With little discussion, the mayor and the City Council enacted an emergency ordinance during Monday’s session that grants police officers the authority to arrest anyone who ignores their orders.
The ordinance’s language makes it “unlawful to fail to obey a police officer’s order to immediately cease and desist while committing any offense, which is classified as a municipal infraction upon such order from a police officer.” Since the ordinance upgrades some infractions to misdemeanors, violators can be punished with a $1,000 fine or 90 days in jail.
The Police Commission considered imposing harsher penalties since the Ocean City Police Department would have to wait 24 hours after issuing the first citation before taking further action. Originally, city staff considered that Maryland’s common law “failure to obey a reasonable and lawful order” would be able to assist the police, but decided that wasn’t enough to cover all possible infractions.
