Judge rejects Berlin Fire Dept. motion

The Berlin Fire Company’s motion for a partial summary judgment in the Zackary Tyndall case that alleges that he was harassed was denied last Thursday by U.S. District Court Judge Ellen Lipton Hollander.

Hollander’s rejection of the motion came just short of two years after Tyndall, a former fire company employee, filed his harassment complaint in August 2013.

In Lipton’s 63-page opinion, she said the case concerned allegations of employment discrimination and “intentional infliction of emotional distress” against two former coworkers of Tyndall, Bryon Trimble and Derrick Simpson.

Tyndall contended that he was fired in retaliation for reporting certain activities at the department, including his contention that the defendants created a hostile work environment that led to his severe depression.

Hopefully this will a s strong clear message concerning the consequences of a hostile work environment. The ramifications can be huge and very destructive to many!

Trimble and Simpson, now there's a pair of stupid rednecks if two ever walked. This show's the good ole boy network doesn't win them all.

Trimble is the nastiest, negative, arrogant SOB that calls himself a fireman. I should know, I work with him. He should have been fired years ago after the days inn incedent. The town of Berlin and OC get what they deserve.

I hope Mr. Tyndall holds out for every cent he deserves. Shame on the firemen that were part of the harassment & the leaders of the company that stood by and allowed it. Sure hope all involved are removed from their positions within the company.
