The official who was briefed on the matter says a police check of the weapon's serial number shows it belonged to a federal agent. The official was not authorized to speak publicly about the case and spoke on condition of anonymity. The official declined to elaborate further.

1. He had been deported he chose to return illegally AGAIN!
2. He chose to pick up a t-shirt wrapped around a gun that did not belong to him.
3. He chose to fire the gun.
4. Now he goes to jail for murder and eventual deportation when time is served.

This was a set up by the Obama administration to make the Republicans look bad for not supporting Obama with the so called immigration control.. Blaming republicans for gun control.
