Rape Victim Sues Ocean City Nightclub

A federal civil trial has begun in which a 26-year-old woman is suing the manager and employees of the popular Ocean City nightclub Seacrets for $1 million, claiming she was raped after club security tossed her out and left her on a bench near a parking lot without her belongings.

The incident happened during the 2008 Memorial Day holiday weekend. The victim, who isn't being identified, said she's hoping a jury will help define how far a club's security should extend.

"It's an interesting case because the jury has a tough decision to make," said attorney Alex Brown, a liability expert.

was she drunk and why didnt her friends go help her

Good for her. Apparently the woman was intoxicated to the point she was thrown out of the bar. I would think they have a responsibility to ensure she is at the minimum "SAFE". I'm sure she was obnoxious as most drunks are, however, not letting her get her belongings or letting her friends know is gross neglegence on their part. I hope she wins big!

Isn't there a law in Maryland that if you are visibly intoxicated you are supposed to be cut OFF by the bartender.unreal.

This happened in 2008? Why did she wait so long to file?

its not Secrets fault she crossed the line from having a good time to being a nuisance to the point that she needed to be tossed out. perhaps she'll make better life choices now, including getting new friends who look out for you.

Hey 1229 so if i seen you bleeding and unconscious on the street should i just step over you and ignore you and mind my business or call an ambulance for you ???

I'm not going to judge without hearing all of the facts. That's for a jury. However, it's not Seacrets job to be her security team when she is out of control.

I can see Seacret's not being liable had she walked out on her own accord. Throwing her out because she was intoxicated takes this to a whole new level of responsibility.
What she coulda done shoulda done plays no role. She was made into a "sitting duck" by Seacrets is all that matters, who obviously by their actions of ejecting her, knew she was drunk and therefore it doensn't take much of a leap to say vulnerable.

To All:

We realized we had TWO posts up about this subject and a contributor decided to take one down. We put it back up because it had 8 comments on it we felt every one should see.

Sorry for any inconvenience and yes, there are now TWO posts up about this topic.

Yes, leave both of them up Joe, because I can guarantee that lawyers for both sides are going over any and all that relates to this case to gage public opinion
and quite possibly change their strategy according to the way "the wind is blowing."
BTW-There was so much going on internet wise during the Casey Anthony trial Jose Baez has voluteer law students monitoring what people were saying in the blogesphere and reporting to defense team.

She left and came back folks.she could have say right there out side and waited.as long as she isn't a pain waiting.if she was then security would just call the police.she left period.her fault.anyones fault for getting that drink.

I think someone should look into what everyone knows about the drinks there being drugged. Girls get drinks, bartenders drug them for certain customer and the rest is history. Girls becareful, this just happened a month agoto a friend of mine.

Not knowing the facts...or circumstances involved in the event no one is qualified to pass judgement. However, "2008 Memorial Day holiday" says it all for me. A fishing trip gone bad.

I feel so sorry for the young woman that had to go through this experience. I was not there but I think it ill advised to put a lone young woman on the street in that part of Ocean City. Ocean City is not the "family resort" anymore. It is a dangerous place after dark just like any city and the locals know this best. I grew up in this area and I know that there was a time she may have been safe but in this day and time...not a chance...and a local would know that.

Layton has insurance, and if he paid this out of his pocket it would not phase him or his bank account. His bouncers generally are way out of line, but then they have the town and the police dept in their pocket, the drunk person is usually arrested and found guilty. so they have no recourse against being thrown out on their head or the injuries they get when they are beat up.

5:04 I agree and it's a shame that OC has turned into a dangerous place over the past 2 decades after being an enjoyable resort for families to vacation.
It has become an out-of-control wild party town filled with criminal-minded and unruly drunks.
Beautiful view, horrendous crowd.

A woman who becomes so intoxicated to get thrown out of the bar is a woman who so intoxicated to get thrown out of a bar. This rule also applies to men, and is practiced by several bars across the nation! I could probably say ALL here, but I have been to a few that don't adhere, but Seacrets is not a candidate here.

An open hole is an open hole. Don't open your hole, there are a$$h_les out there to take advantage.

The bottom line is the only person who is going to look out for you is you. If you cant be responsible and maintain self awareness then you shouldnt drink. We get called to bars, bus stops, the beach, alleys and private residences for people who either drink themselves til they pass out leaving themselves open to be taken advantage of or they mouth off to the wrong person and get clocked. Did anyone force them to get that drunk? No! And in the case of minors then the parents are to blame. C'mon people, wake up and take responsibility for your own behavior!

I believe we could resolve all our economic problems by putting a road block on both sides of Coastal Highway
by Seacrets!
