Around 3 a.m. on Sunday, Ocean City police officers responded to the parking lot of a hotel on 2nd Street to assist Ocean City EMS with an assault that had already occurred. Upon arrival, OCPD officers found the victim, later identified as Justin D. Cancelliere, 37, of North Whitehall, Pa., unconscious and unresponsive. First responders from the OCPD and the Ocean City Fire Department initiated emergency lifesaving procedures on the victim and transported him to AGH where he was later pronounced deceased. An autopsy was performed on Monday, and the Office of the Chief Medical Examiner in Baltimore has ruled the nature of Cancelliere’s injuries as head and neck trauma and the cause of death a homicide.
After an investigation, OCPD detectives determined the assault occurred during an altercation in the area of Talbot Street and Baltimore Ave. The two suspects, identified as Caleb Edwin-Earl Ochse, 27, of Ocean City, and Christopher Blake Kendall, 22, of Ocean City, had entered the Fat Daddy’s restaurant around 2:30 a.m. on Sunday and ordered food.

Sorry, but if you're involved in a self defense situation you certainly don't flee. You stop the threat, call the police, or go straight to a hospital to get checked and report to police.

While this may very well be self defense, I take extreme offense to the tasteless statement released by the family of one of the defendants.
To even hint that this was a rush to judgment is ludicrous. A rush to judgment and he would have been charged with murder.
At this point in time a more appropriate statement would have been just a simple offer of condolences to the family of the victim. Nothing more- nothing less.
The dissertation into why this happened was out of line and should have been reserved for a later date. Clear to see now, why this young man has had difficulties his entire life.
Either way if the suspects were defending themselves, or if they started it, when you are out at 2:30 in the morning, you are looking for trouble. Go to bed!

Remember in the Zimmerman case, he called 911 after the threat to him was eliminated.
Report says they ran east toward the ocean, where at some point they had to realize they we out of danger (if they ever really felt they were in any danger to begin with) and called 911.
Or is they were really in fear, they would have called because even though the victim was immobile he still had friends who weren't and could have been a threat to them.
According to the MD Judiciary Website, Caleb is no stranger to fighting, dwi, and general mischeif.

I call BS. If it were self defense that means you are in fear for your life and you would call for help as soon as you felt you were in a safe position as said above.
Sounds like another case of affluenza. Rich family, always bailed him out, he didn't know how to control himself. Not HIS fault. Now that he's risen to this level of violence, what's next, when he gets out?

Who cares what the tapes show. The altercation occurred outside and not in view of the tapes. That's all that's important.
The minute the four men followed the two locals out of the restaurant and trailed them they became the aggressors. Sounds like they were looking for trouble. Good thing there is video.
I agree with 9:07. Four-on-two. One guy thought he was Rambo and these two little locals were going to be fodder for him trying to impress his buddies. Not this time. You pick a fight that time of morning, hundreds of miles from home, on two smaller men, for no reason, with three bigger guys to back you up...tough luck on you.

The tape is a nonissue. Completely useless really. What occurred outside is the only thing that matters.
Not saying this wasn't justified but to say the tapes proves that it was, is silly. Unless the victim was shown to have provoked a reasonable person to use physical force for protection the manslaughter charges will stick.

I think I would be willing to give the accused the benefit of the doubt more if they had gone to LE and not LE had to go looking for them.
That would be more in line with self defense. By not contacting LE right away seems like they wanted to get their stories in line with each other. And really the only thing that matters is what happened outside. Hopefully there is an independent witness to all of this.
The act of "following" someone in and of itself, is NOT an act of aggression.
Just following someone does not make the follower an "aggressor", some other action must take place for it to be an act of aggression. There are lots of reasons you might follow someone and many reasons you may THINK you are being followed.

A more accurate description would be to say following someone is very intimidating. The act of intimidation means to make someone fearful.
I wonder how long before Ochse starts blaming Kendall and Kendall blaming Ochse. You know it's coming.

I agree 12:40 but none of that matters. They were followed as an attempt to either intimidate and/or provoke. No kidding we get that. The only question that matters is who was the aggressor. Following someone is, in no way, shape or form an act of aggression. It's not even an act of stalking in of itself.
This is sickening. The tape tells very little of the story-no audio and only what happened inside.
The Ochse family sounds clueless and should have remained silent instead of trying to make a case in the media.
This enabling and excuse making is a major factor in why this young man has had so many run in's with the law.

Like most altercation's, people don't call the police, especially if the fight ensued, ended and the two parties went their separate ways. Playing devil's advocate here, you don't leave a fight thinking the other person's going to die later of injuries. He has a record of fighting, but do we know the victim's record? Probably not. A past of fighting doesn't mean he set out to intentionally kill someone. Now, had the victim lay lifeless in the parking lot immediately after the altercation I'd say sure, he was wrong to just walk away knowing that something was wrong with him! At the end of the day, he did take someone's life whether it was intentional or not and he should have to serve time for manslaughter. It's a good thing that Fat Daddy's cameras caught some of the action leading up to the altercation on surveillance.
Another published account states that Ochse and his buddy were being disorderly inside Fat Daddy's. That certainly might explain attention (staring?)they allegedly got from the victim. Regarding alleged following, the route the victim's group was taking was on the way back to the hotel they were staying. You want to say they were following, it's just as easy to say (and impossible to prove) that Ochse was laying in wait for them.
I do agree with sby16grl. This is manslaughter, not murder. And someone in similar circumstances got 7 years for it same prosecutor, I believe.

How special that the family leaves the disorderly part out of their statement, proving only that the apple doesn't fall to far from the dishonest tree.

He's a no good SOB-his prior record speaks for itself- and reading this makes me ill. Seems the whole family is tacky crass and vulgar. Not only do I think this is not the right time for their side of the story but to blatantly be dishonest about it takes it to a whole new level of their obvious dysfunction.

How do you know they were being "followed"? Maybe the 4 were going back to their hotel, and it happened to be in that same direction....wait until all the facts come out. Yes Caleb is pretty much a dirtbag, and nobody knows about the deceased, but wait for the whole story before rushing to judgment one way or the other.
Kendall would best be served by coming out with the real story.
Most of what Ochse or even his family are saying can not be believed. At one point his aunt is saying in comments elsewhere that the victim and his companions were yelling obscenities and picking a fight with the defendants. She claims in the story linked to this post that the defendants were "jumped."
Lying comes naturally to this family.
It's also telling as to the family's character when they omitted the part about the defendants causing a scene in Fat Daddy's, which would give reason for anyone in the establishment to stare at them.
I have no sympathy. He as well as his dysfunctional family need a lesson in how to live in a civilized society.
These people are huge democrats therefore it's in their genetic makeup to dismiss any personal responsibility, make up excuses and attempt to pass the blame on to someone or something else for their own bad actions.
