Attorney General Frosh Joins Multistate Coalition Urging Supreme Court to Protect Workers’ Organizing Rights

21 Attorneys General File Amicus Brief in Mark Janus v. AFSCME Council 31, Urging SCOTUS to Follow Precedent That Empowers States to Manage Labor Relations

BALTIMORE, MD –
Maryland Attorney General Brian E. Frosh today announced that he has joined a coalition of 21 Attorneys General in filing an amicus brief urging the U.S. Supreme Court to uphold a Seventh Circuit decision protecting “fair share” provisions in public sector collective bargaining agreements.

The brief addresses Mark Janus v. AFSCME Council 31, a case that will be heard on February 26, 2018, that seeks to overrule precedent settled in the 1977 Supreme Court case Abood v. Detroit Board of Education, which states have relied upon for decades to negotiate labor contracts and ensure labor peace and efficient provision of government services. The brief argues that the Supreme Court should defer to states’ judgment on how best to manage their workforces.

I am a very strong believer in States rights. But in this case I question;

#1 Last sentence the word 'judgement' implies 'good judgement',
which the State of Md does not have.
#2 "...manage their workforces." If you've ever had any dealings with the State of Md you know they don't have a clue how to manage anything.Just think about healthcare/insur. or how well they are managing Balto.,ect.

Workers' right to organize are not in question. Federal legislation has protected that for decades.

What is in question is Unions' desire to extract dues from workers who chose not to join the union that has a contract with the worker's employer.

Unions place monetary income (dues) as their first and highest priority, and will agree to terms unfavorable to their members in order to secure that revenue stream. Undisputable.

Sussex County, DE erred badly recently in choosing not to enact a Right-To-Work law. Prospective new employers look very carefully at whether their new employees will be compelled to join or support a union against the employee's wishes.

It's all about forcing the Unions down our throats so the Unions will donate to their politics.
