Appeals Court Upholds Maryland Assault Weapons Ban

A federal appeals court has upheld Maryland's ban on 45 assault weapons and a 10-round limit on gun magazines.

The 4th U.S. Circuit Court of Appeals in Richmond, Virginia, issued the ruling Tuesday.

The court ruled that the banned assault weapons "are not protected by the Second Amendment."

The court says: "Put simply, we have no power to extend Second Amendment protections to weapons of war" that the Supreme Court's decision in District of Columbia v. Heller explicitly excluded from such coverage.

Maryland Attorney General Brian Frosh led the push to pass the law in 2013. He praised the ruling, describing it as "very strong."

"Weapons of war"????? No, a semi-automatic rifle is certainly NOT a weapon of war. I'm pretty sure that we send our guys over there with fully automatic and 3 shot burst capabilities. And a 30 round magazine just means less reloading. It doesn't make the gun more deadly.

The musket was a weapon of war. In WWI, the shotgun(aka trench gun) was a weapon of war.

Explain this "ban" too me. Is there a date after which you can not purchase an assault rifle, or is its illegal to posses any assault rifle? I bought an assault rifle in Maryland in 2011.

Dave T: A kangaroo court with clowns for judges and no respect for people's rights. What a joke. "Weapons of war!" Oooooh sooo scary. I hope these clowns wear proper clothing to cover up the big yellow stripe running down their backs. More liberal idiots who can't handle their own authority and lack the wisdom, understanding and maturity to render real world decisions. No wonder people have such little regard for this government. It's pathetic.

The 4CA simply misinterpreted not only 2A but other case law as well.....its called derelict of duty.
If they can do this with the 2A, whats to stop them with 1A or freedom of religion...or any other Right.

11:54 AM. YES, it was back in October of 2013 when the law was enacted... So From OCT 2013 until forever, there is a ban on AK-47's and guns that look like AK-47's and other various names of gun manufactures... Just read the list, its on MSP's website...

The 1911 presently on my hip was adopted by the US army 3/29/1911 and served until 1986, served in two world wars. Legal in Md. is it not a weapon of war?

11:54 you can keep it because you already have it. The law only prohibits the sale of them now not ownership. My advice is if you want another build it from an 80% lower. Completely legal.

Weapons of war would also included Remington 870, the Mossberg 500,.22 cal. rifles, 308 rifles and I could list several more. They were / are used on the front lines since Viet Nam. Proves this decision based on weapons of war should be discredited. They have ban so-called look a likes. The AR-15 is ban since it has the appearance of the M-16 which is fully auto. These weapons are illegal to own unless you have been approved by the Federal Government to own with a Federal license. This shows the Politian's ignorance by being uninformed. They are acting on peoples emotions to be elected / re-elected to their Government welfare position.

there is no such thing as an assault weapon. a weapon is neither good nor bad. the used of the weapon makes that determination.

If we have a war here, there's going to be a LOT of "weapons of war" being used, and half of them made from an 80% lower! I've got mine, and working on some for the kids! Look into it. It's the best gun I've ever had! The more unregistered firearms I own, the better I feel.

Also, although expensive, there's a trigger system out there that fires a round on the pull, and another on the release. It's faster than full auto, and currently a legal modification.

I have seen something like that because of the stock. It will make a semi auto fire as an automatic or you can flip a catch and it will fire semi auto. Genius but I wonder how long it will be legal.
