Attorney: Man Was Acting In Self-Defense When He Killed Sheriff's Deputy

A man accused in last week's shooting death of a Burleson County sheriff's deputy mistook the officer coming through his front door as an intruder, according to his lawyer.

Henry Goedrich Magee, 28, was charged with capital murder after authorities said he shot Sgt. Adam Sowders as he led an eight-man team into Magee's trailer near Somerville just before 6 a.m. Thursday.

Houston attorney Dick DeGuerin said Magee and his girlfriend, who is five months pregnant with Magee's baby, were asleep in the living room of the trailer home when they were awakened by "explosives" going off near the front windows and loud pounding on the front door.

Moments later, Magee saw a person whom he said he couldn't identify in the dark burst through his door, DeGuerin said, adding that Magee -- who has a felony and misdemeanor drug conviction -- believed the man rushing in was an intruder and he needed to defend himself.

Magee grabbed a rifle leaning against his bedroom door frame and fired, striking and killing 31-year-old Sowders, DeGuerin said.

Burleson County is hicksville with a population of 17,000.
Looks like the cop set it up more as a grudge match than actually having any suitable evidence.
I have said before and will say again. Cops assume that when they break down my door and I am awakened I am going to comply? I don't think so.
It is also stated, he had guns and would use them... well duh, guess you should have knocked and introduced your self first.
I am sorry someone died, but logically and tactically this was a disaster from the start.
All for a couple of maryjane plants.

So 8 police officers following the deceased deputy did nothing. That scum bag should have been riddled with bullet holes.

The 8 cops following the deputy were too busy running over each other to get out of that doorway to shoot anyone (its a wonder
they didn't start shooting each other).
I'm always surprised to hear the police are upset that someone shot at them because they (the police) kicked someone's door in at 4AM. THEY come in, ready to kill ANYTHING moving. Its macho, that's for sure, but stupid as a bag of rocks. Who shoots ONE ROUND at a bunch of men running into your house at 4AM? I'm gonna fire until the moaning and crying stops. But in this case, it was likely one man running IN. EIGHT running like hell OUT of there. You know, brave and all that.

I fault law enforcement and the judicial system here. For, I'm certain this judge, Reva Towslee Corbett, was fed a string of BS as long as a trot-line and she, like a carp, swallowed all of it. And the cops.., the cops wanted to break in w/o announcement.., on an effing marijuana grow, in a GD trailer??? Sounds like an episode straight out of "Trailer Park Boys" with Jim Lahey leading a squad of Randy's.
They got just what they deserved.
Other then that, certainly a case of self defense and a justifiable homicide.

Why not just come out when everyone is awake, and knock on the door and identify yourself and the purpose of your visit?

Or has that procedure become back burner material?

Bust in my door in the middle of the night, you will be met harshly.

Yup... they won't make it over my threshold before they are sucking air through their vest. Yes it's that powerful and will be used without mercy if they break the law refusing to uphold the constitution and come through my door without an invitation.
I have lost all patience with what has become a very poor excuse for Law Enforcement officers. They are mindless idiots.
