Did speeding PGPD officer with .07 BAC die in line of duty?

GREENBELT, Md. (WJLA) – After Prince George’s County Police revealed off-duty Officer Brennan Rabain had alcohol in his system when he got into a crash that killed him, some officers are asking if his death should be listed as having occurred in the line of duty.

Two weeks ago, Officer Rabain was laid to rest with full honors. Days before, the 26-year-old died in a crash that was ruled in the line of duty, because though technically off duty, Rabain was in pursuit of a 100-mph speeder on Greenbelt Road.

“To the end, he was serving this community with no concern of his own safety,” said Chief Mark Magaw at Officer Rabain’s funeral.

Last Friday, it was revealed that Officer Rabain’s blood alcohol concentration was .07—enough for a possible charge of driving while impaired—at the time of the crash. On Tuesday, Dean Jones, the president of the Fraternal Order of Police (FOP) Lodge 89, said that changes nothing.

...or the safety of his own girlfriend. How was she served by this impaired off duty cop?

He quit being a cop when he got behind the wheel drunk. Now us tax payers are paying money to this criminals family for life! To the end.... Thank god this criminal only killed himself. Typical cop mentality..... Above the law!

I don't really see the difference we pay welfare to drug addicts, dead beats people who never worked a day in their life ...he didn't hurt anyone else and he paid the ultimate price. Since I am one of the people that works and actually pays for everybody else stuff, I am ok with paying for someone who on every other day of the week went to work.

8:15 The reason not to is because this sets a precedent. The next time a civilian may be killed or worse crippled for life. Because they said in this case it was line of duty the next time it happens and someone is injured or killed they can sue the government saying the Officer was on duty. That is why it makes a difference. What they are trying to do is make it so his relatives can collect some compensation.

didnt his gf get hurt? who bought cop car and who will replace it? who had to respond to accident scene? who had to clean up the scene?

but no one else was hurt?

No way. He quit his job when he decided to take his girl against her will on a drunken life ending ride.

Absolutely not. He quit his job when he made an alcohol inspired decision to endanger his girlfriend's life in exchange for chasing down a speeder on his own time, not at work.

He absolutely should never have engaged this vehicle.

Just another ignorant civilian to clain him as some sort of hero, me, but if the State Police want to hold him up as a hero, it's telling us what the bar is these days to be a Trooper.

This makes Troopers a bad thing.

he shouldn't have been in that chase. he was drunk. why glorify him? thankfully, he took no one else with him.

DUI is DUI.
It doesn't matter if you have a
badge.
At least, not to "we, the people".
Equal justice.
The people don't see that much anymore. And its a problem getting bigger every day.

Yup I am going to walk back my comments you people are absolutely right. Any person that is paid by any city, county, state or federal government agency who commits a crime including but not limited to driving while drunk ( which happens to be in excess of .08 in every state in this country) should absolutely not receive any money nor should their immediate families receive any money from any government agency. I am fine with that as long as it is across the board not just police officers. So let's go back and take it away from all of those people as well. That should help significantly with the federal deficit.

Didn't hurt anyone else? His family is in pain I'm sure. His girl was hurt. How many lives has he ruined? Every person he ever arrested should have their convictions over turned. Same with all cops who break the law.

Just another story of how police do no wrong. Even when its obvious wrong has been done. Just like the murdering sheriffs deputy. Who cares if he violated rights. And he's back on patrol! Mike lewis!!!!! You care so much for our rights and freedoms that you grandstand every chance you get, why don't you grandstand more and publicly fire your deputy who killed that boy? Your deputy violated his rights first! As a cop that's a crime. Your held to a higher standard as officers. But I forgot.... Every black man you've ever come across has been searched and treated as guilty. Some of us know about your profiling ride to the top.

This cop union guy, Dean Jones, also said per the parent article,

"He responds to anonymous critics of the line of duty death designation by citing federal law, which states that an officer who takes police action, even if he or she has been drinking, is acting in the line of duty."

Can you believe this BS?

So, here we have cops who 1.) don't need to know the law about your 4th Amendment rights [per the SC's decision] and 2.) can be drunk while he's ransacking your home/car/camper/SUV per federal law.
What TF is this country coming to, for crying out loud?
