Troopers Arrest Camden Man for 6th Offense DUI

Location: Royal Farms, 6 West Lebanon Road, Dover, DE

Date of Occurrence: Friday March 21, 2014 at approximately 4:38 p.m.

6th Offense DUI

Arraigned at JP2 and was released after posting $5,000.00 cash bond.

Resume:
Dover, DE- The Delaware State Police have arrested a man from Camden after he was found to be operating a motor vehicle under the influence of alcohol for the 6th time.

The incident occurred at approximately 4:38 p.m. Friday afternoon when a trooper was dispatched to a report of a male passed out in the parking lot of Royal Farms located on the corner of West Lebanon Road and South State Street. The trooper was able to locate the vehicle in question still running and observe the driver, who was later identified as Titus W. Hobbs, with his foot on the brake. Hobbs, who was slumped over in the vehicle asleep, was woken by the trooper who could immediately smell alcohol being emitted from him. A DUI investigation ensued and Hobbs was taken into custody and transported back to Troop 3. A computer check revealed he had five previous DUI convictions (10/09/89, 12/28/89, 12/31/89, 11/30/94, and 03/13/96); this arrest would make #6.

Titus Hobbs was arraigned on the Felony DUI charge and later released after posting $5,000.00 cash bond.

It used to be, in the state of Delaware, that if 5 years has passed since your last DUI, they treat the next one as your first offense. Is that still the way it is, and if so, how can this be a felony DUI?
