COLUMBUS, Ohio (AP) -- Condemned killer Steven Smith's argument for mercy isn't an easy one. Smith acknowledges he intended to rape his girlfriend's 6-month-old daughter but says he never intended to kill the baby.
The girl, Autumn Carter, of Mansfield, died because Smith was too drunk to realize his assault was killing the child, Smith's attorneys argued in court filings with the Ohio Parole Board, which heard the case Tuesday. And Ohio law is clear, they say: a death sentence requires an intent to kill the victim.
"The evidence suggests that Autumn's death was a horrible accident," his attorneys, Joseph Wilhelm and Tyson Fleming, said in a written argument prepared for the board.

Chair.
the death penalty is not severe enough for this man, but perhaps if the penalty is carried out properly, say like in the middle of a prison exercise yard with him tied over a barrel with a hundred or so angry prisoners standing in line behind him
6 months old. OMG. You deserve to die regardless if you intended to kill her or not.
He didn't intend for this baby girl to have any kind of life! He should get the death penalty!
Put him in jail and let him get raped so bad it kills him.
The media and justice system is screwed if they portray this as some accident. He wants mercy because he only intended on RAPING A 6 MONTH OLD CHILD? Die
Obama has called for him to the White House for a BABY SUMMIT...
Gross SOB needs to die... She was only a baby...
I don't care if he was drunk or not either.
But I would rather he die at the hands of another inmate instead.
No b.s. appeals costing the taxpayer.
YOU DESERVE TO DIE A LONG PAINFUL DEATH. I HOPE YOU ROT IN HELL
Skin that SOB alive and pack him in salt after ramming a telephone pole up his rectum.
He only intended to rape the baby and not kill it. Read that again. Does it really matter if he intended to kill the 6 month old baby? Well does it? To me, in my humble opinion, the mere fact that he raped the baby would deserve death.
But the way things are turned upside down in the country, and the world, it wouldn't surprise me if some nut didn't say it was somehow the baby's fault. Or the mothers. Or the postman. Or the guy down the street who owned an AR-15.
They say history repeats itself. I'm starting to wonder if whoever wrote the bible did not live through the things he wrote about. It seems to me that everything that's written in those 66 books is coming true.
Bad is good and good is bad. Right is wrong,..etc.
Agreed.
