Burglary Arrest On Clove Street

DATE & TIME: 7/2/2010 at 2109 hours

LOCATION: 238 Clover Street, Salisbury, MD 21801

CASE NUMBER: 1054-006061

CRIME: 1. Burglary
2. Resisting arrest
3. MDOP under $500
4. Second degree assault
5. Disorderly conduct

VICTIM: 1. Eric Michael Weigel W/M of Salisbury, MD
2. TFC A. Edwards
3. Tpr. J. Smith

SUSPECT: Juan Gonzales Rivero, H/M 56 years old of Salisbury, MD

BRIEF RESUME: On 7/2/2010, troopers from the Maryland State Police Salisbury Barrack were called to 238 Clover Street for a reported burglary. When troopers arrived, they were advised by the homeowner that the above listed suspect had admitted to breaking into the residence. Tpr. Smith attempted to place the suspect under arrest and he resisted arrest. He was subsequently placed under arrest and placed into a patrol vehicle. While the suspect was in the patrol vehicle he attempted to kick the interior of the vehicle and spit on the interior of the vehicle and on Tpr. Smith. The suspect then appeared to have a seizure and the Salisbury Fire Department was called to the scene. When the fire department arrived on scene, the suspect continued to act in a disorderly manner and spit on TFC Edwards and was combative with the EMS personnel. The suspect was transported to PRMC for medical treatment and held for observation. He was charged with the above offenses upon his release from PRMC. Neither trooper was injured

If this goes in front of Judge R.Scott Davis he will find him not guilty and advise the courtroom of spectators that it's not illegal to assault and spit on an Officer. Then he'll recommend that the defendant obtain an Attorney to sue the Officers
