Ochse, Kendall plead to affray in fatal beating

There doesn’t seem to be any confusion about the fact there was a fight, but after that the consensus falls apart on what exactly happened in the early hours of Aug. 24, 2014, which happened to be the last day of Justin Cancelliere’s life.

The unconscious Pennsylvania man was pronounced dead at Atlantic General Hospital early that morning.

As part of the plea agreement between Christopher Kendall, Caleb Ochse and the State of Maryland, the pair conceded a number of points. The two were only charged with “affray,” or public fighting, and all other charges were either dismissed or nolle prosequi, where the prosecutor voluntarily agrees to not pursue a particular charge or charges.

State’s Attorney Beau Oglesby described, perhaps for the first time in public, the results of the investigation into the case.

A group of mature men, after drinking all day, allowed one of their group to pick a fight with two much smaller men barely out of their teens. After trying to ignore the aggressors for quite some time, the two turned and defended themselves. The group then foolishly took the main aggressor, now unconscious, back to their hotel instead of seeking immediate medical care, which he obviously needed desperately.

I guess the two were supposed to back down, offer the group more alcohol, and take them to the beach and hold hands singing Kumbaya until sunrise.

Instead, they gave the group the fight they were looking for. The bullies lost and, most unfortunately, one of them died in part because they were too stupid to call 911 for him. After all the initial hysteria settled down, the facts became clear. This has nothing to do with silver spoons. It's about a group of big bullies drinking all day, then picking on a pair of smaller guys for no good reason. They got what they were looking for.

Don't be so sure of this. This family couldn't even come up with bail money. They don't have anywhere near the money people think they have.
He's been treated like the tons of other losers in this country. We read time and time again (esp in the inner cities) of defendants getting reduced or not convicted at all for violent crimes. They were lucky to have any spoon in their mouths much less a silver one.

9:42 isn't right at all. Problem it appears was that the witnesses weren't available to testify because they were from Turkey.
