This seemingly innocuous proposal has sparked a firestorm.
First, a brief background.
Title IX prohibits discrimination “on the basis of sex” in federally funded programs. It was passed in 1972 as part of the Education Amendments Act to ensure that women have access to educational programs equivalent to men’s programs.
In 2016, the Obama administration issued a guidance letter reinterpreting “sex” to include sexual orientation and gender identity. The letter required schools to “‘treat a student’s gender identity as the student’s sex for purposes of Title IX.” This drastic reinterpretation was done without an act of Congress or even the normal rule-making process for regulations. It was clearly an act of bureaucratic overreach.
And it spurred a frenzy of disputes over trans students claiming access to spaces restricted to the opposite sex—bathrooms, locker rooms, showers, dormitories, sports teams, and so on.
Then, in 2017, the Trump administration rescinded the Obama guidelines. But it left unclear just what the law does require. Hence the administration’s current effort to provide a clear, uniform definition of the term “sex.”
The memo suggests that “the sex listed on a person’s birth certificate, as originally issued, shall constitute definitive proof of a person’s sex unless rebutted by reliable genetic evidence.” In this way, sex will be determined “on a biological basis that is clear, grounded in science, objective and administrable.”
Who could object to science and objectivity? Lots of people, apparently...

You can't pick and choose when it comes to Science when it's convenient for you.
Wanna tell me what you think about climate science? Wait, won't you need to use the peer reviewed consensus?
If you are gonna do this, you will have to be consistent.
You can't use this for your agenda to demonize trans-folks, then deny evolution which is supported by biology, paleontology, molecular biology, genetics, anthropology, and more.

I'm actually fine with the Government getting out of the sex/gender issues all together.... no need for their nose to be in it at all.
Transgenders don't need special protections, they share the same freedoms and protections we all do.
We ARE for the most part a binary species. YES there are abnormalities where people are born with odd genetics... but people are also sometimes born with 6 fingers. It is an abnormality, not a new class of people. Science supports this. We are almost exclusively male and female.
Wanna dress up differently? Want to get a sex change? Your name was Bob and now you want me to refer to you as Charlene? Why not? Sure! Just don't make it a hassle for everyone else.
Want to be referred to by some silly pro-noun? Whatever, I'll try my best to remember, but I'm not the bad guy for using language as most of our culture does, and it doesn't make me evil. It makes you a demanding a-hole. If you look like a female, I'll probably by default call you she/her.... a male as him/he.... but you want me to say something out of the norm then expect to have problems with it. And if you are gonna be a pain about it, I'm certainly not going to be compelled to say anything.
