Delmar Man Arrested After Assaulting Paramedics

Resume:
On Monday August 16, 2010 Delmar Fire Department EMTs responded to Britts Lane Delmar, Delaware for a subject allegedly passed out on his front lawn. When Delmar Fire Department arrived they found Clodoaldo L. Santos-38 of Delmar lying in his yard.

State Police learned that Santos arrived at his residence, pulled into his driveway, exited his Ford pick up truck and stumbled across his yard before collapsing. When Delmar Fire Department arrived they attempted to ascertain the condition of Santos, however they were met with obscenities. Santos continued to make verbal threats toward 4 different Emergency Medical Technicians there to help him.

Delmar Fire Department while attempting to load Santos onto a stretcher would kick, punch and spit at the emergency medical crew. Once Santos was placed into the ambulance he ripped his IV’s out flinging blood about the inside.

Santos was transported to Peninsula Regional Medical Center for treatment and after being released today was formally charged by State Police. Santos was charged with 9 counts of Offensive Touching against Ambulance and or EMT’s, Terroristic Threatening, Driving under the Influence of Alcohol and Disorderly Conduct. Santos was remanded to Sussex Correctional Institute in lieu of $5,600 secured bond.

Since when can't you refuse treatment? Sounds to me like the EMT's were in the wrong by sticking needles in this man when he clearly didn't want them to. This was clearly a big mistake by these emergency workers.

Agreed. Maybe he didn't want needles stuck in him. Like did it ever occur to anyone to leave this guy the F alone? He was at HIS residence in HIS yard for chrissake. Leave him alone!! This is scary, on a number of levels. Paramedics show up and force care on him when he probably didn't really need it?

He probably should get off with the DWI. I didn't read where any police officer observed him driving. Are we now going to find people guilty of DWI just because a bystander says they observed someone driving while intoxicated?

There aren't enough details here. Why were the EMTs compelled to force treatment on this individual? Had he been violent? What right do citizens have to refuse treatment? Perhaps he went about it the wrong way, but given the details offered here I shudder to think anyone can just be hauled off to a hospital for being drunk or look intoxicated. Hell, if that were the standard they might as well build a bay for ambulances only over by SU and Wor Wic.

It sounds to me that the patient was not in the correct frame of mind to consent to having no service rendered. Many disease processes can be masked and complicated by alcohol. A case in Washington D.C. where EMS providers wrote a patient off as mearly being intoxicated cost the citizens a lot of money in a law suit against the city.
I applaud the EMS providers for following protocol and not leaving this patient in his front yard with no care.

Why did they not just leave this jerk alone..He was in his yard. He would have either passed out and slept it off , or laid there and the rain would have drown him..EMS had no right sticking him with needles...There are others out there needing their help..

sounds like the emts kidnapped him and he was defending himself. i would expect this out of the fools in salisbury but not delmar.

The next thing is that they are going to expect him to pay the bills that were forced on him. Most likely the tax payers will be paying the bills and I don't blame this person for not paying, after all he tryed to refuse treatment. Maybe this is Obama care in action, care for everyone no matter if you want it or not.

You must be joking...First off, the average person has no idea about this case so shut up. Second, he was not kidnapped, he had an altered mental status and does not have the power to refuse, you would know if you were familiar. The IV could of been to counteract any narcotics in his system... If he didnt even know where he was or his name at the time, would you just let him refuse...IDIOTS, please know what you are saying before you say it, and if you want to make an educated decision, actually read the charging documents...Its so easy to say what you would do if you were there. There are actually protocols that have to be followed and they were to a t, and if it is decided by any police official that they are not able to care for themselves, they cannot refuse treatment....Go online to Delaware fire school and under ems, they have a copy of what can and cannot be done, then at least try to make an educated decision.....I know all involved and they did not kidnap him, or do anything outside their protocols....

This is so disturbing folks, they say don't drink and drive but apparently it's not even safe to drink at your own house either... This man was in the boundaries of his property and nobody can prove he drove while intoxicated since he was found outside his car on his back yard. This all makes me think "Are we allowed to drink at all?" and if so "Where should we drink? Inside our bedrooms?!!!

Some kind of neighbors we have around this town? If this neighbor was so concerned why didn't he just check on the gentleman since he claims to know the guy and helped him instead of calling the Emt?

This man is my ants x husband. He is legal and i have never none him to do anything like this. he must be having some problems in his life. I still care about him no matter what he did.

That is why the expression "Shit Happens" . The guy did not want to disturb anybody, did not call for help and pass out on his lawn. What did he do wrong?????

I dearly regreat for drinking that day, I had never ever have intention to hurt or offend anybody.I do apologize to EMT's for my actions, but I had no concience at the time. I am a single father of two kids trying to make a living and made the mistake to drink while in my property. I was harmless because I was drunk and weak with no coordenation on my body. It is sad what happened to me inside that ambulance because they were angry to me and I had no witness.
All I have to do now is keep working hard, do not ever drink in my life again and do my best to pay all this bills without let miss meal on my kids table.
Thanks for those who simpathised with my situation.......I wish that Delmar rescue had left me alone I was just drunk, now I have bruses and my body ache
