Sussex Council Denies Request For Apartments


GEORGETOWN — Five Sussex County families face eviction from an illegal apartment complex following a decision Jan. 17 by Sussex County Council.
Council voted 5-0 to deny an application for a conditional use filed by John and Nicole Scott to allow for multifamily housing in an AR-1 zoning district, which is not permitted under county code.
The developer of the apartments along Airport Road southwest of Laurel did not apply for a building permit, receive a certificate of occupancy or have an inspection. The property was formerly a single-family home.
In addition, Lawrence Lank, director of county planning and zoning, said the owner did not appear to have the proper septic system in place for a multifamily complex. No approval letter is on file from the Department of Natural Resources and Environmental Control. Lank said there is no indication of the current sand mound system's capacity; it was designed for a single-family structure. The parcel is also included in the Sussex County landfill-Laurel groundwater management zone with strict regulations placed on land and groundwater use.
