As long as the guy is an actual "physical control" of the vehicle, meaning sitting behind the wheel, he can be arrested. If the guy was sitting in the passenger or the back seat, and he wasn't stupid enough to tell a police office he was alone all night, he wouldn't be found guilty if arrested.
