SALISBURY FILES WASTEWATER TREATMENT PLANT LAWSUIT

Salisbury Mayor James Ireton, Jr., is announcing that the City has filed a lawsuit against O’Brien & Gere Engineers, Inc. seeking damages for repair of Wastewater Treatment Plant (WWTP) design defects, corresponding increased cost of operation, recovery of any monetary penalties imposed by the State of Maryland and/or the U.S. Environmental Protection Agency for non-compliance with the City’s wastewater discharge permit and/or sanitary sewer overflows. The City is claiming that thirteen (13) design defects may result in as much as $18 million of repair costs and increased operational expense.

The City is also claiming that O’Brien & Gere Engineers, Inc. misrepresented the capabilities of the WWTP design, the operating costs, and the difficult operational issues to the City. The lawsuit claims damages of $10 million as a result of these misrepresentations.

“The City continues to work with its consultants to improve the daily operation of the WWTP in order to improve its performance,” said Mayor Ireton. “As the City moves forward with WWTP repairs, I will keep the rate payers of the City informed of those improvements.”

EDITORS NOTE: It should be known by all that within their contract there's a $1,000,000.00 Liability clause on behalf of the Engineering Firm. A lawsuit, (IMO) is useless. Whomever allowed such a contract should be held, (perhaps criminally) liable.

Joe, I know that you've been busy with all the craziness going on and I'm figuring that this is on your to-do list, but here it is anyway...Wicomico County Furloughs have been passed. Could you please post and allow discussion so some Citizens and employees can voice opinion on the matter. Thank you!


Today the Wicomico County Council adopted the following Furlough Plan. We need to notify all County employees immediately. I have asked Mr. Fineran to distribute this e-mail to all employees with e-mail, but the rest should be notified by the department. Thank you for your help in this matter.

EMPLOYEE GROUP NUMBER OF FURLOUGH DAYS
Less than $30,000 5 days
$30,000-$40,000 6 days
$40,001-$50,000 7 days
$50,001-$65,000 8 days
$65,001-$80,000 9 days
Over $80,000 10 days

HOW WILL EMPLOYEES BE AFFECTED?

The salary equivalent of an individual's total number of furlough days will be deducted equally from the remaining FY10 checks starting with the second check in October. Benefits and County Pension computations will not be affected. All County Employees will participate in the plan except: 1) No person will have their effective hourly pay reduced below the Federal Minimum Wage; and, 2) Employees exempt by law will not be affected (note that Council has approved inclusion of the Council Staff). Departments requiring 24/7 functional coverage will "make it work" without incurring additional overtime. Department/Agency Heads will work with employees to schedule furlough days to minimize service disruption. All furlough days must be taken by June 30, 2010. There is no change to the Annual Leave carry over policy.

So the mayor will file a law suit but not do anything about the crime and the police chief. Yup it is all about the money. Mayor Ireton, you are a rat bast***. Here you have people getting shot, stabbed and robbed but you want the money. Let me guess, you will use the law suit money to hire more employees? I doubt it. You are a coward!

Oh, my, this waste watrr tratment plant is Barry Tilghman's baby, and if there are any stand up persons in the city, I would advise them to look at why the bond and the contract were written in favor of the Brian and Gere Engineering firm? does the procurement law of the city state that anyone can give bond or insurance at such a low percentage of the total job? It is not the case with the legal operations of other cities, counties and state governemts. What did the "dream team" get in graft for making the cotract? especially one where the city of Salisbury residents get burned? Again, folks, Barry Tilghman at her best.

It is so sad that so many folks on her team are now blindsiding Jimmy Ireton, what is it going to take to have him wake up, and fire the bastards? How can he work in the viper pit and not expect to get bitten?

Kudos to Jim Ireton for going after this when Barrie Tilghman was content to let the taxpayers get SCREWED!

Maybe dealing with the chief is next? Maybe we're just seeing the start of what Ireton can/will do?

When one reviews the common RFP'S on the city website, most all jobs valued over $25k require the bidding contractors to put up 5% bid bond, 100% performance bond, and 100% payment bonds. This includes simpleton contracts like painting, sidewalks, and carpentry.
Why would this clause be excluded from an $84 million job?
Inquiring minds want to know. Any thoughts, Jim Ireton? There is a lawsuit waiting to happen, and Barrie T needs to be on the receiving end, among others. What do you think, Gary Comegies?

How much will that attorney make advising the mayor and council to pursue a worthless lawsuit and handling it?
