Former California Prosecutor, Defense Attorney Files Complaint Against Mosby

A retired California prosecutor and defense attorney says he's so outraged by the actions of Baltimore State's Attorney Marilyn Mosby that he filed a grievance from the other side of the country.

The filing from Martin C. Brhel Jr. is the second such complaint against Mosby for her handling of the trials in the death of Freddie Gray. Brhel said he has no connection to Baltimore or Maryland.

"The only indirect contact I have with it other than the fact that I have friends that live in Maryland is the fact that as a retired prosecutor, I am highly offended at the way Ms. Mosby, in my humble opinion... is persecuting six innocent police officers."

He said a prosecutor has an ethical duty to only file cases where probable cause exists, and where they honestly believe they can convince a jury to convict. He said the answer to both questions for all six Baltimore officers charged in Gray's death is no.

Mosby looks like one of Beyonces dancers in her black panther routine….. Angry revolution, get whitey, pay us back for slavery, power to the people kind of radical.

She is in a lose / lose position. Looking at what she is facing, she is truly in a quandary…

Rice is charged identically, based on the Charging Document, as was Goodson, less the “depraved heart” murder charge. It is evident that Rice cannot be found guilty of manslaughter based on the ruling Williams gave regarding manslaughter in the Goodson case. Rice did not have any controlling responsibility over Gray once Gray was placed in the van for transport. That one is a no – brainer. Goodson’s acquital eliminates that charge as having any reasonable chance of success.

Removing the manslaughter charge, Rice is now left with that exact charges that Nero was acquitted of. Slight variation due to supervisory role verses subordinate role. But again, it will fall back to who was the arresting Officer., again it was Miller. Rice’s role is primarily instituting the Terry stop.

It has been acknowledged by the Prosecution to have been properly applied, the illegality of the knife has been withdrawn, Judge Williams has acknowledged that Gray was indeed combative & resisting. So based on the evidence presented to date in the preceding trials regarding “assault” & “misconduct”, where does Judge Williams go with this case?

Unless something new in the way of evidence emerges, the Prosecution’s presentation is a rehash of the Nero trial & points to yet another acquittal. Mosby should cut her losses & dismiss these charges now. If not, she faces yet another loss & another negative aspect against her in any Civil case.

She is again forced to rely on the weak position of the seat belt issue & the theory of medical attention not being provided. The seat belt issue has become a non-issue in the eyes of Judge Williams. The rationale for immediate need for medical attention was also debunked by Williams in the Goodson trial as the Prosecution could not prove when, in their theory, medical attention as indeed required.

Goodson, who had the majority of control over Gray from the point he was placed in the van, was found not guilty of any action that contributed to Gray’s injury. How then can the Prosecution possibly assign that responsibility to Rice?

They may have a shot of mis-conduct as Rice was the supervisor in charge during the incident & did instruct some of the officers as to their actions. But when looked at in totality, his actions were well within the range of being reasonable given the circumstances.

They will need something new regarding evidence & it better be something that was provided in discovery or there is going to be one pissed off Judge…..

So his efforts are all for naught.
