With just over a month to go before the first trial is scheduled to begin, three of the six officers accused in the death of Freddie Gray are seeking to have one of the charges against them dismissed.
Officer William Porter, Sgt. Alicia White and Lt. Brian Rice all are seeking to get second degree assault charges dropped.
Attorneys for the three officers are asking Judge Barry Williams hold a hearing on this motion.
In identical motions, their attorneys argue that the charges are based on the officers' to put Gray in a seat belt in the police transport van which they argue is not a crime.
The state argues the assault is based on Gray's injuries were the result of the officers' "gross negligence."

I do believe they will all be aquitted as they should be. Freddie Gray was a thug and his behavior was what killed him
He was handcuffed and unable to put on his own seat belt. Passengers are required by law to wear seat belts, or the driver is fined. So, it is a fact that the driver of the paddy wagon is guilty of failure to belt the prisoner in.
