MARYLAND STATE CONFERENCE OF NAACP BRANCHES

RESOLUTION SEEKING AN INDEPENDENT INVESTIGATION BY THE US DEPARTMENT OF JUSTICE OF THE FATAL SHOOTING OF AN AFRICAN AMERICAN MALE IN WICOMICO COUNTY, MARYLAND

WHEREAS, The National Association for the Advancement of Colored People (NAACP) has long sought the end of any acts of police brutality;

WHEREAS, NAACP and its branches across the country have continually protested against police misconduct and use of excessive force by law enforcement officers;

WHEREAS, on or about March 18, 2014 an African American male was fatally shot by two Maryland State Troopers at their barracks in Wicomico County, Maryland;

WHEREAS, the Maryland State Troopers have only been subjected to an internal investigation of the fatal shooting of Winfield Fisher, III;

WHEREAS, the Wicomico County NAACP seeks an external and comprehensive investigation of this fatal shooting and the circumstances causing this death;

THEREFORE BE IT RESOLVED: that the Maryland State Conference of NAACP Branches in support of the Wicomico county NAACP hereby requests an external investigation to the fatal shooting in Wicomico County. That copies of this Resolution be directed to the US Department of Justice, US Senators Barbara Mikulski and Benjamin Cardin forthwith.

Adopted this 25th day of 2014 at its 74th Annual conference.

I may be incorrect, but I thought the State's Attorney's office did an investigation as well.

Whereas Fisher showed up smoking dope and tried to run over an officer. Whereas Fisher had a weapon called a car. Whereas Fisher was either stupid or stoned or perhaps both.

The recent shootings and deaths resulting from police actions are tragic. However, if we boil them all back to basics, if the individuals had just done what the police officers had told them to do, they all would be alive today. How difficult is it to move to the sidewalk, or show your hands without reaching to your waistband, or stop when ordered to do so. If I remember correctly, Mr. Fisher was dragging a police officer down the highway when he was shot.

I guess if he hadn't showed up to the barrack smelling like pot they wouldn't have had a reason to try and search his vehicle. Then he dragged the officer with his car which is assault! I am tired of hearing this crap all the time about its always white people putting down a black person, well maybe if they didn't act like a bunch of animals that think they can get away with everything just because of the color of their skin the cops wouldn't bother them! It's just like schools having more black students suspended than whites, well you know what that tells me that the black kids are bad! This is BS...that's why 9 out 10 people are welfare and assistance are black, I guess it's all us white folks fault for you being lazy!! I work 3 jobs to make ends meat and feed my family, most of their jobs are standing in line at the welfare office!!

""This office has determined that probable cause of course does not exist to charge either Cpl. Myers or Trooper Wilkins. They have committed no wrong doing or crime as a result of the actions that they took," said Wicomico County State's Attorney, Matt Maciarello."

I take offense as should everyone else that they are trying to defame and are discrediting the integrity of Matt Maciarello.
He has more integrity then all of them combined.
If they don't trust him, then they should have put someone up to run against him. How dare them!

Why people see this as race thing boggles the mind.the simple fact is almost two times more whites are killed by police officers then blacks. People who are using race in conjunction with what's going on whether your white or black, Mexican or what ever are just ignorant to what's really going on.

Let me just ask this. why is it that every branch of government in this country has checks and balances yet when it comes to a police officer being accused of a crime more often then not they are simply investigated by someone that works in the same barracks as the officer in question? What's wrong with someone from the outside investigating an officer in question? It's a proven fact that in the past in this country we have had dirty cops. Hell in NY in the 80s two cops where arrested and found guilty for doing hits for the mob while on the job. It's a fact every police officer out there can't be trusted. Now I'm not saying every officer out there is dirty most are honest and do care for your rights as an american but, our own history proves we have had some dirty cops in the mist. So why wouldn't you want an outside entity to investigate a claim made against an officer instead of someone he may know and who knows might even be best friends with? This alone would solve a lot of the issues and distrust the public have against police in general .

This is not about race. it's about the general public having distrust with police in general. I like most people in this country am sick of seeing blacks screaming this is all about race while using some thug and holding him on a pedestal like he was a saint. But you know this is the United States Of America and the last time I looked even criminals have rights and deserve the right to have proper investigation.

I was going to ask the same thing. I think it is more real than that online college that Rick Hoppes got his fake degree. Heck people that get degrees from their are more qualified to run the city than Tom Stevenson is.

9:03, The justice dept statutory authority limits them to enforcing federal laws only. There is not indication any fed laws were broken in this case.
What the NAACP is saying is that a civil rights violation has taken place in other words the man was shot because he was black.
How Ashanti and the others can live with themselves (or even how their families can live with them) is unbelievable.

I can't remember the details but wasn't Winfield Fisher high on marijuana. I ask because after it became known that Michael Brown was high (2x the legal limit in states where it's legal) I asked a friend who is an ER doctor about this. She works in a big city hospital and see patients of all socio-economic levels. Several colleges in her area so students come in.
She said they are slammed on the weekends with kids high on pot, who get in fights and do other stupid things and get injured.
So I asked-I thought pot made you mellow. She said not the new kind the kids smoke. It's coming from the West coast and if you smoke one or 2 hits, you mellow out, but anymore and you can compare it to the "beer muscle" effect that happens when someone drinks too much.
This would explain both Winfield Fishers irrational actions and Michael Browns.

The DOJ does it all the time. They investigate whole dept's and what they find is horrific.

Again, you don't have to take my word for it, everything I say can be found on the internet. I am one of the few that actually researches the facts BEFORE I type a comment.

Go find out what the DOJ found out about Cleveland OH. Or Alberquce New Mexico. Or in Oregon. Or Seattle Wash. Or Detroit MI. Or any others I have forgotten.

Unless you really don't care what kops do since they have such a tough, tough job.

No one said the DOJ doesn't ever investigate PD's only that it's unwarranted in this particular instance: i.e. "such as this one."

I happened to do a bit of research myself. Seems like this investigating of PD's by the DOJ is a new trend. Coincides with Holder's appointment. The Obama admin's been known to overstep their reach, but we'll just ignore that fact.
Another thing I noticed is that no one was charged in these investigations, because the state's handled any criminal actions against the department's members prior to the DOJ getting involved.

I smoke twenty dollar per gram marijuana everyday. There is no incitement to violence. Typical marijuana is five per gram.

I've knew Winfield since I was in my late teens and I'm 35. He was a good guy. Not a thug at all.

Those two statements are facts.

Trying to demonize after the fact a person for anything to do with marijuana is obtuse. You aren't convincing African Americans he deserved to die, nor are you convincing white Americans such as myself that he was a maniac.

Posers like yourself really bore me. I don't know where you do your 'research' but you really should consider upgrading your sources besides letters to an editor and such.

I have took the time to include such things as have happened recently and outcome. I'm not sure what you mean by being a recent trend of DOJ to investigate pd's. Maybe you meant it is recent because you have recently heard of it?

Regardless, you nor I have the authority to decide which case is warranted for review and which is not so I won't even address your erroneous claim in that regard.

I would also inform you that the DOJ investigates pd's at both criminal and civil levels, each independent of each other.

As a result of the federal investigation in Cleveland, the city has agreed to work toward a settlement with the Justice Department, known as a consent decree, that will overhaul practices, tighten policies on the use of force and subject the police to oversight by an independent monitor. Consent decrees in other cities, including Albuquerque, Detroit, New Orleans and Seattle, were put into effect after investigations into questionable police violence and other abusive practices
In Mr. Holder’s first five years in office, the Justice Department opened 20 civil rights investigations into police departments, more than twice the number in the five years before.

That shooting happened after the police apparently mistook backfire from a speeding car for gunfire and began a 20-mile chase that eventually grew to include 62 patrol cars. It ended when officers fired 137 rounds at close range at the car after it pulled into a middle-school parking lot, killing both occupants. The incident was described by the state attorney general, Mike DeWine, a Republican, as a “systemic failure in the Cleveland Police Department.”
This year, one officer was indicted on a charge of manslaughter in the shooting and five supervisors were charged with criminal dereliction of duty.
