Any assets, 'gifts', etc, that were transferred during the period in which the crime was committed are seized. The government has all angles covered.
A bit off topic but along the same lines. If an elderly person, who bought a child a house, paid for grandkids education, gave a large 'gift', etc, ends up in a long term nursing facility and runs out of money and has to go on Medicaid, Medicaid can go back (I believe) it's 8 yrs to get the money back from the recipients. They look at it as a deliberate transfer of assets or distribution of money in order to get rid of it before the "nursing home gets it."

New York City to New Church VA. 530 miles round trip (give or take). Cost of gas for the trip at 25 MPG @ $2.80 per gallon(note more than the current price)$59.36. Current tax per pack in New York $4.35, current tax in VA $0.30 per pack or $43.50 per carton vs. $3.00 per carton. Pack a day habit 30 packs or 3 cartons per month. Tax for 3 cartons in NYC $130.50, tax in VA. $9. Trip to VA from NYC once a month for a months worth of smokes savings $62.14. Ability of poor people in NYC to travel to VA for smokes once a month 0%. Ability of middle class or wealthy people to in NYC to travel to VA for smokes once a month 100%. Seems to me that New York is discriminating against poor people in their State. NAACP where are you. If I am a business man in NYC I can schedule a trip to VA Beach once a month write off the entire cost of the trip and pick up 3 cartons of cigarettes and save over $100 in the process along with a weekend in VA Beach. If I'm poor and smoke I'm just another slave to the State.
