Mayor Jim Ireton, You're Full Of Sh!t

"One legal opinion that has been filed is that of the Supreme Court, so I don't know if any independent decision from my office changes things", said Jim Ireton


Let's see the legal opinion cited by the Mayor that sets the precedent, not only for the City of Salisbury but apparently the rest of the Country.


SBYNews will donate $500 to the charity of choice to the first person, including the Mayor, who can provide the citation of a Supreme Court decision that stands for the specific proposition that Saturday is a weekday.

SBYNews will DOUBLE the amount IF the citation comes directly from Mayor Jim Ireton.

Bottom line the mayor is lying. Should come as no surprise, it's the only thing democrats excel at.
Weekdays are Mon-Fri, the weekend Sat-Sun. You need look no further than court ordered child visitations i.e. non custodial parent gets child on "weekends." meaning at the very minimum Sat. and Sun.
The mayor is a half asses half wit and since he "loves" reading this blog I'm going to clue him in as well as the rest of the silly council and the city attorney.
There is ZERO ambiguity. If construction were permitted on Saturdays, carte blanche without special permitting, it would be spelled out in the city code, or let's say it would be, if competent thorough people were at the helm.
It would read something along the lines of: construction only permitted on weekdays such and such a time AND on Saturdays from such and such a time.
The mayor and council need to do the right thing. Either put a halt to the weekend construction or amend the code. It's really about time some leadership is shown.
You all seriously look like a bunch of idiots grasping at straws trying to come up with reasons why Saturday is a weekday.

This is the only Supreme Court case they should be looking at.
There is a standard rule of legal interpretation, from Supreme Court case TRW Inc. v. Andrews, 122 S. Ct. 441 (2001), among others, that states:

"It is a cardinal principle of statutory construction that a statute ought, upon the whole, to be so construed that, if it can be prevented, no clause, sentence, or word should be superfluous, void, or insignificant."

If ANY interpretation of the word weekday were to include Saturdays as well, then that would make the insertion of the work "weekday" into the statute superfluous. As such, the Court would interpret the word "weekday" to have the meaning of Monday-Friday.

Generally a weekend runs from Friday evening till Monday morning. In the context of child custody and visitation the duration and frequency of weekend visitation may vary according to child custody agreements or court orders.

I heard them firing up the equipment @ 0636 this morning from a few blocks away. Perhaps the town has another interpretation of 7 A.M.

The city attorney probably mentioned it to him and he's a decent guy and a good attorney.

I think your BETTER bet would be a $500 gift to the charity of the choice of the person who comes forward and proves their work was stopped on a weekend BECAUSE it was a Saturday or Sunday (not because they were trying to do illegal work to an historic building or something-I remember you had a post about that).

Towjam makes a good point. Why insert "weekday" if it can be done on any day of the week? Because Sunday is the only one that's an exception? In that case, make sure the person proves the work was stopped on a Saturday.

I'm really surprised at the lawyer's response. In the US as in most Western countries, the workweek which is synonymous with weekday, is always recognized as Monday thru Friday.
The weekend is the time period including Saturday and Sunday. This is not open to any sort of interpretation.
Ireton thinks he's a big shot throwing out the Supreme Court.
Okay Ireton show everyone what you are made of. Put your money where your mouth is and make known this elusive ruling.
You won't though because all you've done is written a check your ass can't cash. Typical lying democrat.

Vary as in; "From after school on Friday until 6pm Sunday."
Weekend can be expanded upon but does not ever NOT include Saturdays.
