Salisbury Police Department Pulls A Dee, Dee, Deeee Tonight!

A short while ago a Salisbury Police Officer pulled over a guy riding his bicycle, (during the day time). He searched the individual and found NOTHING on him. When the individual asked why he was being treated like this the SPD wrote him a WARNING for NOT having a BELL on his bicycle.

Look guys, this BULLSHIT has got to STOP! There is REAL CRIME in this City and wasting your time writing tickets for not having a bell on your bicycle has got to be the biggest crock of shit I have seen in a very long time.

Tomorrow I will provide the actual ticket/warning this gentleman was given. Please don't make me have to write another Post like this guys, PLEASE?

How do you know this? Maybe he didnt have a light on his bike. Thats against the law. If he wrote a warning for no bell and its not illegal, the cop can lose his job. However if its legal, its legal.

Come on guys, a BELL? Granted, it may be against the law not to have one on a nike, I'll give you that. It was NOT dark at the time, for the person who asked. However, there are an average of 2 armed robberied per day in the City. Leave the black guy with no bell or drugs on him alone. I wasn't there, there could be more to the story and I'm sure there is. However, he was not arrested and he was given a warning for no bell on a bicycle. That's throwing good money after bad money, sorry.

The police officer made a valid stop of the person for a traffic violation, although it was a minor traffic violation. If the person he stopped was found with a gun on the way to a store, the officer would be praised for doing a good job and preventing a robbery. Lets not forget that following the bombing in Oklahoma, Timothy McViegh was stopped for a minor traffic violation and was subsequently arrested and identified.

the problem is NOT the salisbury police department, it is the society that is raising the low-life scumbag human garbage that would hold a gun to an 84-year-old man last night during this home invasion. That is the problem here. I think they should start executing these wastes of life. Just shoot them in the skull and be done with it...The world will benefit from such an act.

This is a tactic that was started years and years ago for the bicycle officers to catch the drug runners who were using bicycles to ferry there dope around. I have personally seen guys taken down on bicycles with guns and ounces of dope. So yes it is a good tactic, and it is against the law. If he was found to be in poss of a weapon or a small amount of dope. These dumb a-- criminals will roll on there on brother to get out of a charge and most of the time that is how these stops go. At least they are doing something and thats alot more than most of them. Keep up the good work.

The guy on the bike was easy. The more I read here and in the times, and talk to friends back home, the SPD is afraid to go after the real criminals. The guy on the bike posed zero threat to officer.

When my brothers house was robbed last month, the sheriffs department not only responded (He lives in the city limits)they eventually caught the guy, and helped him recover some of his stuff.

You continue to blabber about how other people do their jobs, the zoo, the fire department, the police department, the humane society and whoever the demon in head your pulls out today. Until you have filled these positions and actually done the work, who are you to criticize everyone?

Since you believe you're such a great reporter, maybe you should take some time to take an English course. I always get so lost in your great reporting as I stumble across your spelling errors and grammatical idiocy.

Back to the police issue, they enforce laws, no matter how tedious. No bell on a bike, throwing cigarettes out the window, whatever... In many cases these "minor laws" lead to major arrests, in which case you would be on here praising the officer for stopping the bicyclist.

Take your medicine Joe; the doctor prescribed them for a reason.

Not all officers at SPD are afraid of criminals 9:21 and 10:03. I know a few who catch some of the biggest fish in the pond sort of speak. And in the whole Eastern Shore as well.

I don't think I coulda said it better than "who cares" and "anon 9:33". This OFC was out there being PROACTIVE and more than likely getting CONSENT to search the person once he completed his "traffic stop".

Again, had he located a handgun, some crack or powder cocaine you would have wrote a "good job" blog. I am more than willing to bet this "person" that was stopped is a friend of yours who came crying to you about being "harassed" by SPD.

I think you need to decide what you want to do Joe. Either side for or against the police. If its SPD doing something "good" then you still criticize them.

If it is WCSO then you praise the crap out of them. Just because you don't like SPD's "Chiefy" and are obsessed with Sheriff Lewis, don't take it out on these OFC's. Those guys get enough grief for doing work.

Frankly almost everything can be used for a reason for a stop. See the following: http://www.courts.state.md.us/district/forms/criminal/dccr90.pdf. This is a police officers "fine schedule" which is a little book that cops have with them to determine the proper code and cost of a citation. Now, the wording in the fine schedule IS NOT VERBATIM of the traffic code, it is an abbreviated source. The actual traffic code is a book about 3" thick. So under the “bell law” as indicated the following is true: “ 22 401 a Motor veh. on hwy. w/o audible and reasonably loud working horn...................... $ 60.00”. A bicycle is considered a motor vehicle and “hwy.” is any paved roadway owned and operated by the state or local municipality. You can also get a ticket for blowing your horn for no reason, “22 401 b
Driver use of motor veh. horn on hwy. when not reasonably necessary for $ 50.00 00 00
Safety” or operating an ice cream truck utilizing an improper bell! So, yes, the stop is probably good PC. As far as the search, that’s another story. Either the officer had PC (probable cause) which could have been anything from the smell of marijuana to a suspicious object under his coat (etc.) or the person could have consented to the search. No one knows, we weren’t there. But, the initial stop is good if there was no bell on the bike. Petty? Perhaps but it can be used for a probable cause traffic stop.

OKAY, I hate to have to do this to you again but here comes the spanking...

I know the deputy also and if I were in a jam he is the first person I would want to respond because, when required, he backs us up all the time and when I’ve called for help, he’s come with a can of “help” with him. Heard a Judge here locally right from the bench say these SPD cops are making wrongful searches when it is done without legal probable cause........

What good is if SPD finds the dope and/or gun but the search was not legal--the perp walks and is on the street to continue his dope peddling.

Alot of SPD Officer's are good guys but there are a few that I don't trust. I've also seen Judges say the same thing, they make bad cases and commit alot of personal violations. Although the stop on the bike was a good one, it was a chicken shit one just to find out who he was. It's a common practice, but that's why you interview the person before getting into his pockets. A little interviewing and using some instincts never hurt anyone. Apparently this cop has no insights. As for the WCSO Deputy on Nanticoke road: I know him and he is a standup kinda guy and one I don't mind helping me. I have the utmost respect for him. A couple SPD officers have a grudge against him because THEY have a hard time getting along. They are narcistic and make bad cases. I've seen it myself while sitting in court waiting for other cases. I've also seen them do things to people that made me walk away because I didn't want to be labeled in the Civil Rights complaints. This is why some of them will NEVER be hired by the WCSO. Their reputation precedes them and the Sheriff nor the Deputies want that there. Don't blame them either. Some people (attn: TM's) can't accept that fact and want to keep controversy going over his wife sleeping with a Deputy while she was an empl:yee there. Typical new yorkers, never ever do anything wrong and they're perfect. They both can wallow in their sickness. They are not well liked in this community (law enforcement) by numerous agencies, judges and Attorney's offices.

Joe- you've proven your just a clueless on how police depts work as you are about fire depts. This is how cops bust people. They pull them over for bs stuff like no headlamp/bell/reflectors (bikes), or things like a license plate lite out, no seatbelt, not making a full 3 second stop, etc, for cars, just to have probable cause to check them out. If they're not dirtbag criminals they usually get let go with a warning. talk to your butt buddy mike lewis about this. he has made many of his arrests ths way.

Who the hell is Peel? A bicycle is not a motor vehicle.....it's a vehicle. Big difference. The proper section is 21-1207. There is an "a", "b", etc. for light, bell, respectively. On it's face it may sound like a petty traffic stop, but it's actually an absolutely outstanding tool to learn identities and as P/C for a stop of a suspect who is selling dope. If they refuse to stop after the officer initiates a traffic stop, it becomes fleeing and eluding, an arrestable offense. Once you make an arrest, you can legally search without permission. Good street cops know how to use this as an option to get the dirt bags off the street.

Officers have to use all the tools available to weave thier way through all the technicalities established by the constitution and related case law that govern arrest, search, and seizure, so that they can make good cases for court. Man you can do all kinds of good work that start with traffic stops like that. Remember bad guys use every type of transportation to get from place to place.

Then again at 3:01. Looks like TM is the one who let it go to me! Anyone with half a brain can see that. First attack him, then his wife, now his job and friends. I've been following the police related blogs for some time now. My better half is a retired officer. I don't like to pry in personal matters. I do have a couple observations which I think should be considered. I do pay a substantial dollar in county taxes.
From what I see is that an Spd officers wife worked in the Sheriffs office. Cheated on her hubby with a fellow Deputy. She got fired. Hubby got ticked off, as any man would. He didn't get hired there for obvious reasons of possible tension. Then several comments were made. Most not by him or his wife. But maybe a few friends or whatever.
At no time I have never seen anything that states the whole affair did not happen. What happened to the other Deputy? Just curious.
I do know of a cop that works at city who's from New York. I have met his family. I think it is the same guy I see jogging with his son in my neighborhood. From what I hear by many other police that we know is that he is a fine officer. From what I see his whole family is very respectable.
I see that he has made comments here none of which are deserving of the ones made in return. Again I don't really know him but what I have heard from other deputies, troopers, and city officers is that he works very hard and is very dedicated. I am inclined to believe them. Even the Avnet guy. He does seem like a standup man.
The rest on here, by the way they write, I would never take their word for anything. The language alone is offensive and child like.
