The Boulevard Theater Part III

As I had stated on Sunday, Salisbury News has the Exclusive Photos of the old Theater coming down. While the Construction Company made every attempt to pull the face of the Main Street side of the building inwards towards the inside of the building, the structure was simply too weak. Once they started taking down the cinder block, the outer shell started leaning forward and I just knew the building would fall forward into the street, I was right.

It's a shame the rest of the Media chose not to participate because this would have made for some great video. I have photos of the back side of the building being torn down and I'll post some of those later. There's some cool shots of the old balcony seats still in place on the upper level before they tore it down.

Nevertheless, I hope you've enjoyed these pictures. It's just a shame that Arts Group refused to reinvest in this property and keep it maintained. Like I said, they won't see a penny out of me no matter how many times they change their name.

How The Internet Can Hurt The Innocent, Until Proven Guilty?

Last week I received a telephone call from a concerned Parent who had read on the Internet some disturbing information.

He had done a Google Search on his 20 year old Daughter who is attending College at Salisbury University. She was recently pulled over by the Sheriff's Department for not having her headlights on and by the time it was all said and done she had been arrested for a DUI.

OK, so the first thing that ran through my head was, she's been arrested, we received a "Press Release" from the Sheriff's Department, all is fair and good, right?

Well, not necessarily. The Sheriff's Department did everything right but let's look into this a little deeper because while I had defended the Sheriff's Department, I had been listening to the Father expressing how his Daughter had been violated and by the time we were done talking, he was right. At least I felt that way anyway.

You see, once this information gets onto the Internet, it never goes away. In America, we're innocent until proven guilty. However, with the presence of Blogs and On Line Newspapers, DUI information gets out there through Press Releases like the one we provided and that's it.

Once this young lady goes out looking for a job and they do a Google Search on her, guess what, they're going to read about that DUI. Now let's say she 's found innocent, like many have in the past. There's an instant tattoo on her personal record, one in which can't be taken away.

So my reasoning for this Post is to ask all of you what YOU think about such Press Releases BEFORE people are found guilty. I know there are many other examples we could use but I'm going to ask that we stick to this one subject at hand as an example so as we don't have comments go off in the wrong direction about other previous Posts. Let's stick to this example.

Do you believe Law Enforcement Agencies should produce Press Releases before trial? As you and I both know, in many of the local cases people are found innocent while many people commenting here regularly express their disbelief in so many cases falling apart. In the mean time, the people involved with charges against them are exposed on the Internet and that information just doesn't go away.

Perhaps Press Releases should only come out after the case has been tried? What's your thoughts on this. Keep in mind, I do realize that the Case Search Files are also considered Public Information. I just wonder if that too is right.

SHOULD SALISBURY HELP THE VILLAGE OF HOPE?

It is surprising and seems disappointing that the City administration does not favor any reduction of an unusually high water and sewer bill issued to the Village of Hope (formerly, the Joseph House Village), which offers shelter and medical attention to the homeless and uninsured. That organization received an unusually high water bill – over 2.5 times higher than normal – after which it was determined that at least some of the difference was due to a leaking faucet and toilet that have been repaired.

The Village of Hope has paid the bill and requested that the City waive some of the amount billed. But the Finance Director has responded as follows: “I am not recommending that a refund be granted,” on the basis of the City’s policy.

The request has been bucked to the City Council, which will consider it at today’s work session. Apparently, Mayor Ireton has accepted Ms. Oland’s position as that of the administration. If you agree that under the circumstances it would be fair and reasonable to waive some of the amount billed, please contact the Council at: ALLCityCouncilMembers@ci.salisbury.md.us

Great Crevase Edgar Mueller. Hard work: Together with up to five assistants, Mueller painted all day long from sunrise to sunset.

The picture appeared on the East Pier in Dun Laoghaire , Ireland , as part of the town's Festival of World Cultures.

He spent five days, working 12 hours a day, to create the 250 square metre image of the crevasse, which, viewed from the correct angle, appears to be 3D. He then persuaded passers-by to complete the illusion by pretending the gaping hole was real.

'I wanted to play with positives and negatives to encourage people to thnk twice about everything they see,' he said. 'It was a very scary scene, but when people saw it they had great fun playing on it and pretending to fall into the earth. 'I like to think that later, when they returned home, they might reflect more on what a frightening scenario it was and say, "Wow, that was actually pretty scary."

Knockout Show Slated For Wicomico Youth & Civic Center

An Eastern Shore favorite is scheduled to make his return to the Wicomico Youth & Civic Center. Fernando Guerrero returns to the Eastern Shore to take part in Boxing’s Future Champions on Friday, June 19. Tickets go on sale Monday, May 4 at 10:00am.

How To Instantly Fail A DUI Test

"Juror No. 6" Letter Stirs Sentencing Debate

Jim Caron spent 10 months on a federal jury in Washington in 2007 that voted to acquit a D.C. man accused of racketeering, murder and dozens of other charges, convicting him solely on a $600 drug deal.
Months after the verdict, Mr. Caron learned prosecutors still wanted to send the defendant, Antwuan Ball, to prison for 40 years. "He was furious, he was absolutely furious," recalled Mr. Caron's wife, Mary Brennan. "He told me, 'I'm going to write a letter to the judge.'"
Signing his letter "Juror No. 6," Mr. Caron wrote, "It seems to me a tragedy that one is asked to serve on a jury, serves, but then finds their work may not be given the credit it deserves." Mr. Caron, 60, died unexpectedly a few weeks later from an apparent heart-related illness, but his letter has found a life of its own.
Quoting a person they know only as "Juror No. 6," a handful of senior federal appeals judges and attorneys across the country are citing Mr. Caron's letter - including in a recent brief sent to the U.S. Supreme Court - in railing against a little-known practice called acquitted conduct sentencing.
The policy lets federal judges mete out tougher sentences based on what lawyers call "acquitted conduct," or the criminal charges for which a defendant has been acquitted in court.

Gilbert S. Merritt Jr., senior judge on the 6th Circuit U.S. Court of Appeals, recently quoted Juror No. 6 in a dissenting opinion he filed with five other judges in a case in Kentucky.
"The juror's reaction is the same, I believe, as the reaction that the drafters of the Declaration of Independence, the Constitution and the Sentencing Reform Act of 1984 ..." the judge wrote of Mr. Caron.
"It undermines public respect for the law when a judge overrides a jury acquittal," Judge Merritt said in a phone interview. "And this letter that this fellow wrote is a good example of why."
Not everyone agrees. Many judges hold that acquitted conduct sentencing is widely accepted and note the policy has been upheld by the courts. Indeed, they point out that judges can take all sorts of conduct into account when sentencing a defendant, just so long as the sentence falls within the minimum and maximum terms allowed under the law. WWII Army Vet Receives Bronze Star

Pfc. Clarence Wallaert was shot in the hip by a German sniper while fighting against the German Winter Line in Italy Dec. 30, 1943. Wallaert bandaged his own wound and provided 12 hours of automatic rifle support for his Army comrades advancing into the Liri Valley-the "gateway to Rome."
Nearly 66 years later, Wallaert, 86, was awarded the Bronze Star Medal at Scott Air Force Base, Ill., April 14 for his meritorious actions during World War II.
Wallaert's son-in-law, retired Air Force Col. Jim Harper, attended the ceremony at Military Surface Deployment and Distribution Command Headquarters where he works, along with other members of Wallaert's family.
"It was such an awesome and humbling experience to have (Maj.) Gen. (James) Hodge meet with the family and then award his medal," Harper said. "My father-in-law said that he was 'awed' by the ceremony."
Harper said the award was delayed for decades because Wallaert and his family did not realize he was authorized to receive the award until recently.
"It was unknown that Army regulations authorized the Bronze Star medal for WWII recipients if they had been awarded the Purple Heart and the Combat Infantryman's Badge," Harper said.
Wallaert previously received both decorations and his Bronze Star request was filed March 16. "It's one of those gems uncovered over time that showed he was authorized to receive it (the Bronze Star) when it was unknown to him prior to recently," Harper said.
Hodge, SDDC commanding general, presented Wallaert with his Bronze Star during the ceremony last week. "I was as happy as I could possibly be to be involved in the recognition of one of our WWII veterans," said Hodge, whose father is also a decorated World War II veteran.
"It was close to me personally," he said. "You could certainly see his pride during the ceremony."
Friday, back in Michigan, Wallaert said via phone that he was surprised by the large crowd at the ceremony. "I was really overwhelmed," Wallaert said. "I expected maybe one person to be there but they had the whole room (filled). I was just doing my duty and I didn't expect all the praise."
Wallaert served as a Browning Automatic Rifleman with the Army's K Company, 3rd Battalion, 180th Infantry Regiment, 45th division, from February 1943 until January 1944.
Wallaert and Company K received strong combat resistance from the hills of Mount Raimo in Italy, Dec. 30, 1943. The company had just cleared the town of Venafro and was fighting to move forward and drive German soldiers out of Southern Italy when then - Pfc. Wallaert was wounded but continued to provide automatic rifle support for his company.
Before his exceptional actions in Italy, Wallaert served in North Africa and Sicily. After being wounded in Italy he was transferred to a military hospital in Tunisia to recover and was then transferred back to the United States.
Back in the U.S., Wallaert was assigned to Fort Sheridan, Ill., on the north side of Chicago. He was discharged from active service on Dec. 7, 1945.
After being discharged, he worked as a mixer for the Sunshine Biscuit Company in Saginaw, Mich., then on a General Motors assembly line. Wallaert married his wife Geraldine on May 1, 1948. The couple has six children.
In 1995, Harper, went to Venafro, Italy, and took pictures of the war site. He shared the photos with his father-in-law who recalled the battleground.
"He remembered well the terrain and which mountain he was wounded on," Harper said.
Of the Bronze Star Award ceremony, Harper said it too would become another memory for his father-in-law. "(The ceremony) became a significant life event for my father-in-law," he said, "and I am sure it is one that will provide him many fond memories throughout his life."

A firefighter was working on the engine outside the station, when he noticed a little girl nearby in a little red wagon with little ladders hung off the sides, and a garden hose tightly coiled in the middle.

The girl was wearing a firefighter's helmet. The wagon was being pulled by her dog and her cat.

The firefighter walked over to take a closer look.

That sure is a nice fire truck,' the firefighter said with admiration.

Thanks,' the girl replied.

The firefighter looked a little closer. He noticed the girl had tied the wagon to her dog's collar and to the cat's testicles.

'Little partner,' the firefighter said, 'I don't want to tell you how to run your rig, but if you were to tie that rope around the cat's collar, I think you could go faster.'

The little girl replied thoughtfully, 'You're probably right, but then I wouldn't have a siren.

Cinco de Mayo

While some think of Cinco de Mayo as the Mexican equivalent to the United States' 4th of July, it's not, really. It's actually the celebration of the Mexican army's unlikely victory over the French occupational forces of Napoleon III at the Battle of Puebla on May 5, 1862. While outnumbered nearly two to one by a much better equipped force that had known no defeat in almost fifty years, the Mexicans rallied and defeated the French in a day-long battle that ended in mud and blood, with French casualties outnumbering the Mexicans' by over five to one, a stinging defeat that reverberated around the world.
On September 16, 1862, then-President Juarez declared that the anniversary of the Battle of Puebla would be a national holiday. It has since fallen by the wayside as a national celebration, and is not now even a federal holiday. Instead, it has become a day of celebration of Mexican heritage throughout the New World and elsewhere, much the same as St. Patrick's Day is for the Irish.

So, as you down that Corona or Dos Equis on May 5th, think of the battle that signalled the downfall of the French occupation and oppression in Mexico that began in 1838. Lift a glass to the brave souls who looked death in the eye and, against overwhelming odds, fought for their freedom. Salud!

Remember it takes a college degree to fly a plane, but only a high school diploma to fix one...a reassurance to those of us who fly routinely in our jobs. After every flight, United Parcel Service pilots fill out a form, called a 'gripe sheet,' which tells mechanics about problems with the aircraft. The mechanics correct the problems; document their repairs on the form, and then pilots review the gripe sheets before the next flight.

Never let it be said that ground crews lack a sense of humor. Here are some actual maintenance complaints submitted by UPS ' pilots (marked with a P) and the solutions recorded (marked with an S) by maintenance engineers.

By the way, UPS is the only major airline that has never, ever, had an accident.

Just a little new info on happenings within the Simpkins clan in Somerset Co. Guess who's kids ride all over Mt Vernon Rd area on their ATV and mini-bikes? Well, none other than those of the county attorney, Kirk Simpkins. Guess he FORGOT they're off road vehicles and, according to the Maryland DMV, are not allowed on county and/or state roads.

Then there's the county commissioner, Rex. He inherited his mom's house.
From the water, it really stands out - now. Bet he didn't get a permit to take down all those waterfront trees! He had Ronnie Haymaker take them down and grind out the stumps. Probably doesn't know you need special permits on waterfront trees.

Ambulance Involved In Rehoboth Beach Crash

Rehoboth Beach – The Delaware State Police are investigating a crash that involved a Rehoboth Beach Volunteer Fire Company Ambulance. Troopers were called to the two vehicle crash at 6:23 pm on Coastal Highway (SR1) at John J Williams Highway (SR24).

Investigators learned that a 2004 Ford Ambulance, operated by Teri Overstreet, 22 of Harbeson, was traveling northbound on Coastal Hwy. The ambulance approached the intersection of SR 24 and was preparing to turn left to go westbound. The ambulance slowed down due to a red left- turn traffic signal and waited for southbound traffic to stop.

The ambulance, which had its emergency equipment activated, observed traffic stopped and began crossing the southbound lanes. A 2006 Chevy Impala, operated by Tonya Moore, 41 of Milton, was traveling southbound on Coastal Hwy in the right lane. She failed to yield to the ambulance and proceeded into the intersection. As a result the ambulance and Chevy collided.

Both operators and a passenger from the ambulance, Steven Humphreys, 32 of Georgetown, sustained minor injuries and were taken to Beebe Hospital. Ms. Moore was cited for Failure to Yield to an Emergency Vehicle.

All parties were wearing seatbelts and alcohol was not a factor. The ambulance was en-route to a medical assistance call and did not have any patients on board.

Salisbury Bombarded With B&E's This Weekend

Cathy's Pet Salon was broken into last night. Checks were stolen, cash and their office was torn apart looking for anything they could get their hands on.

While the Police were there taking finger prints, they received two more calls for B & E's. If you happen to have a business locally, you may want to take a ride out there and see if you too were hit.

They broke in through a back office window and remember, this New Shop is located next door to where Ted Shea was shot at the Credit Union. We told everyone it was going to get a lot worse before it got better. With the economy like it is, expect to hear more about things like this.

If YOU hear of any other business or home being broken into in the Salisbury area, let us know. I don't see many Press Releases floating around about this and I get the feeling there's more going on than we're being lead to know.

Calls for service do not tell us whether or not there was an actual break in. If you're a victim, let us know so we can spread the word.

"Hi Joe, thanks for the post. On Sunday morning I was going into my Salon to do my weeks end work and discovered that I had been broken into. We just got home at 9:02 Sunday evening. I read a few posts, I want to say THANKS to the many officers that responded to my Salon. I had several come, I kept finding other pieces of evidence or more crime. The thief actually came over a six foot stockade fence,and broke into both our buildings. The officers all responded quickly, they did a very through job, fingerprinted, and collected evidence. They were also very informative and extremely compassionate. Being with the police all day I have a better understand what they are limited to do with the lack of funds and resources they have. I think the City has their priorities confused with sending too many funds to other departments. Thanks again the the Salisbury Police Department."

Troopers Shut Down Central Kent County Burglary Ring

Dover – The Delaware State Police have arrested four persons responsible for committing 17 burglaries and 1 attempted burglary spanning from March 26 to April 30 of this year. These arrests are directly correlated to residential burglaries that have been occurring in the south Dover and Camden areas.

The arrest resulted after troopers apprehended Walker Cross Jr., 20 of Voshell’s Mill Road in Dover, on Thursday, April 30 after he was fleeing the scene of a recent burglary on Leslie Drive. Investigators discovered that Cross and three other subjects had recently burglarized the home and stashed some of the stolen property in a nearby wooded area. On Thursday at approximately 1:15 pm, the homeowner observed these subjects retrieving what appeared to be stolen property from the wooded area near his home and called 911.

Police arrived on-scene and observed the subjects fleeing on foot. After a foot pursuit, troopers apprehended Cross on Headstart lane and took him into custody without further incident. As police continued the investigation they located two additional persons that fled the area. Saron Cross, 15 of Voshell’s Mill Rd (brother of Walker Cross), and Glen Cooper, 16 of Peachtree Run were contacted at Cross’ residence and found to be in possession of numerous stolen items. Additionally, detectives identified a fourth person involved in the burglaries. Storm R. Winters, 18 of Voshell Mill Road was apprehended on Friday, May 1 after being implicated in the crimes.

As a result of the apprehensions and investigation, detectives recovered several of the stolen items, which included DVD’s, games, video game systems, prescription medications, laptop computers and jewelry. Detectives have also learned that several of the stolen video games were taken to area stores and sold by the culprits. They are continuing the investigation and expect to retrieve more of the stolen property.

Because of the investigation all persons were arrested and charged with the 17 burglaries, 1 attempted burglary, theft and conspiracy charges. Walker Cross Jr. was committed to the James T Vaughn Correctional Center in lieu of a $36, 900 secured bail. Strom R. Winters was committed the James T Vaughn Correctional Center in lieu of a $20,650 secured bail. Saron Cross was released on a $20,650 unsecured bail. Glen Cooper was released on a $19,400 unsecured bail.

Our numbers soared this week on Salisbury News as we experienced one record day after another. Certainly the Defamation Lawsuit between Barrie Tilghman and Blogger Joe Albero didn't hurt matters, that's for sure.

The really cool part about getting in new visitors is when you recognize the numbers continue to increase days and weeks later. I thank all of you for visiting and I especially want to thank those of you who continue to go to Blognetnews and rate our Site.

It's not a matter of being #1 all the time. What I feel is most important is that everyone around the State realizes something must be going on out here if were constantly in the #1 or Top 10 position. One Of Three Salisbury Officers Suspended Turns in His Resignation

One of the Salisbury Police Officers who was recently suspended, (out of 3) thought about what had been done and simply said, screw this, I'm out of here.

I have said it for years, Webster Sucks as Police Chief and Mayor Ireton needs to get him the heck out of there before he forces everyone out of there out of spite. Perhaps Webster sees the writing on the wall and is putting additional pressure on Ireton because Ireton refused to jump when the Chiefy said jump.

Look at me for example, I refused to jump too and the man is done just about everything possible to have me arrested. Jim, get this guy out of there before it's too late and others take a walk as well. I'm not kidding around either, this is very serious stuff. The Citizens are NOT being protected and when the Officers start bailing like they have most recently, Webster is proving he cannot lead and he needs to be fired.

Ehrlich Lecture

Former Maryland Governor Robert L. Ehrlich Jr. speaks on “The 12Principles that Bind” 4:30 p.m. Tuesday, May 5, in the Great Hall of Holloway Hall.

Ehrlich’s visit to SU is sponsored by the College Republicans and the Institute for Public Affairs and Civic Engagement(PACE). "On behalf of SU’s College Republicans, we are honored to have someone of Governor Ehrlich’s stature speak to the SU community,” said Matt Teffeau, vice president of the College Republicans. “I am personally inspired by former Governor Ehrlich’s achievements and leadership during and after his time in office.”Ehrlich is currently a partner at the law firm Womble Carlyle Sandridge& Rice PLLC in Baltimore. Having served as Maryland’s Governor, a U.S. Congressman, a state legislator and a civic litigator, Ehrlich now counsels clients on government matters, with expertise in health care,finance and economic development. "We are delighted that former Governor Ehrlich is back on the SU campus speaking to our students,” said President Janet Dudley-Eshbach. “We appreciate his efforts on behalf of higher education in the state of Maryland.

SU’s new Teacher Education and Technology Center became a reality, thanks to his support.” During his last visit to SU in 2006, Ehrlich held a regional cabinet meeting honoring citizens and organizations for their contributions to Maryland. In 2002, Ehrlich became Maryland’s first Republican governor elected to office in 36 years. When he was governor, Maryland experienced a growth of new private sector jobs and enacted policies that positioned Maryland as a national leader in education, biotechnology, health care and minority business advancement.

Ehrlich doubled funding for need-based college scholarships, which helped college enrollment reach an all-time high. Ehrlich has received numerous awards, including “Legislator of the Year” from the Maryland States’ Attorneys Association and “Governor of the Year” from the National Multiple Sclerosis Society. During his time in office,Ehrlich created the nation’s first cabinet-level Department of Disabilities, for which he earned the “Highest Recognition Award”from the U.S. Secretary of Health and Human Services.

Ehrlich serves on numerous boards, including Dunbar Armored, the Maryland Public Policy Institute, the Mentoring Partnership and Thanks USA. In 2003, he was appointed by President George W. Bush to the National Infrastructure Advisory Council. He is also a special advisor to the board at Bay National Bank. Admission to his talk is free and the public is invited.

Flying Tiger Attacks Imminent

With warm weather and plenty of rain in our forecasts, look forward to a bumper crop of these annoying and potentially dangerous critters this spring and summer. Hiding mainly in the shade of foliage and coming out to feed on nearby warm-blooded targets, mosquitoes are the carriers of a wide range of life-threatening diseases, including malaria, varieties of viral encephalitis (West Nile, Eastern Equine, La Crosse, etc.), Yellow Fever, Dengue Fever and canine heartworm, which, while previously thought to affect only dogs, has rarely been seen in humans in the last decade.

Even though our local government periodically sprays for mosquitoes during the summer months, they remain a problem, as our area is rife with breeding grounds, both natural and artificial. Standing water is pretty much the only thing that mosquitoes need to breed (other than a willing mate and nourishment), and it doesn't take much of it - just a few ounces of the undisturbed liquid - to provide a nursery for hundreds if not thousands of the biters. Backyard buckets, undrained flowerpots, clogged roof gutters, folds in tarps, old tires, plastic cups and bottles and almost anything that will hold water for the short matter of days it takes for eggs to be laid, wrigglers to wriggle and adult mosquitoes to emerge will do. What to do about it? Simple backyard, barnyard and business site prevention measures are key in keeping the mosquito population down. Empty the water-holding buckets and pots and store them upside down, clean leaves and other debris from roof gutters. Dispose of used tires or cover them with plastic or take them indoors for storage. Pick up and dispose of trash, like cups and bottles. Anything to eliminate standing water wherever it is will give mosquitoes one less place to call home.

A useful reminder: The Wicomico County Landfill has free consumer (no businesses) tire disposal on Saturday, May 9th. Amazingly enough, Worcester County sponsors a tire amnesty day on the same May 9th at the Worcester County Central Landfill. Well, maybe not so amazing, as the State of Maryland is promoting these throughout the state as part of a program to reduce cast-off tire numbers and to decrease mosquito infestation.

Two Years Ago Today

Two years ago today you could find signs like this posted in Salisbury. Today, they're all gone. Well, the signs might still be up but the Sub Stations are history thanks to Barrie Tilghman and Chiefy Webster.

I could see if they had more Officers on Bike Patrol but we all know that's not the case. Heck, as slim as they're getting with Officers on the beat, they don't even have a rush to put lights on brand new vehicles sitting in their parking lot because they don't have enough Officers to drive them all.

CRIME, almost 4 times higher than the National Average. You need to GO Chiefy!
