Ocean City Mayor: ‘It is Time To Move On’

OCEAN CITY — Despite a measure of closure in the long-running Dumser’s case last week, resort officials continue to assert ownership of the historic property on the east side of the Boardwalk, but are ready to move on.

The Court of Appeals last week denied a petition for writ of certiorari filed earlier this year by the town of Ocean City, which, if approved, would have had the state’s highest court take up the case involving ownership of the historic building on the east side of the Boardwalk at South Division Street. For decades, the building has been home to the iconic Dumser’s Dairyland, but ownership of the property was called into question when an agreement between the city and the Nathans Associates expired in 2016.

The ownership dispute began in Worcester County Circuit Court, which ruled in favor of the town of Ocean City. As a result, Nathans Associates, or the heirs of Nathan Rapaport, who built the structure in 1912, were enjoined from any use of the property and were given a timeline at that time to remove or demolish the historic building.

Ocean City officials should cease any action on Dumpsters this building and business is not OC's it is the Dumpster Family which has been a landmark for longer than my 72 years. Leave the family alone, please if there is any humanity on the part of OC and Nathan's Assoc you are just making yourselves look like greedy businessmen.

Its prime real estate. The rules go out the window when big money is at stake. Dumser family owns it. Always has. I am glad they keep standing up. Its one of the better stops in OC.

Wait until Dumser's needs a building permit for some type of renovation. It will be game on for the town to try and mess with them...

What needs to be looked into is who initiated this and why. Then that dumpy dopey half assed "lawyer" ayres needs to go. He's useless as a lawyer. And finally the last 2 election cycles has put some brains in that council. Drain the swamp of the rest of the losers.

No it is not time to move on unless meehan wants to reimburse tax payers out of his own pocket then and only then does he have a right to tell anyone to move on. What needs to be known is how much this asinine idea cost tax payers. And whose idea it was and why?
