Incident: Possession of a Handgun
Date of Incident: 7 January 2009
Location: U.S. 13 N/B at Parker Road, Salisbury, MD
Suspects:
1. Scherick Macell Forde, 27, Hartsville, SC
2. Charles Bernard Byrd, 28, Hartsville, SC
Narrative: On 7 January2009 at 10:15 AM, a deputy from the Wicomico County Sheriff’s Office Aggressive Criminal Enforcement Team stopped a Chevrolet Uplander operated by Scherick Ford for exceeding the posted speed limit. Upon making contact with Ford and his passenger, Charles Byrd, the deputy discovered clear indicators of criminal activity. During the course of the traffic stop, the deputy developed probable cause to search the vehicle. During that search, the deputy located a revolver and two semi-automatic handguns inside the passenger compartment. All three handguns were loaded. Both Forde and Byrd were placed under arrest.
Further investigation revealed that one of the semi-automatic handguns was reported stolen during a burglary in South Carolina. The deputy also discovered that both Forde and Byrd were prohibited from possessing firearms due to previous criminal convictions.
Forde and Byrd were transported to the Central Booking Unit where they were processed and taken in front of the District Court Commissioner. Disposition from the Commissioner is unavailable.

Wear / Carry a handgun on person
Wear/ Carry/ Transport a handgun in a vehicle
Possession of a regulated firearm by a prohibited person
Possession of a regulated firearm by a convicted felon
Possession of a Stolen Handgun

We need to support the idea that funds and property seized by the Sheriff's Office should be used by the Sheriff's Office to obtain the best equipment and training available to keep our deputies safe and to make sure that they have everything they need to keep our communities safe. Ask your Councilman where it goes. It goes into the general fund to be spent on who knows what. Any property lawfully seized by law enforcement should stay with law enforcement to fight crime.
Probable cause was developed ? Now it is good that a couple of criminals were apprehended but how is probable cause developed ?
I wonder if they were really speeding at all or did the deputy just pick a out of state vehicle and pull them over ? I feel this is a serious question that should be asked. Are the boys in brown becoming above the law and bending the rights of people by making illegal searches of vehicles and hoping to fall into a crime ?
It reminds me of all them check points where a officer detected a faint aroma of "pot". And then proceded to do a illegal seach and siezor. Food for thought. Thats all.
The "aroma" of marijuana is probable cause for a warrantless search under "the Carroll Doctrine". (Carroll v U.S. 1925)

In the case of many traffic stops, probable cause is developed when the totality of the circumstances indicate that there is probable cause. This could be any combination of things including court accepted criminal indicators. At that point "Carroll" gives them the right to conduct a warrantless search due to the fact that the vehicle is readily mobile.
Probable cause = that amount of evidence necessary to convince a reasonable and impartial person to believe that a crime has been or is being committed and that the people to be arrested or search has or is committing that crime.
Think about it. You walk up to a car and the passengers open the window. The odor of burning marijuana comes rolling out from inside. What do you think.
Now you stop a car for speeding. The driver has no license with him but gives his name and date of birth. He states he was going to New Jersey to visit his mother and that the passenger is his cousin. You then question the passenger who states that he is the drivers neighbor and friend and that they are on their way to New York to visit some girls they met on line for a few days. They have no luggage. You issue the driver a warning for speed and he signs a name that is different than that which he gave you only moments ago. As you question the driver, you notice that small beads of sweat are beginning to form on his forehead and that the carotid pulse in his neck is becoming visible.

Its really a comforting feeling to know we have so many druggies passing through town - or living right here in Salisbury. I keep my car doors locked at all times anymore even when just getting into my car at night, or walking out of my office after dark - its like I have to take my life in my own hands to just walk out the door anymore! Pretty scary!!!!

How would you feel if these thugs had killed one of your loved ones because the officer did not have what you define as solid probable cause? Were you there to witness this alleged breach of these pitiful peoples rights? Until you are you have no right to question the instincts of an officer. I personally am a strong believer in personal rights but those rights do not include possesing unpermitted loaded handguns in your vehicle especially when you have a felony conviction.
Open your eyes. It has become a dangerous world. If the police did not do their job you would probably be the first one to whine.

Follow the money, check cell phone #'s. Both carrying loaded firearms with each having restrictions is a felony in itself. Good Job getting more guns out of the hands of criminals. Now look for the kingpin in those cell phone records.
