Lewes Man Charged With 6th DUI Offense


Last evening, a Troop 7 patrol officer was on Route 9, east of CR 261, when he observed a Chevrolet pick up swerving back and forth on the roadway. The officer stopped the truck and approached the driver- James B. Walsh.

When the Trooper spoke with Mr. Walsh, he could smell the odor of an alcoholic beverage coming from his breath. A DUI investigation ensued and the officer eventually took Mr. Walsh into custody.

Mr. Walsh was transported back to Troop 7 where a computer check revealed he had five previous DUI convictions- this arrest would make #6.

James Walsh was formally charged with Felony DUI and Failure to Obey a Traffic Control Device. He was committed to the Sussex Correctional Institute in lieu of $10,250.00 secured bond.

LOCK HIS ASS UP BEFORE HE KILLS SOMEONE! Our legal system sucks! I thought MD and especially DE were cracking down on drunk driving? Let us know how this one goes in court Joe

how these people are allowed to drive after #2 amazes me. maybe a judges daughter or son needs to be killed by a drunk driver before someone realizes this.

again, explain to me why this poison is legal and marijuana is not?

I wonder if anyone has been hurt? I wonder if he has damaged any property?
I wonder if he has done anything wrong, under common law.

Are we trying to PREVENT crime? Does that make us gods?

Years ago I served on a jury trying a case with a DUI. We asked about prior convictions and were told we were not permitted to know about prior arrests for DUI or similar charges.

"locking him up" is not going to solve the problem. How many years do you think he would get sentenced to? 3? 4? or even 5? Get real, he won't do much more than one to one and a half years. Yeah, we'll be safe from him during that time but do you think he will have learned his lesson by the time he gets out? NOT. He will head straight for the "store" to get his beer or liquor and start 'celebrating'. The only way to "stop him" would be to KILL HIM but we all know that our Christian/Judicial belief systems will not allow us to do that even though most of you (come on, admit it) would really like to see him executed.

The only chance he has to stay sober and straight when he gets out is to be in a court-ordered intensive outpatient treatment modality and hope to God it "takes". If it does, great. If not, well, this dude will join the ranks of the other two gentlement who this week earned their 7th DUI. Not a very hopeful situation is it?

Really, why has his license not been revoked?

I think it is absolutely ridiculous that we allow people to still hold a license after a DUI let alone after SIX!!!! There is no reason for a person to have the privilege of driving if they have such a severe drinking and driving problem. Driving is a privilege and not a right. Maryland and Delaware MUST start cracking down on these offenders. Thousands of men, women and children are killed every year due to drunk drivers. As a community, we need take a stand, voice our opinions and promote change.

11:56 do you actually think that "taking away his license" will stop him from driving in the future? No, it will not. That is a major problem that not even engine interlock devices can cure because the defendant can always "borrow" a car. Unfortunately, I have no answer to the problem.

If court ordered alcohol counseling will not work,then the least the courts can do is make sure he never is permitted to drive again,thanks to these drunk drivers all of us have to pay more in insurance.

The comments are extreme. Has this guy hurt anyone yet? Seriously, has he hurt anyone? don't we need to know before we punish him by poking out his eyes, hanging him, etc.
