Hope On The Horizon For The Demise Of Obamacare..

Nowhere in the Constitution is Congress given the power to mandate that an individual enter into a contract with a private party or purchase a good or service and, as this paper will explain, no decision or present doctrine of the Supreme Court justifies such a claim of power.

Therefore, because this claim of power by Congress would literally be without precedent, it could only be upheld if the Supreme Court is willing to create a new constitutional doctrine.

This memorandum explains why the two powers cited by supporters of this bill--the power of Congress to regulate interstate commerce and the power of Congress to tax-- do not justify an individual mandate, even under the most expansive readings given these powers by the Supreme Court.

In particular, this paper addresses four topics that have not yet been given adequate consideration by Congress and most, if not all, of the commentators:

* First, most arguments, either favoring or opposing the individual mandate, do not discuss the Supreme Court's "class of activities" test, which it has applied in every relevant Commerce Clause case. This paper addresses this oversight and argues that, despite the broad congressional power to regulate interstate commerce, the individual mandate provision fails this test and is unlikely to survive the Court's review.

* Second, this paper addresses the common, but mistaken, suggestion that a universal federal mandate to obtain health insurance is no different than a state requiring its licensed automobile drivers to have liability insurance for their injuries to others.

* Third, this paper analyzes claims arising under the Taxing Clause. A preliminary review raises serious questions about the constitutionality of using the taxing power in this manner.

* And finally, this paper explains why it is highly unlikely that the Supreme Court would break new constitutional ground to save this unpopular personal mandate.

they'll pass it anyway. I see the point and I agree that it's unconstitutional but that won't stop them. Think about it. Obama's executive order permitting Interpol to come into the U.S. and conduct investigations using international law rather than U.S. law usurps the rights we are entitled to as Americans. An executive order nullifying or Constitution. Hmmm. This is wrong. They will pass this thing in blatant violation 0f our Constitution and this will spark a second revolution.

The revolution is on already-- being fought right now on the phone, with the pen and at the ballot box.
We have just ten months to get things where they need to be.
Many have been sitting and saying "they will never change-- there's nothing I can do."
That attitude is what got us where we are.
"Somebody needs to do something."
Not "somebody.."
YOU.
If you really care, get up. Make some phone calls and let them know in no uncertain terms that we're done with the BS.
Then get on the computer and give it to them in writing.
Then get on the phone/email your friends and tell them just what I'm telling you-- you and I are the ones who are going to have to fight this war (and make no mistake-- it is a war.)
The next ten months is probably our last chance to turn this thing around without things getting really ugly.
The battle is on.. are you in it, or are you going to watch from the sidelines and wring your hands as America's Patriots make the sacrifices they have to make to get the job done?
Pick the candidates you're going to back, and get busy...
Use your voice and your computer, and start talking about the issues to everybody you know, both conservative and liberal. Don't be obnoxious-- be effective. Convince them.
If there has to be a fight, let it be here and now, so that our children can live in freedom.
It's up to you and I.
Let's get the job done.

The worst part is that not only is it going to cost trillions if/when passed, but it's also going to cost many more trillions in people fighting the bill instead of simply fixing it. This fight is what is going to destroy our country financially. Whether you are for it, against it, or indifferent, we are all going to suffer simply because NOBODY seems to know the word comprimise

There is a fighting chance that a Republican candidate who has pledged to vote AGAINST this bill may win the special election in a few weeks in Massachusetts of Kennedy's seat. His name is Scott Brown, Lt. Colonel, and is a fiscal conservative. DONATE what you can to him, the Republican National Committee is ignoring him, his support is purely grassroots! He would tip the balance from the Democrats as the 41th vote!!!

No, 10:31, it's NOT about 'comprimise' (you mean 'compromise')
That's what got us Republicrats like McCain.
There's nothing good in the Obamacare bill-- it's nothing more than a fast track to marxism, and compromise won't improve it (that would be like putting ice cream on a pile of..)
The application of solid conservative principles to this problem will help solve it-- but the Republican bills have been buried by the Marxists-in-charge.

I think the new health care reform bill is great and years overdue.

I have been just as vocal in favor of it as anyone I've ever met who's apposed. Its funny how none of you got so worked up over W' dragging the constitution through the mud in the name of fear but when President Obama takes charge and provides all Americans meaningful health care reform you freak out...

and don't be surprised when the public option comes back in the next session if not in Obamas second term!

So, let me get this straight: Either I buy the Government's healthcare insurance or they can throw me in jail? Hey, take me away! At least there, I'll get 3 meals a day, a roof over my head and FREE health care! If all of us refuse to buy into this pile of crap, where will they put us all? The prisons are already overflowing (which is why convicted pieces of slime like Leggs get released early), so there's no way they can lock all of us up. But if that's what they want to try to do, SCREW 'EM! I wear a size medium orange jumpsuit.
