed on it. Maryland has lost many very costly Lawsuits in recent year or two and has cost the state millions of court costs and still lost and has allowed Thousands to come off the List and making it more Useless then ever. My feelings is it needs to be closed and reworked to be better for those it is suppose to protect and at this point it is overkill and making it useless as it is today..

No one gave a hoot when this was going on in OC during senior week. There were many a guy hooking up on the beach with young girls! I saw a couple doing it on one of the benches, they had a towel wrapped around them, but she was on his lap moving up and down like she had fire ants in her pants. Most everyone close by was cheering them on. Then there were the couples doing it on the balconies and waving to folks below watching. This is what OC wants and advertises to those kids!

The courts are worried about a 3 yr old seeing them doing something on the beach yet they don't have a problem with them being in the same bathroom with the opposite sex. BOTH are wrong.
For what it matters I just saw a photo of the young lady in question.Saying she's hot is an understatement.She looks like a 20 year old Selena.
