Delmar Family Denied Peace Order After Arson

DELMAR, Md. (AP) -- A Maryland judge has denied a peace order for a Wicomico County family whose landlord is charged with burning their home.

District Court Judge L. Bruce Wade told Eduardo and Patricia Machado on Tuesday that they didn't present convincing evidence that Andy Modeste of Seaford, Del., is an imminent danger. But Wade did rule that Modeste cannot contact the family as part of the ongoing criminal case.

So the landlord burned set fire to the house? While the tenants were inside? And that's not an imminent threat for a judge?

Legal question:If the tenants suffer dire consequences as a result of the judges decision,can the court then be sued?

there is no way the landlord can endanger the family he is still locked up. once he is released then the tide should turn for the family

2:07 will the family be notified? If not, they could be in danger and not know it. The judge should have just issued the order.

Judges are exempt from being sued in matters of the court.

Trying to murder you and your family doesn't make him an imminent danger? I bet my house and my paychecks for the next 10 years that if it was Wade's family in that house, the ruling would be much different.

Judge Wade made that decision before. If the person isn't standing there with a gun to your head, then you're not in imminent danger. Guess they're allowed to stalk you, etc. but that's not dangerous.LOL
