On February 18, 2009 at approximately 4:00 p.m., officers from the Fruitland Police Department responded to a call from Loss Prevention of the Fruitland WalMart regarding a shoplifter who had just fled from the store with loss prevention personnel in pursuit. While enroute, the officers were advised that the suspect had entered the Texas Roadhouse Restaurant’s main entrance. The hostess on duty advised the officers that the man they were looking for just ran into the men’s restroom. As the officers approached the restroom, the suspect exited the restroom. He was short of breath and sweating. He was identified by the WalMart loss prevention personnel, who were on the scene, as being the same subject they had pursued. He was taken into custody and identified from his Massachusetts driver’s license as Nathaniel O Taylor.
The facts leading to the charges are that loss prevention personnel observed Taylor take property belonging to WalMart from the electronic department and walk to the automotive section where he opened the packaging and placed the items in his pocket. Taylor then walked toward the front of the store where he dropped the packaging in the domestic department behind some dishes. Taylor then continued toward the front of the store and exited through the grocery exit, passing all points of sale. Loss prevention personnel caught up to Taylor outside the store, identified himself as being from loss prevention at which time Taylor shoved him. Loss prevention personnel attempted to detain Taylor by grabbing his jacket at which time Taylor pinched him and struck him in the face breaking his glasses. Taylor then pulled free and ran toward the Texas Roadhouse Restaurant. The property taken was recovered but was not resalable.
