On March 20, 2013, at a press conference attended by local media, Matthew A. Maciarello, State’s Attorney for Wicomico County released a document entitled Report and Conclusions of the State’s Attorney which detailed an investigation into a motor vehicle accident that resulted in the death of a minor, T.S., age 15, on Camden, Avenue on March 7, 2013. The report is attached hereto along with exhibits (except for audio communication and video that was distributed to the media at the press conference).
In the report, the State’s Attorney explained that the SPD officers observed J.S. manifest the following signs of impairment as he drove his vehicle through a Salisbury neighborhood: sharp turns, improper signaling, crossing prominent yellow lines, crossing white lines, driving through turn lanes, driving through red lights, driving through stop signs, swerving, driving through oncoming traffic, and failure to acknowledge the officer during a traffic stop. Based upon what the officers’ observed, and based upon the Maryland State Police Crash Team’s Oral Report, witness statements and other evidence obtained during the investigation, it was the opinion of the State’s Attorney that the officers acted prudently and professionally, and that charges were clearly not warranted.
The State’s Attorney provided copies of the report and the exhibits referenced therein to media attending the conference. He would have had to do all those things before they started to chase him in order to institute a chase according to SPD procedures that I have read. I cannot believe someone commented that a kid who was an honors student and made a mistake was a "punk who played and paid". It makes me ashamed.
Honors student or punk it doesn't matter. When you do stupid things and make bad choices, the consequences can turn out as disasters, as this did.

So it's the cops fault this kid made a stupid decision? Do you know how many lives were at stake because this honor student thug? You soft hearted liberals are ruining this country. Learn from this tragedy and raise your children better than you do.
He was only 15 and probably scared. No matter what the police say I think the chase was wrong. And now they're trying ti justify it. Had they stopped chasing he would have gone home and they could have apprehended him there since they had his tag number. Police chases also put innocent by-standers at risk.

Did the police know he was going home? Or could the car have been stolen? Or could it have been an active kidnapping? Or robbery? Or murder? Apparently there is no need to chase criminals any more since we can just get their tag number and go the their home the next morning after they have had their coffee.

This is really sad, but there is no way the police could have known it was a 15-year-old kid vs. a wanted murderer or rapist or robber.
Please. When someone tries to outrun the police, the police give chase if they don't see anyone else they would endanger. This tragedy has to have left a scar on these officers, too.
The boy made a terrible choice and I feel for his family. I also feel for the officers who did what they were supposed to, but probably can't help feeling the loss, too.
I pray for the family at their time of loss. That's really all that there is to be said.
The kid was 15...when in Maryland is it legal to drive a)alone, b)at night, c)evading police?? The officers were doing their jobs. Geez, people, you bi*ch when they do their jobs & bi*ch when they don't. You can't have it both ways.

The front page of todays issue of THE DAILY TIMES quotes our Wicomico County States Attorney "It (the report) also contains video showing a third marked SPD car involved in the chase, although department officials say they don't know who was driving."
FIRSTLY: The 15 year old was not a fleeing felon. Therefore, WHY put the lives of innocent people in jeopardy for a traffic violation, with a high speed chase through a largely populated area? (Oh yes, as an officer I want my monthly performance report to reflect another DWI citation - no matter how many innocent people are killed).
SECONDLY: I certainly hope that when Joe becomes Mayor of the City of Salisbury, that the first thing he does is replace the police chief. They want the power to close a business after infractions over a two (2) year period, but cannot determine what officer was operating a particular vehicle at a particular time. I may have been born at night, but it was not last night.
THIRDLY: The time has come for the democrats to find a better candidate to run for the office of States Attorney in Wicomico County in the next election. The republicans have failed the taxpayers and voters of this county with Matt Maciarello. It is obvious to me that both Ms. Duncan and Mr. Marciarello both have severe difficulty with the meaning of the word "truth". The best Twiddle Dee and Twiddle Dumb can do is to both resign their positions. Save the taxpayers money! Ladies and gentlemen this is an example of crooked law enforcement on the Eastern Shore.

I happen to agree with Gerald. It's a good way to keep people from acting like idiots. The cops a pretty much powerless these days. There will come a day when they can't protect you anymore because the average dirtbag has more rights than we do. We need to bring some sense of order back in our society and sometimes that requires a good old fashion ass whoopin by the cops. This will also save a lot of tax dollars by keeping it out of the court system. If you ain't screwin up you'll be fine.

Cops have already been doing that for decades. Never wondered where all those lawsuits and payouts came from?
Cops don't care, it's not their money, it's the taxpayers.
And every once in awhile we hear about a cop getting popped. If they behaved like you two endorse, they deserved it.

Firstly, the car was not his, therefore it was stolen...a felony.
Secondly, it does not matter who was driving a car that was 100 yards behind a chase, 200 yards behind the bad guy. I would hope every available cop was headed that direction to help. The cops didn't know why the felon was running.
Thirdly, how does this make an attorney general "Crooked"? Somebody must have written him a big check to make these findings I guess. They looked into this case, much more than they needed to. The cop cars are faster than the felon's car, and the cops were obviously better drivers, but they backed way off. The suspect continued to drive like an idiot. If the cops turned around and ran away, the bad guy still would have driven like an idiot. The only one with blame on this is felon.

Exactly. If the cops drove away, the kids still would have driven like an idiot, and crashed. People would have blamed the cops for not chasing him. You can all see in the video, they were way off of him. To blame the cops for actions of a criminal is idiotic. I blame the bank for the bank robbery too then.
