Three Bases of Criminal Liability:
Conduct Prejudicial to Good Order and Discipline.
Conduct of a Nature to Bring Discredit upon the Armed Forces.
Conduct Constituting a Non-capital Crime.
Offenses Listed in MCM, pt. IV, 61-113:
Require proof of prejudice to good order and discipline or tendency to bring discreditupon the armed forces.
This list is nonexhaustive. Other novel offenses may be charged, provided the alleged misconduct satisfies the standard in one of the three clauses of Article 134 and the misconduct cannot be prosecuted under another article of the UCMJ.
Another Dreamer?
Conduct Unbecoming an Officer. Break him down in rank, throw him in the brig, dishonorable discharge, make him pay back the cost of his education.
Wherever he is, I hope that they've held at least one blanket party in his honor.
