Mayor Ireton & Police Chief Duncan Want Control Over The Liquor Board

During yesterday's City Council Work Session the Mayor and Chief of Police introduced a proposed ordinance that came out of nowhere but is now being targeted as something the City Council came up with. Know this right out of the gate, this has everything to do with the Mayor. It is the Council's job to review any ordinance the Mayor proposes but for those of you who are targeting the Council, you are out of line.

"It particularly targets bars, restaurants, and convenience stores. If a property owner has 2 “confirmed” cases (read charges, not convictions), including underage sale of alcohol to minors, within a 2 year period, the Salisbury Chief of Police can close the establishment."


It should be noted that the Liquor Board already has complete control over licences and now the Mayor wants control over the Liquor Board. One might ask, why? Could it be that the Mayor is upset with the Liquor Board over an alleged incident at MoJo's not that long ago? Could it be that the Mayor has interest in riverfront property and wants to control whether or not a certain establishment can stay open or not?

All I can tell you is, Big Brother wants to get even bigger and the community needs to fight this from beginning to end. Yes, some establishments have more problems than others but I can assure you that those establishments that do have more issues are desperately trying to manage those businesses as best as they can. To attempt to INSULT the Liquor Board by creating such an ordinance to overpower them has to be what I'd consider the last straw for this community or any other. 

You cannot have a controlling part time Mayor who pulls this kind of stunt to prove his/her power and control. Let the Liquor Board do their job. Let the Police Chief do her job and for goodness sake Mayor Ireton, stay out of local businesses business. It's no wonder Salisbury has the reputation it has. 

Salisbury News has learned that Frank Hannah will personally come up from Florida to fight this ordinance as well as corporate lawyers from WaWa, (and the fight just got started). 

Stop grandstanding Mayor Ireton. I keep telling everyone, Salisbury is NOT business friendly and that will change the very second I am elected.

What does the mayor do all day? Sit around and dream up useless legislation? I could see 2 confirmed cases within something like 30 days because that would indicate a problem but 2 in 2 years is just plain stupidity and another indication of just how business unfriendly Salisbury is.
Maybe if Ireton spent as much time cleaning up the river and on nuisance residential properties as he did dreaming up new stupid laws Salisbury would be a showplace.

The County council can't even touch them as it should be.

anonymous 2:10, very interesting! If you'll recall, almost a year ago I confronted Jim at the Salisbury Festival and asked him if he was going to run again. He said if he got the EDU's and all parking lots surplussed he wouldn't run again.

It's not too late to register to vote. Any establishment that sells alcohol in the city needs to immediately make sure their employees and patrons (if qualified) are registered to vote. They need to have the registration forms available and cards printed for the districts to hand out saying-

anonymous 2:17, thank you. This should be the final straw for Jim Ireton. I have been saying it for years, he is so unfriendly towards businesses it isn't funny. Hence Alber for Mayor signs at so many business locations.

The wicomico county liquor control board members are appointed by the governor of Maryland.

There are two seperate liquor boards, one that controls license and regulations, the other sells the liquor(dispensary). The profits from the liquor sales goes to the local county government (Wicomico).

Both are controled by state appointments. Jimbo is way over his head on this one. He's peeing down the backs of the wrong people now!

Is Ireton's proposed standard for closing businesses really 2 errors in 2 years? Let's look at how absurd that is. Say the Giant makes 100 sales of alcohol per day, in 2 years that would be 73,000 transactions. So, the fourth grade teacher running Salisbury on a part-time basis is saying that 72,998 out of 73,000 (99.997%) is a failing grade?

What a buffoon!

Ireton is just as full of sh%^%^ as a Thankgiving Turkey.
Under Md. Article 2b (liquor licensing authority) the one & only person(s) that can supercede the liquor boards baliwick is Mike Lewis. Him and/or his deputy(s)can enter an establishment vending liquor and demand to see the premises liquor license OR determine such establishment is acting as a Disorderly House(Bet Ireton NEVER heard that one before) and Lewis can ORDER the establishment to immediately close down, cease and desist. He farthurmore could send an emergency letter to the liquor licensing Chairman to suspend and hold the license of said establishment until such time as an open meeting could be held to determine the weight of the evidence in presented fact. At that time the proprietor has the chance for him & his councel to defend of same.
Oddly enough I don't read ANYWHERE either Ireton OR Duncans' name in that section or subsection as being party to circumvention of the statute. These oats have ALLREADY been through the horse as usual with Town Government. I HOPE I get a chance to third chair the resulting lawsuit!! Someone needs to TELL Ireton and Duncan when she crossed the line at Delmar things in MD. DON'T fall under the domicile of NEW YORK either in text OR AUTHORITY.

I worked at the dispenary for eight and a half years, to my knowledge we only had one violation during that time and that was ONCE, at the Tighlman road location and that manager has long since retired.

There are only three places to buy liquor in this county and I'd say that is not bad. Four million dollars in sales a year, one violation is too many, however who's going to run a tighter ship than that?

I have been in the bar restaurant management business, and my time at the liquor store, I've been dealing with alcohol consumption for 30 years without one violation under my watch.

Maybe Ireton would prefer the liquor board didn't exist then we'd be like the big cities with liquor stores on every corner. More big gubberment liberltards with nothing better to do. I'm sure Rick Pollitt isn't gonna give up that revenue with out a fight.

this is ridiculous. i am a convince store owner and mistakes happen it can be by you or your employees. Closing an establishment is going to far. If a business closes down then there goes tax money for Salisbury. If we had a better leadership like the other counties around us small businesses would be doing very well. For instance give c-stores to sell liquor. And that would bring more taxes then what the wicomico dispenser are making.
There would be no need for Salisbury residents to go to Delaware for liquor, and not pay high prices in the county liquor stores. There was a 70% tax increase on tabacoo opt items. where now we have to business on cigars, our customers just go to Delaware to virgina.

If you visit one of the three liquor stores in Delmar, all on the Delaware side, you will observe more vehicles with Maryland plates than Delaware. Could the Maryland-O'Malley 9% sales tax have anything to do with it?

This certainly proves that Ireton has something else up his sleeve. Something underhanded at that. Why in the name of income and revenues would he want to stamp out businesses???? There's something else a foot here, something sneaky. It also speaks volumes of the police chief for going along with it.
Little people who think they are big time, I don't think so. Give Ireton a foot and he thinks he's a ruler..not so. He has NO BUSINESS IQ and has no business being the mayor!

Both he and Pollitt come from a government background. Free markets and free enterprise is foriegn to them. As long as voters continue to elect such people, we can expect more regulation, control and an atmosphere that is not business friendly. Unfortunately, this is simply a part of their nature, and until they are replaced with knowlegable and experienced business people, little will change.

I doubt the Annapolis machine has any candidate they favor in Salisbury and seriously doubt "Jimbo" would be their pick. Ireton's only hope is to follow the party platform and hope someone drops a few crumbs. Just take a look at the voting turnout. Would anyone ever expect an Obama to show up? Salisbury is on their own whether to improve things on behalf of the citizens or turn the back on them in order to realizes some small town kick back.

Mojos should ban Ireton from premises. This publicity is negative for them overall. In fact, concerned citizens should boycott Mojos and let them know that Ireton is coloring their business with his politics. Maybe if they get enough people boycotting, the owner will tell Ireton he's persona non grata on their premises. Sweet irony.

The LCB is an outdated holdover from prohibitionists and shoud be eliminated. Enforcement of laws should be handled by police, thats why they are called law enforcement. It is wrong (IMHO) for government to be in busniess and competing against private enterprise. The LCB is just another way for government to waste more of your money and support the good 'ol boy network. Buy your hooch in Delaware. Besides, it costs less there.

Suppose businesses could get only two sex violations on their premises in two years before being shut down. How can underage drinking be a monumental problem to the mayor and law enforcement, but sex offenses aren't?

While, this whole dealing is shady, I don't know why anyone is Salisbury would buy any beer, liquor, or wine here ever. Right down the road in Delmar you can buy it up and not get robbed by exhorbitant taxation.

You are JUST as left handed AND MIS-GUIDED as Ireton & Duncan.
There is a DIVISION between what you are speaking of that apparently you ARE NOT familiar with. The SHERIff ONLY has jurisdiction over CIVIL process. Neither Ireton OR Duncan has THAT authority which has been GRANTED the SHERIFF since the time ENGLISH COMMON LAW was adopted as the LEGAL standard to handle CIVIL infractions.
I might enlighten you as to the FACT LIQUOR LICENSING IS A 'CIVIL'
MATTER which is GOVERNED by DIFFERENT procedures 180 degrees to
CRIMINAL procedures.
Not withstanding the test is a principle that in itself is a REPROACHABLE complaint (lawsuit) that I hope I can be part of to seek a remedy.
Duncan is the POLICE CHIEF which ONLY has authority over CRIMINAL process. The crux of the situation IS there are MANY opinions yet NONE are founded in LAW or CASE LAW.
The dunderhead Ireton uses the approach NO ONE will question HIM... How wrong could one person BE.
I'm waiting for the RIGHT moment to do my yearly PRO BONO ... Believe me when I tell you I WILL UPSET THE WONDERLAND BALANCE in CAMELOT!!!
