Justices, Citing Ban on Unreasonable Searches, Limit Use of Drug-Sniffing Dogs

WASHINGTON — The Supreme Court on Tuesday limited the ability of the police to use drug-sniffing dogs outside homes.

The case concerned Franky, a chocolate Labrador retriever who detected the smell of marijuana outside a Florida house used by Joelis Jardines. Based on Franky’s signal, the police obtained a warrant to search the house, and they found a marijuana-growing operation inside.

Mr. Jardines moved to suppress the evidence, saying that using Franky to sniff around his residence was an unreasonable search barred by the Fourth Amendment. The Florida Supreme Court agreed, and so did a majority of the United States Supreme Court.

It's a damn shame that our courts are continually having to tell law enforcement and governments of the 'Police States of America' that there's a Constitution they have to abide by.

Well poster 10:56 AM...

The cops and the rest are testing waters, they are doing things unorthodox and un reasnable becaue ti helps them get at you for any number of reasons...

If you do not test them back or stand up and fight or take it to court for the supreme coutrs to rule then the cops and the rest like the cops will contuue to push the envolpue to see what they can and cant do... When no one stands up and fights, they assume it is on and after a while it will be come OK and become the norm as they say...

That's why it is imperative to stand up and fight no matter what... sometimes it works and sometimes it does not, however, nonetheless your still a slave when you allow them to do so, and I prefer to fight all the way down...

Just like the NY sugar ban and stuff... people were going to let it slide for the sake of arguments and hassles and such and look what happened, someone stood up and fought and they found it to be unconstitutional.... with that we can move forward and stop all the other unconstitutional stuff...

One day you wake up and your neck deep in Communism with the Government completely inside your personal space.
Police are pushing the envelope with their B.S. excuses for searches.
Obviously they don't care about the Constitution or the courts.

Now we all have to have tacky "no trespassing" signs up to prevent this, as if the 4th A doesn't already presuppose this. A real shame.
